HomeMy Public PortalAbout2004-014 Resolution Granting Final Approval to the Plat of Belle TerraMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-14 RESOLUTION GRANTING FINAL APPROVAL TO THE PLAT OF BELLE TERRA WHEREAS, the city of Medina (the "City") has received an application from Laurent Land Development (the "Applicant") regarding the platting of certain land in Medina located generally north of Evergreen Road and east of Co. Rd. 101, which land is legally described in Exhibit A attached hereto (the "Property"); and WHEREAS, the City granted preliminary approval of the plat, which will be known as Belle Terra, on January 6, 2004; and WHEREAS, the Applicant has requested final approval of the plat which has been reviewed by city staff for compliance with city ordinances and the terms of preliminary plat approval. NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota that final approval of the plat of Belle Terra is hereby granted, subject to the following terms and conditions: 1. The Applicant must pay a park dedication fee in the amount of $56,234 in lieu of dedication of land, which fee is payable prior to issuance of the first building permit; 2. The Applicant must grant an easement to the City for ingress, egress and access from Linden Court to the exception parcel on Co. Rd. 101, which easement must be 20' in width and satisfactory in form and substance to the City; 3. The Applicant must pay an administrative fee to the City in an amount sufficient to reimburse the city for the costs of reviewing the plat; 4. The Applicant must execute a subdivision agreement satisfactory in form and substance to the City to ensure completion of the public improvements necessary to serve the lots in Belle Terra; and Resolution No. 04-14 1 5. The final plat must be filed with Hennepin County within 60 days of the date of this resolution or the approval hereby granted shall be null and void. Resolution No. 04-14 2 EXHIBIT A The Property is legally described as follows: Tract A, Registered Land Survey No. 167, except that part thereof lying South of the extension East of the North line of Tract B, said Survey, North of a line drawn parallel with and distant 5.0 feet South as measured at right angles to the South line of said Tract B and its extension East and West of a line drawn parallel with and distant 10.0 feet East, as measured at right angles to the East line of said Tract B and its extension South, Hennepin County, Minnesota.
