AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE EXTENSION OF THE CITY LIMITS OF THE CITY OF JEFFERSON, MISSOURI BY ANNEXING AND INCLUDING UNINCORPORATED REAL PROPERTY LOCATED IN THE COUNTY OF COLE, STATE OF MISSOURI, LYING SOUTHWEST OF THE PRESENT CITY LIMITS REFERRED TO AS THE ROUTE C/CAPITAL HILLS AREA AND AUTHORIZING AN ELECTION TO APPROVE THE EXTENSION OF THE CITY LIMITS THROUGH ANNEXATION. WHEREAS, on September 17, 2007, the City of Jefferson, Missouri declared by resolution of the City Council its intent to annex unincorporated territory described in Section 1 below into the City of Jefferson, Missouri. WHEREAS, the City of Jefferson has developed a "Plan of Intent' to provide services to the area proposed for annexation on the same bass upon which services presently are provided to the residents of the City of Jefferson, Missouri; WHEREAS, notices of the annexation public hearing, prior to final passage, were sent by certified mail to all fee owners of record having property in the proposed annexation area during the week of October 2, 2007; and WHEREAS, a public hearing concerning the annexation was advertised on October 21, October 28, and November 4, 2007, in the Jefferson City News Tribune; and WHEREAS, a public hearing was held by the City Council at 6:00 p.m., November+2 13, 2007, in Council Chambers, 320 East McCarty Street, Jefferson City, Missouri, at which time the "Plan of Intent' was presented; and WHEREAS, The Mayor and City Council of the City of Jefferson, Missouri, believe elections should be held in the City to determine if a majority of the qualified voters voting thereat are in favor of extending the limits of the City to included the unincorporated areas of land hereinafter described. 1 SUBSTITUTE WHEREAS, the effective date of the annexation of the real estate described below will be when approved by the voters or November 1, 2008, whichever is later. NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council determines and does affirmatively state that the unincorporated area described in Section 1 is contiguous to the existing city limits and is compact. Section 3. The City Council determines and does affirmatively state that the length of the contiguous boundary common to the existing city limit and the proposed area to be annexed is at least fifteen percent (15%) of the length and the perimeter of the area proposed for annexation. Section 4. The City Council finds and declares that the annexation of the 5 SUBSTITUTE unincorporated area described in Section 1 is reasonable and necessary to the proper development of the city. Section 5. The City has developed a "Plan of Intent' to provide services to the area proposed for annexation after the date of annexation. (Copy attached) Said Plan of Intent is hereby adopted. Section 6. A public hearing has been held, as provided by law, on the annexation of the unincorporated area described in Section 1. Section 7. A petition for Declaratory Judgement shall be filed as soon as possible after the final election. Section 8. A proposition to extend the City Limits of the City of Jefferson, Missouri, so as to embrace and include all that territory located in the County of Cole, Missouri, known as the Route C/Capital Hills Annexation Area, and as described in Section 1, shall be submitted to the voters of the City of Jefferson, Missouri and the voters of the unincorporated territory subject to the annexation proceedings, and an election shall be held and conducted for this area on Tuesday, the 5th of February, 2008. Section 9. If a majority of legal voters in the City of Jefferson vote in favor of the proposition, and a majority of legal voters of the unincorporated territory subject to the annexation proceedings shall vote in opposition to the proposition, a second election shall be held and conducted for this area to resubmit the proposition as described in Section 1, on Tuesday, the 8th day of April, 2008. Section 10. The Proposition to be submitted on February 5, 2008, and April 8, 2008, if necessary, shall be as follows: PROPOSITION NO. A Shall the corporate limits of the City of Jefferson,Missouri,be extended to include the unincorporated areas of land contiguous to the present city corporate limits named as the Route C/Capital Hills Annexation Area in Ordinance 14284 enacted by the City Council of the City of Jefferson, Missouri, on November 19, 2007? ❑ YES ❑ NO Section 11. The annexation shall be effective immediately upon approval by the voters, or November 1, 2008, whichever is later. Section 12. Upon the effective date, Section 1-17 of the Code of the City of 6 SUBSTITUTE Jefferson, Missouri is hereby amended by adding one new subsection which shall read the same as set out in Section 1. Section 13. Upon the effective date, the annexed area shall be in Ward 4 of the City. Section 14. The zoning of the annexed areas, as set out in the Plan of Intent, shall be established upon the effective date. Section 15. This ordinance shall be in full force and effect from and after its passage and approval. INTRODUCTION The Council of the City of Jefferson City, Missouri has expressed its intent to extend the corporate boundaries of the City to include the area known as the Route C/Capital Hills Annexation Area. Missouri law requires that prior to annexation, a report be prepared and presented at a public hearing setting forth the plans of the City for providing major municipal services. A timetable for the provision of these services and an indication as to the methods of financing also is provided. The following information has been compiled by the principal departments of the City of . Jefferson City, Missouri, responsible for the provision of services to newly annexed areas. A series of maps accompanies and is an integral part of this report. II. BACKGROUND 1. Description of Area. The City ofJefferson is proposing to annex approximately 308.85 acres in the unincorporated area of Cole County southwest ofthe City,referred to herein as the Route C/Capital Hills Annexation Area. (See Appendix A) The proposed area generally follows Highway 179 from the existing southerly City boundary, south to where Highway 179 turns west and re-enters the City. The area is generally