RESOLUTION OVERRULING PROTESTS IN CONNECTION
WITH THE HEARING ON DEBT LIMITATION FOR THE
PROPOSED IMPROUEMENT OF ALMA AVENUE BETWEEN
LONG BEACH BOULEVARD AND CALIFORNIA AVENUE
BY THE CONSTRUCTION OF CURBS, DRIVEWAYS, SIDE-
WALKS, AND GUTTERS, AND THE REMOVAL OF EXIST-
ING PARKWAYS, DRIVEWAYS, AND TREES.
WHEREAS, the City Council of the City of Lynwood did, on
the 7th day of September, 1954 approve an investigation report under
the provisions of Division 4- of the Streets and Highways Code, cited
as "Special Assessment Investigation, Limitation and Majority Protest
Act oP 1931" as amended, upon the proposed improvement of Alma Avenue
between Long Beach Boulevard. and. California Avenue by the construction
of curbs, driveways, sidewalks, and gutters, and the removal of exist-
ing parkways, driveways, and trees, including all incidental and
a.ppurtenant work, as shown on Plan No. 1954-J-2 on file in the office
of the City Clerk of said City, and
WHEREAS, said report having been duly prepared and filed,
a hearing wa.s held by `said City Council on the 26th day of October,
1954 in the manner provided in sa.id Act above referred to; and
6JHEREAS, more than thirty days have expired since the date
of ma3ling notices of hearing on said report;
NOW, THEREFORE, the City Council of the City of Lynwood
does hereby resolvecas follows:
l. That the protests made at said hearing on said investi-
gation report be and the same are hereby overruled,
2. That the putilic interest, convenience, and necessity
require the doing and making of the public improvement set forth and
described in said report above referred to and substantially in the
manner set forth; •
3. That the pro,jeet concisting of the proposed improvement
above referred to is feasible and that the lands to be assessed will
be able to carry the burden of said proposed assessment, and the
limitations on the amounts of as,sessments provided for in this part
,
may be disregarded, both with respect to the limitations on the dis-
trict as a whole and as to the limitation on individual specific
assessments,
4. That the estimated total amount proposed to be
assessed upon any or all lots or parcels of land for the costs and
, expenses of said proposed improvement does not exceed the limitation
} of indebtedness established and set forth in said act above referred
to and will not, by the levy thereof, cause said limitation to be
exceeded in any instance; •
5• That the written protests filed with the clerk of
the legislative boy by the owners did not constitute a majority of
the frontage of the property fronting on said proposed improvement.
6. That it is hereby ordered that the proceedings for the
making of said proposed improvement be undertaken pursuant to the
provisions of an Act of the Legislature of the State of California.,
designated as Division 7 of the Streets and Highways Code, cited as
- the "Improvement Act of 1911, and amendments thereto".
