HomeMy Public PortalAbout2004-019 Resolution Granting CUP to Alpine Farms IncMember Workman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-19 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ALPINE FARMS, INC WHEREAS, Alpine Farms, Inc. (the "Applicant") has requested a conditional use permit to operate a commercial horse facility at 2182 Homestead Trail (the "Property"); and WHEREAS, the Property has been rezoned from rural residential to rural residential 2; and WHEREAS, the application was reviewed by the planning commission at its meeting on February 10, 2004; and WHEREAS, the matter was considered by the city council at its meeting of March 16, 2004; and WHEREAS, it has been determined that the commercial horse facility will not impede the orderly development of adjacent properties for the purposes for which they are zoned. NOW, THEREFORE, BE TT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicant for a commercial horse facility on the Property; subject to the following terms and conditions: 1. The maximum number of horses allowed on the Property is 90; 2. Hardcover on site will meet ordinance requirements; 3. There is to be a primary residence on the Property with a manager living in the residence; 4. A new septic system for the bunk house must be installed with an alternate site designated by November 1, 2004; 5. Animals must be kept off both the primary and alternate septic sites; 6. Animal feed and bedding, including hay, must be kept in a covered shed; 7. All recommendations of the MPCA, NRCS and USDA for manure and pasture Resolution No. 04-19 1 April 6, 2004 management must be complied with; 8. Manure is to be wind rowed no later than March 31, 2004; 9. In lieu of manure removal every 6 months, the manure must be composted and removed at least once per year. If manure that is not spread on site, used by nurseries or used in another environmentally responsible manner, it must be removed each year by December 31 st; 10. Soil testing for nutrients must be done twice per year with the results reported to a city. If the first two tests are favorable, further testing may be done at city staff s discretion; 11. It is recognized that the existing paddocks to the north do not have grass strips between them and the filter strip to the north is to be maintained. The two paddocks to the south of the bunkhouses are grass paddocks and the two that are not grass run into a shallow grass ditch. Runoff from all paddocks must filter through grassy strips; 12. No parking shall be allowed on the septic sites or grassy areas. Overflow parking shall be as shown on the approved site plan; 13. Outdoor approved special events shall be limited to 16 days per year. The city must be notified of all larger events, two weeks prior to the event; 14. Outdoor speakers may be used only for the allowed 16 days per year for special events; 15. Outdoor sanitary facilities must be rented for the special events; 16. All outside lighting must be downcast, shoe box style with no light source cast off the Property lines; 17. The fire marshal shall review the site for compliance with fire codes; 18. All trash containers must be screened by July 1, 2004; 19. Hours of operation shall be limited to 7 a.m. to 9 p.m., 7 days per week; 20. The number of employees shall not exceed 16; 21. Food for events shall be catered; 22. The Applicant must provide and enforce written guidelines for controlling the customers of the facility to prevent trespassing on adjacent property; 23. Handicapped parking must be provided per ADA requirements; Resolution No. 04-19 2 April 6, 2004 24. An emergency response plan for accidental spillage of manure must be implemented; 25. The Applicant must maintain secure fencing of a commonly accepted form adequate and appropriate for confining horses on the Property. The Applicant may be subject to city action if, within any 12-month period, horses escape from the Property on more than three occasions. 26. No burial of animals shall be allowed on site; 27. The current signage may remain. If any new signs are proposed, they must meet the city's sign ordinance; 28. For any new buildings, the exterior building materials must meet the city's ordinance for commercial buildings; 29. The tractor, manure spreader and other implements regularly used in stable operations may be kept outside; 30. The landscaping must be reviewed by city staff for any new buildings; and 31. The Applicant must pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this conditional use permit application.