bordered on two sides by the existing City limits. A map of the proposed area is attached as Appendix A. The legal description is attached as Appendix D. 2. Area is Contiguous. State law requires that the area be at least 15% contiguous. Sixty-Five percent (65%) of the proposed area's boundary is contiguous with the existing boundaries of the City. (See Appendix B). Thus this proposal meets the requirements of State law in this respect. • Revised Plan of Intent-FMAL.wpd 1 • 3. History of this Annexation Initiative. In June 2003, Mayor Landwehr created a standing committee of the City Council to study annexation. This became the Growth and Annexation Committee. In 2003 the Capital Area Partnership for Planned Growth(CAPPG), comprised of city and county residents,government officials,business persons, developers and others, formed to study the annexation policies of the City of Jefferson. CAPPG identified the Highway 179 Corridor as an area to receive priority consideration for voluntary annexation. In addition, CAPPG recommended that involuntary annexations should be limited in size and only be used in exigent circumstances. CAPPG recommended that voluntary annexation be used to the fullest extent possible. While recognizing that unanimous support for any annexation project is unattainable, CAPPG recommended that the City assess public opinion and elicit public input prior to proceeding with a plan. (Capital Area Partnership for Planned Growth, Final Report, October 8, 2004) Following the recommendation of CAPPG to examine the 179 Corridor area, the City conducted numerous public discussions over the past 12 months to determine whether annexation of • the Route C/Capital Hills Area was desirable, to gauge public opinion, and to determine specifically the boundaries of the annexation area. Six public meetings were held by the Council Committee on Growth and Annexation between January and July of 2007 annexation in the proposed area was discussed. (See Appendix E) The Council requested city staff divide the entire study area into twelve specific smaller study areas so that the Council could carefully decide the specific areas where annexation should be pursued. This is referred to as the initial study area. Neighborhood meetings were held in the populated parts of the study area. The initial meetings were facilitated by CAPG. The meetings also included input from current residents. In total twelve meetings were held over a six month period. A complete listing of the meetings is shown in Appendix F. Meetings were also held with other interested stakeholders, including landlords, Three Rivers Electric, AquaSource, and the Cole County Fire Protection District. After considering the comments of stakeholders in the Route C/Capital Hills Annexation Area and the costs and benefits to existing citizens, the Council elected only to pursue voter approved annexation in three and a half of the eight study areas. The area selected is shown in Appendix A. This reflects due consideration to the incremental approach urged by CAPPG and the County Commission. The official resolution initiating the annexation process was adopted on September 17,2007. Additional meetings are planned with neighbors and stakeholders during October and November. • Revised Plan of Intent-FWAL.wpd 2 • 4. Voluntary Annexations Will Not Achieve Goal. The City has had success in securing many voluntary annexations near the study area. However, voluntary annexations'have carried with them certain problems. First, the-tremendous response from land owners wanting to annex, creates a danger that other land owners, not yet ready to annex, will become islands, completely surrounded by the City. Indeed the City has had to refrain from annexing some property simply to prevent creating such islands. Secondly,voluntary annexations tend to be erratic based on development at specific locations. This does not lend itself to orderly and planned development thus failing to achieve a primary goal of annexation. III. REASONABLENESS AND NECESSITY OF ANNEXATION 1. Annexation of the area is reasonable and logical. Annexation of the proposed area is reasonable and logical for the following reasons: a. Development within the proposed annexation area will increasingly be'of an urban character. The Capital Hills Subdivision, one of several residential subdivisions in the area, lies in the northeast quadrant of the proposed annexation area and exhibits a residential density that is urban in character. This subdivision is indistinguishable from • the adjacent Colonial Hills Subdivision which is within the City. This 150-lot subdivision includes high density residential apartments as well as single family homes. The area around the Highway 179/Route C interchange is well situated for commercial development, and there are commercial uses at or near each of the `four corners' of this interchange. The largest farm that exists in the area was previously divided by highway extensions and is also well suited for urban development.Most ofthe smaller acreages in the area include residential homes. Such development is more appropriate within a municipal framework. Many retail and service establishments would prefer to be located within the City limits and therefore the lack of annexation will be a hindrance to the economic growth of the area. b. The City is in need of sites for residential and commercial development and such sites are available in the proposed area. C. Analysis of past growth patterns shows that much of the growth that would have occurred inside the City has instead spilled over into the unincorporated area immediately surrounding the city. d. The area and the existing City will benefit from the uniform application and enforcement of building, plumbing, and electrical codes. e. The area is not affected by flood hazard areas, however, it will benefit from the City's stormwater management program, particularly as development increases. The north • half of the area is part of the Frog Hollow watershed. As the area develops, sound Revised Plan of Intent-FINAL.wo 3 • storm water planning and management is needed to protect the current residents ofthe City. f. Since the County currently lacks zoning, the