HomeMy Public PortalAbout2683 (10-16-56) 2� Y3 RESOLUTION N0. 2683 RESOLUTION OVERRULING PROTESTS IN CONNECTION WITH THE HEARING ON DEBT LIMITATION FOR THE PROPOSED IMPROVEMENT OF WRIGHT ROAD BETWEEN FERNWOOD AVENUE AIVD CENTURY BOULEVARD BY THE CONS.TRUQTION OF VITRIFIED CLAY PIPE SANITARY SEWERS, TOGETHER WITH n�LL INCIDENTAL �ND APPURTEN�NT WORK. WHEREAS, the City Council of the City of Lynwood did, on the 4th day of September 1956 approve an investigation report under the provisions of Division 4 of the Streets and Highways Cod.e, cited , as "Special Assessment Inv�stigation, Limitation.and Ma,jority Protest Act of 1931" as amend.ed, upon the proposed improvement of Wright Road between Fernwood Avenue and Century Boulevard. by the construction of vitrified clay pipe sewers together with a11 incidental and appurtenant work, as shown on Plan No. 1956-a-2 on file in the office of the City Clerk of sa.id. City, and WHEREAS, said. report havirig been d.uly prepared and.filed., a hearing wa.s held by said City Council on the 16th day of October, , 1956 in the manner provid.ed in said Act above referred to; a.nd WI�REAS, more than thirty days have expired since the date af mailing notices of hearing on said report; NOW, THEREFORE, the City.Council of the.City of'Lynwood. does hereby resolve as follows: 1. That the protests made at said hearing on said. investi- gation report be and the same are hereby overruled.. 2. That the public interest, convenience, and. necessity require the d.oing and. making of the public improvemerit set £orth and. described in said report above referred to and substantially in the manner set forth; 3, That the project consisting of the�proposed improvement above referred to is feasible, and that the land to be assesaed will be able to carry the burden of said proposed assessment. 4. Tha.t the estima.ted total amount proposed. to be assessed upon any or all lots or parcels of la.nd for the costs and. expenses -1- of said proposed. improvement d.oes not exceed the limitation of indebt- edness established and. set forth in said- act above referred to and will not, by the levy thereof, cause said. limitation to be exceed.ed. in any instance; 5. No ma.jority protest ha.s been £iled with the clerk of the legislative body by the owners of the property proposed to be assessed to pay the costs and expenses oP said proposed improvement. 6. That it is hereby ordered that the proceedings for the making of said proposed improvement be und.ertaken pursuant to the provisions of an Act of the Legislature of the State of 'California, designated as Division 7 of the Streets and Highways Code, cited. as the "Improvement Act of 1911, and amendments thereto,.'-'. °`�.`� �'� APPROVED and ADOPTED this 16th d.ay of October, 1956. . y .
