Rd. 19 Brad Kvanbek14 Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-08 RESOLUTION REGARDING VARIANCES FOR 2895 Co Rd 19 WHEREAS, Brad Kvanbek and Laura Kvanbek (the "Applicants") are the fee owners of property located at 2895 Co. Rd. 19 (the "Property"); and WHEREAS, the Applicants have proposed to construct a number of additions to the house located on the Property, which additions would necessitate the following setback variances: A. For front garage addition: 1) reduce front yard setback from 50' to 41.7'; 2) reduce side yard setback from 10' to 2'; and B. For garage addition to the rear (west) of house: 3) reduce side yard setback from 10' to 6.1'; 4) reduce rear yard setback from 30' to 19.1'; and C. For the front house addition: 5) reduce front yard setback from 50' to 36.6'; and WHEREAS, this matter was considered by the planning commission at its meeting on January 13, 2004 and by the city council on February 3, 2004. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that the above variances are granted to the Applicants for the stated purposes, subject to the following terms and conditions: 1. All variances are for only those additions and improvements outlined in the plans submitted by the Applicants and approved by the city; 2. The variances must be utilized within one year of the date of this resolution by Resolution No. 04-08 1 issuance of a building permit or permits or the approvals hereby granted will be null and void; and 3. The Applicants must pay to the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina that the above variances are justified because of the following hardships: 1. The variances are consistent with those of other houses in the neighborhood; 2. Poor soils and fill on the south side of the lot make expansion in that area impractical; and 3. The property contains an existing house, the location of which as well as the topography and existing trees on the lot constrain development elsewhere on site. Adams, Administrator The motion for the adoption of the foregoing resolution was duly seconded by member Workman and upon vote being taken thereon, the following voted in favor thereof: Workman, Lane, Smith, Brinkman and the following voted against same: (Absent: Zietlow) None Whereupon said resolution was declared duly passed and adopted.