area will benefit from uniform planning and zoning practices. In addition the City's current residents will benefit by being protected from unplanned and unregulated growth immediately outside our borders. g. Highway 179 crosses in and out of the City limits in this area, and the Highway 179/Route C interchange is in close proximity to the City limits. This causes confusion and delay in responding to fire and police calls, particularly those involving vehicular accidents on the affected highways. h. Retail developments, offices, and residences will benefit from being constructed in accordance with the City's building and fire code. 2. Annexation of the area is economically feasible. Annexation of the proposed area will increase the total acreage of the city by less than 1.6%. Annexation of the proposed area will increase the population of the City by 1.7%. These are relatively small increases which can easily be accommodated. • The City is in a sound financial position. (Appendix G). The City is well capable of providing the services outlined in this plan. Annexation of the area is economically feasible for the following reasons: a. The City currently has authorized 88 sworn police officers. This includes three additional officers recently added. The number of officers is currently more than adequate and this puts the City in a position to look at annexation of relatively small areas such as this one without the necessity to fund additional officers. The current force is sufficiently large to handle the additional calls that the proposed area would likely generate for the foreseeable future. As shown in Appendix H, Jefferson City has a higher number of police officers per capita than most similar cities. b. The City Fire Department has recently added six additional officers and is sufficiently large to handle the calls generated for the foreseeable future (see Appendix H). Because the number of firefighters is more than sufficient currently, additional firefighters would not be needed if annexation were to be successful. Likewise the current number and location of fire stations would be sufficient to handle calls in the purposed area. Estimated response times are shown in Appendix I. C. The City already provides sewer to the northeast quadrant The City has already • installed sewer crossings under Highway 179 in anticipation of serving future Revised Plan of Intent-nNAL.wpd 4 • development on the west side ofthe highway.The existing treatment plant is sufficient to handle the expected increase in demand. The costs of sewer extensions would be borne by developers. d. The taxes generated from the area will be sufficient to cover the costs of maintaining existing public infrastructure. IV. LISTING OF MAJOR SERVICES PRESENTLY PROVIDED BY THE CITY OF JEFFERSON The various departments and agencies of the City of Jefferson currently provide a wide range of services to citizens residing within the present corporate limits. These services, listed by department or agency, are: 1. Police Protection: The Jefferson City Police Department protects the lives and property of our citizens with a force of 88 sworn officers. The Police Department divides the City of Jefferson into five zones (beats). Zone 1 is located on the north side of the City; Zone 2 is located in the east side of the City; Zone 3 is located in the central part of the City; Zone 4 is located on the south side of the City; and Zone 5 is located on the west side of the City. The Police Department provides the following services to the citizens of Jefferson City: • a. Crime prevention and detection maintained by comprehensive uniform patrol function for the apprehension of criminal offenders. Each officer is certified in Red Cross first aid and CPR. A Special Weapons and Tactics(SWAT)Unit has been created for rapid deployment,to high risk incidents and for the execution of search and arrest warrants. b. Traffic regulation, education, and enforcement program administered by specifically defined Traffic Unit. Advanced traffic accident investigation services with certified accident reconstructionists. C. State-of-the-art 911 Emergency Communications Center. Documentation and assistance for emergency and routine calls for service. d. School Resource Officers are assigned in Simonsen 91h Grade Center, Lewis & Clark Middle School, Thomas Jefferson Middle School, and Jefferson City Senior High School. Drug Abuse Resistance Education(DARE)program in public elementary and private parochial schools. e. Community Action Team(CAT)designed to apply contemporary community policing strategies to a diverse community. These policing philosophies and strategies focus on crime prevention, community/neighborhood partnerships, and customizing police service to meet the specific needs of the businesses and residents. Revised Plan of Intent-FINAL.wpd 5 i f. Specialized criminal investigation team for juveniles, domestic violence and evidence management. g. Community Service Unit emphasizing crime prevention programs such as Neighborhood Watch, Crime Stoppers, National Night Out, Sober Driver, vacation house watch list, security inspection for residences and businesses, a crime free multi- housing program, and numerous 2. Fire Protection: The Jefferson City Fire Department is a professional fire department with an authorized strength of 72 firefighters. Twenty-four(24)hour fire services provided by five existing fire stations. Through scheduling and manning requirements, residents are assured of having a minimum of twenty fire personnel on duty every hour of every day of the year. Centralized dispatching of fire personnel by the E-911 system ensures quick response to an emergency situation providing residents with increased personal safety. The Fire Department protects the citizens of our city by providing the following services: a. The Fire Department provides medical first responder service within the City in conjunction with Capital Region Emergency Medical Services.Firefighters are licensed Emergency Medical Technicians or Paramedics. Capital Region provides ongoing • training to the firefighters and staffs an ambulance in one ofthe City's stations. Staffed apparatus are equipped with external defibrillators, oxygen equipment, and other medical equipment. b. Limiting structural fire damage within the first few minutes is critical and is accomplished by responding with adequate manpower immediately upon receipt of a call to E-911 central dispatching. Dispatched to every structural fire within the City are two engine companies, a ladder company, squad company, and an assistant chief. C. Rescue services provided for disentanglement from automobiles, farm equipment, or other machinery is handled by two strategically located squad companies. d. Other fire protection services provided by the City ofJefferson are fire code inspection, public fire safety education, and service calls, such as pumping basements and responses to carbon monoxide alarm calls. 3. Parks and Recreation: The Department of Parks and Recreation has 80 full and part time employees to provide for the diverse leisure, conservation, recreation and aesthetic needs of the community. The Parks Department operates a wide variety of facilities, programs and special events on a year-round basis for all age groups and abilities. The Department offers and manages: a. A 1,325 acre park system with facilities for a multitude of passive and active recreation programs and special events. The park system contains fifteen properties, Revised PIm of Intent-HNAL."d 6 • ranging in size from one acre to over 600 acres, including 165 acres North of the Missouri River. b. Active recreational facilities that includes two swimming pools, eleven lighted athletic fields, over 12 miles of paved multi-purpose greenway trails, an 18-hole public golf course, an indoor ice arena, tennis courts, a skateboard park and fifteen miles of mountain biking trails. C. Passive recreational facilities that includes 175 acres of fishing lakes, six large picnic pavilions, twelve playground equipment areas, one recreational vehicle campground with eighteen full hook-up sites, and an indoor ice arena. d. Protection and maintenance of trees on public property; enforcement of hazard tree measures. 4. Community Development: The Department of Community Development focuses on maintaining, improving, and developing the City of Jefferson. Tasks are provided by ten divisions: a. Planning Division has 4 employees to oversee the orderly growth and development of the City. Planning entails not only review of proposed developments within the City to be sure that they comply with federal,state and local laws,but includes procedures • for evaluating how the City will evolve, and preparations to assure that such growth is rational and compatible with the existing community. The staff of the planning division: (1) Administers the City's zoning and related development codes, and maintains the City's comprehensive plan and zoning map.The purpose of zoning is to protect property values and to encourage intelligent development by ensuring compatible uses; (2) Assists the Planning and Zoning Commission with zoning administration in the areas of comprehensive plan amendments,zoning text and zoning map changes, subdivisions, special exception and planned unit development applications; (3) Assists the Board of Adjustment. Missouri cities who have enacted zoning must also have a mechanism to assist property owners who may be unable to comply with the strict letter of zoning provisions. The Board ofAdjustment provides a remedy for those property owners by providing a forum for hearing applications for appeals,interpretations, and variances. In addition, the Board of Adjustment reviews and processes conditional use permit applications and variances to the advertising and sign code and flood hazard regulations; (4) Facilitates citizen input at Planning and Zoning Commission and Board of Adjustment meetings,which are made up ofcitizens appointed from the community, by newspaper publication of required notices,posting • of signs, and direct mail to adjoining and affected property owners Revised Plan of Intent.FINAL.wpd 7 when a landowner proposes to change zoning or apply for certain classes of land use permits. (5) Reviews proposed subdivision plats and development plans to ensure the development of a continuous street system, logical street naming and numbering systems,availability ofadequate utilities and compliance with zoning codes; (6) Assists local groups with neighborhood planning matters; and (7) Participates with the Capital Area Metropolitan Planning Organization, in long range and transportation planning within Jefferson City metropolitan area, in conjunction with the Missouri Department of Transportation and U.S. Department of Transportation. b. Street Division has 26 employees to repair and maintain 251 miles ofpublic streets and alleys. Specific related responsibilities include: (1) Snow plowing and chemical treatment for snow removal; street sweeping and annual street resurfacing program. (2) Maintenance and replacement ofpublic storm drainage systems;minor repair and replacement of curbs and gutters, maintenance of rights of way. (3) Maintenance of City owned and operated street lights, traffic signals, • traffic signing and pavement markings. (4) Issuance and inspection of street cut and right of way excavation permits, inspect and patch street excavations. C. Wastewater Division has 31 employees to operate a wastewater system that treats eleven million gallons of wastewater each day and maintains 400 miles of gravity sewers and 30+pump stations. Specific related responsibilities include: (1) Supervision of construction to upgrade and expand the system;works with developers to extend lines to developing land. (2) Administration of a pretreatment program with certain industries. (3) Twenty-four (24) hour response to sewer backups, system overflows and odor complaints. 1 (4) Line location for property owners, plumbers, and utilities. d. Transit Division has 32 full and part time employees that provide public transportation to city residents. Three types of service include: (1) Fixed route bus system is operated over set routes with regular time schedules from Monday through Friday 6:45 a.m. to 5:45 p.m. Revised Plan of Intent-PINAL.wpd 8 • Regular fare is$1.00. A"half-fare"program is available by application for eligible patrons. (2) City-wide paratransit service, Handiwheels, available to qualified disabled residents. The fare for this curb-to-curb call-in service is $2.00 per one-way trip. (3) Shuttle services for state employees from remote parking locations to the work site. e. Airport Division employs three individuals to operate and maintain the municipal airport located in North Jefferson City. The Jefferson City Memorial Airport has a 6000 foot main runway,a 3400 foot crosswind runway,taxiways and parking aprons. (1) Facilities accommodate 40,000 operations per year for government, commercial and private use. (2) The Air Traffic Control Tower is operated by an FAA contractor. f. Animal Rescue Division has 6 employees to protect the community from the spread of • feline and canine diseases. Personnel are on call 24 hours a day for emergencies. The following services provided: (1) Care of unwanted animals; pick up stray or roaming animals remove and provide help in removing nuisance wildlife and wild animals from homes, yards, and out-buildings; (2) Assist in finding animals that have bitten a person and see that proper steps are taken to insure the maximum safety of this person; protect persons and property by issuing summons to violators; (3) Pick up dead animals from the City streets, yards, and, upon request, houses;assist the police when threatened by animals in the performance of their duties. (4) Help find missing animals; locate homes for unwanted pups, kittens, dogs and cats when possible, provide electronic ID chip program for all adopted animals leaving City shelter. g. Building Regulations Division with 5 employees administers all building, electrical, plumbing, and property maintenance codes. Codes are enforced to protect public health and safety of the public as affected by building design, construction, repair or demolition of buildings. Specifically included: • Revised Plan of Intent.P7NAL.wo 9 • (1) Site inspections to ensure conformity with zoning regulations, for set back requirements, and appropriate use of property. (2) Issuance of demolition permits for all structures to be removed, sign permits and inspect to ordinance conformity. (3) Advice and technical assistance to the public, engineers, contractors and other professionals on building code requirements. h. Environmental Services Division has 6 employees who protect the health and safety of the public by performing the following services: (1) Inspect various types of food services: restaurants, taverns, hospital kitchens,licensed child care,schools, grocery and convenience stores, temporary food stands and mobile food vendors; provide design guidance to contractors/owners of new or remodeled food service establishments. (2) Investigate complaints and resolve problems concerning water supplies used for consumption and food service establishments. • (3) Oversee City's trash contractor and compost site provider;investigate complaints and resolve violations of illegal dumping, trash accumulations, litter, hazardous materials, unsanitary or hazardous conditions to include rodents or vermin,dead trees,icy sidewalks,open cisterns or wells,bird roosts, and open burning of illegal materials. (4) Provide a seasonal mosquito and weed control program. i. Engineering Division has 12 employees to survey, design, manage and inspect city capital projects/ developer infrastructure improvements to protect the public and provide safe/efficient systems for the public. Specific services: (1) Design/prepare plans and inspect public works construction projects for street,sanitary sewers,and stormwater improvements;review plans for subdivision development and inspection of public facilities. (2) Administer flood hazard ordinances; review plans prepared by developers and others which alter or extend the storm drainage system and sanitary sewer system. Parking Division has 8 employees responsible for 2 parking garages, 21 reserved and metered parking lots, and 950 on-street metered parking spaces. Specific duties include: (1) Operation of city lots/meters; enforcement of parking ordinances. (2) Maintenance of parking facilities: sweeping, snow removal. 5. IT/GIS Develop and maintain Geographic Information System(GIS); prepare and update public record maps ofstreet rights-of-way,sanitary system,and stormwater system;coordinate utility activity. 6. Housing Authority: The Jefferson City Housing Authority provides assistance to eligible citizens and neighborhoods. These services include: a. Public housing for families, elderly and disabled; b. PROPOSED TIME SCHEDULE WHEREBY THE CITY PLANS TO PROVIDE SERVICES TO THE RESIDENTS OF THE ANNEXATION AREA The City of Jefferson plans to provide services listed in the preceding Section IV to the residents of the Annexation Area on the effective date of annexation, with the following modifications: 1. Police Protection Jefferson City will provide police service to the Annexation Area immediately upon the effective date of its annexation. The Jefferson City Police Department maintains a patrol staffing requirement that provides 24 hour patrol services to its residents. Analysis ofpreliminary crime figures and calls for service in the Annexation Area reflects a call load that will not adversely impact work load levels for the Police Department with current personnel strength. The amount of area involved is also a factor as it related to response times within the Annexation Area. Current analysis of calls for service do not indicate a need to add additional personnel. The Jefferson City Police Department offers a variety of services that will be extended to the residents in the proposed Annexation Area. Community Policing and Problem Oriented Policing will be extended to include residents in the proposed Annexation Area. • 2. Fire Protection The City will assume fire protection services in the proposed annexation area upon the effective date of the annexation. The City will continue to cooperate with existing fire protection districts and other fire service providers. The City will work cooperatively with the water districts and land developers to attain the desired standards for fire hydrant and water system distribution capabilities. For certain remote areas, the City may place some reliance on the tanker truck capabilities of the fire district by agreement. The fire hydrant spacing standards are 300 ft. for commercial/industrial/institutional areas and 600 ft. for single family residential areas. The City will respond to calls for service from the City's closest staffed station and,depending upon the nature of the call, additional stations, apparatus and personnel will respond. 3. Parks and Recreation: The general policy ofthe Parks and Recreation Commission has been to evaluate the potential park and recreation needs of annexation areas and to address provision of park and recreation programs and facilities for those areas on an equal basis with all other areas within the community. The proposed Annexation Area contains no Park and Recreation facilities at the • present time. Revised Pim of lntent-FINAL.wpd 12 • 4. Community Development: a. Planning and Zoning The Existing Land Use Map is attached as Appendix J. The Proposed Zoning Map for the area is attached as Appendix K. b. Streets (1) Street Maintenance: Jefferson City will be responsible for maintaining, including snow removal, all streets in the area which are currently being maintained by Cole County. Those streets in the annexation area that have not been accepted for maintenance by Cole County will not be maintained by Jefferson City. (2) Street Signs and Marking: Street signing and marking will begin immediately upon annexation and will be completed within three years of the effective date of annexation. (3) Street Lights: The City has an adopted policy for street lighting in • improved subdivisions, subject to budget constraints, with the following criteria: • Installation of the street lights will generally be at spacings no less than 250 feet (residential) and 180 feet (commercial). • The spacing may be less at locations of abrupt horizontal or vertical grade changes when needed for traffic safety. • The City may grant additional lighting on the basis of high concentration of pedestrian traffic such as downtown, school areas, serious traffic hazards, or high incidence of crime as determined by the Chief of Police. • Property owners requesting lighting would pay 25 percent for residential property and 50 percent for commercial property for the cost of installation and the City would install and pay for maintenance and operation when installation is complete. Subdivisions that have installed operational street lights will be credited with the 25% contribution. Private street lights may be turned over to the City for maintenance. The estimated cost to the City ofconverting private lights and installing a sufficient number of new lights is approximately$30,000. Revised Plnn of Intent-FINAL—pd 13 • (4) Capital Improvements-Streetlights. Ifthe annexation is successful the City will add additional streetlights to the area, at no cost to the property owners. Estimated cost of these improvements is $35,000. A conceptual plan is shown as Appendix M. C. Wastewater Wastewater generated within the Annexation Area is presently being collected and treated in a number of ways. Property currently served by septic tanks will continue to utilize that service until such time as growth in the area makes appropriate alternate services, such as construction of additional collector lines,based on size and timing of development. The City does not participate in the cost of constructing collection system lines in new subdivisions. The Department of Community Development reviews sewer construction plans submitted by developers, inspects construction work as it progresses, and accepts lines for maintenance when all City standards have been met. As the region develops and it becomes appropriate to make investments into infrastructure for wastewater treatment, the City will look to its wastewater fund, to economic development grants and to developers and owners who are generating the waste to fund improvements to the system. These improvements will occur in conjunction with and as the property is developed and will not be built generally in • advance of user demands. Some portions of the area will be served by existing City facilities where they are in proximity to those facilities and the terrain would enable those connections to be made at reasonable cost-benefit ratios. d. Transit Regularly scheduled bus service is provided within the City's boundaries on fixed routes. No changes are planned on the fixed routes that would affect the proposed annexation area at this time. Factors considered when determining fixed routes include population density,major trip generators,customer demand for service,income levels, and vehicle ownership. Areas within the proposed annexation area will be periodically reviewed and evaluated to determine possible routes which may be needed in the future. Additions to the fixed routes are also subject to the availability of increased funding from federal and local sources. i The paratransit service, Handiwheels, is a specialized service for the mobility impaired population. Federal law requires the service be provided within nine blocks of all fixed transit routes. However the City strives to make the service available beyond the nine-block area depending on availability of vehicles, drivers and funding. Extension this service into the annexation area will occur as demand dictates. e. Stormwater Drainage Jefferson City will be responsible for maintaining all public drainage facilities in the area which • are currently being maintained by Cole County. Revised Plan of Intent-FWAL."d 14 • Requests for local storm drainage improvements submitted by annexation area property owners will be given consideration equal to similar requests submitted by property owners currently residing in the City. The City does not participate in the construction of local storm drainage structures in new subdivisions. The City has constructed certain major storm drainage facilities in Jefferson City in recent years and will review the need to construct such facilities in the Annexation Area. 5. Jefferson City Housing Authority: The citizens of the Annexation Area will be eligible for consideration for programs offered by the Jefferson City Housing Authority. It must be noted,however,that(1)individuals,families, and areas must meet federally-established income and other participation criteria; (2) certain services, such as access to public housing, are operated on a "first come, first served" basis; and, (3) many of the Housing Authority services are dependent on federal funding. Any reductions in available federal funds would cause a corresponding reduction in services offered. • Revised Plan of Intent-MAL.wpd 15 • VI. EFFECTS OF ANNEXATION 1. Property Tax. Property within the City of Jefferson is assessed by the Cole County Assessor. Property within the City is assessed in the same manner as is property located outside the City. The level of assessment is based on a percent of true value. a. Residential property is valued at nineteen percent of true value, farmland is valued at twelve percent of true value and commercial property is valued at 32 percent of true value. New construction is assessed according to the above stated rates. The current property tax rate is $.5172 per one hundred dollars of valuation. 2. Comparison of Annual Financial Impact for Residential Property Owners Based on a$120,000 home, $20,000 in Personal Property(cars). For many • families this is an extremely in-expensive alternative not available outside of the City. Revised Plan of Intent-FMAL."d 16 • VII. EXISTING AND PURPOSED LAND USES 1. Existing Land Use A. Current Land Use Acreal;e. Land use surveys were conducted in May 2007 and updated in September 2007. The current land use is depicted on Existing Land Use Map. (Appendix J) Existing land use acreage is shown in the following table. Agricultural Uses. Some agricultural uses exist in the area,mostly west of Highway 179 and associated with residential dwellings on small acreages. The largest farm in the area was bisected by previous highway improvements, most recently the extension of Highway 179, such that portions ofthe farm are located within each quadrant of the annexation area. • 17 • C. Existing and Future Commercial Land Uses. Commercial development in the area is located in fairly close proximity to the Route C/Highway 179 interchange. A mini-storage business is located in the southeast quadrant with access from Route C, while Green Horizons plant nursery/landscaping and a copy machine repair business are located southwest of the highway interchange. A number of commercial uses consisting of a mini-storage and three automotive oriented businesses are located in the northwest quadrant, along Rock Ridge Road. Away from the interchange, a day care center is located near the Capital Hills Subdivision,on the corner of Southridge Drive and Rolling Hills Drive.An automobile restoration operation is located above the northeast corner of the interchange at the end of Southridge Drive. A few home based businesses also exist in the area. Future commercial development in the area is likely to be focused in the vicinity of highway intersections. D. Recreational Uses. The Parks and Recreation Commission owns no park land in the proposed annexation area. In the mid-1980's the Parks and Recreation Commission was petitioned by residents ofthe Rolling Hills, Southridge and Lexington area to create a neighborhood park at the corner of Rolling Hills Road and Southridge Drive. In the late 1990's the • Commission subsequently acquired the property for future development as a neighborhood park. A conceptual development plan, attached as Appendix L has been prepared and some funding for development ofneighborhood parks was included in Capital Improvement Sales Tax"E"approved in November 2006 by City voters. It is the intent ofthe Parks and Recreation Commission to develop the property as a neighborhood park within three years of the effective date if the proposed annexation is successful. E. Residential Uses. Residential subdivisions included in the proposed annexation area are Capital H ills, Empire Subdivision,Neutzler's Early American,Section Two,Ridgeview Estates,and Rolling Hills in the northeast quadrant; and Foster Estates and Barnes Replat of Stock's Subdivision in the northwest quadrant. A total of 277 dwelling units were counted during land use surveys conducted in May 2007. Based on the Census Bureau's statistic of 2.4 persons per dwelling unit in Cole County, and an estimated housing vacancy rate of 8%, the population of the proposed annexation area is estimated to be 611 persons. • 18 • F. Single Family Residential Uses A total of 120 single family residential houses were identified in the land use survey. The majority of these single family homes are located in the northeastern quadrant of the area in the Capital Hills Subdivision. G. Multiple Family Residential Uses Multi-family residential housing units outnumber single family residential units in the area. The majority of the 157 multi-family residential housing units are located in the Ridgeview Estates Subdivision along Southridge Drive and Foxbar Terrace. Multi- family residential structures are also located along Saratoga Boulevard within the Capital Hills Subdivision. H. Roadways The public road pattern is dominated by the recently completed extension of Highway 179, stretching south from West Edgewood Drive to its junction with US Highway 54. Currently the only access to Highway 179 in this area is at the Route C/Highway 179 interchange. Highway 179, Missouri Route C, and Missouri Route CC are state • owned and controlled highways which pass through the area. Major local roadways in the area include Rockridge Road and Southridge Drive. Other residential streets in the area include Plymouth Rock Drive,Concord Avenue,Saratoga Boulevard,Rolling Hills Drive, Lexington Drive, Yorktown Drive, and Foxbar Terrace. Privately maintained roadways within the Route C/Capital Hills Annexation Area include Northwood Drive and Norbert Lane. I. Other Land Uses Other land uses include four (4) billboards located along Route C. There are no utility substations in the area. There area no identified church properties in the annexation area and no identified cemeteries. There are no mobile homes within the area. There are several undeveloped lots within the proposed annexation area which have been classified as `vacant"on the Existing Land Use Map.Notable among the vacant lots are those within the Capital Hills Subdivision,which, although platted,no streets or utilities have been constructed to serve many of these lots. 2. How the City Proposes to Zone the Area to be Annexed The Proposed Zoning Map (Appendix K) shows how the City proposes to zone the area. Existing developed or known future land uses were matched with the appropriate zoning district. Vacant • 19 • residential lots are proposed to be zoned according to the existing residential density within the subdivision or neighborhood. Proposed district boundaries follow property lines. Descriptions of proposed zoning classifications are provided at the end of the Section. Agricultural Areas/Undeveloped Areas Proposed Zoning:RURural Use(Color Code:Light Green) The area consists of approximately 84 acres of agricultural land proposed to be zoned RU Rural Use. Commercial Areas Proposed Zoning: C-O Office Commercial (Color Code: Pink) One property consisting of approximately 0.3 acres is proposed to be zoned C-0 Neighborhood Commercial. Proposed Zoning: C-I Neighborhood Commercial(Color Code:Light Red)One property consisting of approximately 3.2 acres are proposed to be zoned C-1 Neighborhood Commercial. Proposed Zoning:C-2 General Commercial(Color Code:Red)Approximately 20 acres are proposed to be zoned C-2 General Commercial, consisting of seven (7) properties. All are currently in use as commercial establishments. Single Family Residential Areas • Proposed Zoning: RS-2 Single Family/Low Density Residential(Color Code: Yellow) The proposed RS-2 zoning lies along Southridge Drive and north of Rockridge Road and consists of large lot residential development. Approximately 37.8 acres are proposed to be zoned as RS-2 single family residential. Proposed Zoning: RS-4 Single Family/Medium Density Residential (Color Code: Light Green) The existing single family homes in the Capital Hills Subdivision and the Rolling Hills Subdivision are proposed to be zoned RS-4. Approximately 41.3 acres are proposed to be zoned as RS-4 single family residential. Multiple Family Residential Areas Proposed Zoning: RD Medium Density Attached Residential (Color Code: Brown) Three residential duplexes consisting of approximately 0.5 acres are proposed to be zoned RD Medium Density Attached Residential Proposed Zoning: RA-I High Density Residential(Color Code: Bright Green) Several areas of multi-family residential development have been constructed within the Capital Hills Subdivision. Approximately 4.1 acres are proposed to be zoned as RA-1 High Density Residential. • 20 Proposed Zoning: RA-2 High Density Residential (Color Code: Dark Green) Existing multi- family residential developments along Southridge Drive and Foxbar Terrace are proposed to be zoned RA-2 High Density Residential. The proposed RA-2 zoning consists of approximately 18.4 acres. 3. Summary Description of Proposed Zoning Districts Jefferson City zoning districts have three distinct use categories, (1) Permitted Uses, (2) Conditional Uses and (3) Special Exception Uses. Review and approval by the Planning Commission and Council are required for Special Exception Uses. Review and approval by the Board of Adjustment is required for Conditional Uses. Hearings and prior approval are not required for permitted uses. Additional information on the proposed zoning districts can be found in the Jefferson City Zoning Code, however, a brief description of selected districts follows. RU Rural Use District The RU District is intended for the maintenance of rural areas, the continued operation of existing farms and ranches and very low density residential uses. Some higher intensity uses and recreational uses may be authorized where adequate access and services are available. RS Single Family Residential Districts There are four single family residential districts in the Jefferson City Zoning Code. Land uses • within the four districts are identical. The districts differ only on the density and dimensional requirements with RS-1 being the lowest density residential district, and RS-4 being a medium density detached single family residential district. The RS-1 and RS-2 Districts implement the Low Density Residential (Detached) Development Plan Land Use Category and are intended for low density residential living and public uses that traditionally serve residential neighborhoods. The RS-3 and RS-4 Medium Density Residential Districts implement the Medium Density Residential (Detached) Development Plan Land Use Category and are intended for medium density detached single-family residential dwellings and activities that traditionally serve residential neighborhoods. RD One and Two Family Residential District. The RD District is intended for medium density residential development, such as duplexes, attached single family and detached single family residential dwellings. RA-1 and RA-2 Multiple Family Residential District There are two multiple family residential districts in the Jefferson City Zoning Code. The RA-1 District is intended for medium-high density residential living and includes various dwelling types including single family dwellings, duplexes, townhouses, row houses, and other multiple family dwelling types. The RA-2 District is intended for high density residential living and includes various dwelling types and densities including single family attached dwellings, townhouses, row houses, triplexes, four-plex dwellings, apartment buildings and other types of multiple family dwellings. • 21 • C-O Office Commercial District The C-O District is intended to provide areas for public, semi-public, institutional and professional offices where the buildings are grouped and surrounded by landscaping and open space areas. C-1 Neighborhood Commercial The C-1 District is intended to provide small convenient, indoor retail/commercial services and offices in residential neighborhood locations at an intersection or on a major street. C-2 General Commercial District The C-2 District implements the Commercial Development Plan Land Use Category. The C-2 District is intended to accommodate general trades and commercial services located in high traffic areas, and at busy intersections and highway interchanges.
