HomeMy Public PortalAbout2572 (11-16-54) RESOLUTION N0. 2572 RESOLUTION OF INTENTION IN THE MATTER OF THE IM- PROVEMENT OF ALMA AVENUE BETS�TEEN LONG BEACH BOULE- VARD AND CALIFORNIA AVENUE BY THE CONSTRUCTION OF CURBS, DRIVEWAYS, SIDEWALKS, AND GUTTERS, AND THE REMOVAL OF EXISTING DRIVEWAYS AND TREES INCLUDING ALL INCIDENTAL AND APPURTENANT.�r70RK. 4JFiEREAS, pursuant to the provisions of Division 4 of the Streets and Hi�hways Code, cited as the "Special Assessment Investi- gation Limitation and Majority Protest Act of 1931", the City Council � of the City of Lynwood has determined that the improvement of Alma Avenue between Long Beach Boulevard and Caliiornia Avenue as proposed in Resolution No. 2565 of said City is feasible, and that the public interest, convenience, and necessity require the improvement sub- _ stantially as set forth in said report, and WF�REAS, said City Council has,found that the lands to be assessed will.be able to stand burden of the proposed assessment, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood as follows: Section 1: That in the opinion of the City Council of the City of Lynwood the public interest and convenience require and it is the intention of said City Council to order the following work or improvement, to be d.one, to-wit: The removal of certa.in existing improvements,including parkways, trees, driveways, curbs, and sidewalks and the construction of cement concrete curbs, cement concrete driveways and sidewalks, and cement concrete gutters, including all incidental and appurtenant work in certain portions of Alma Avenue lying between the center line of Long Beach Boulevard and the center line o£ California Avenue, including portions of intersecting streets. All of said work or improvement shall be performed in the public ways and between the limits hereinbefore designated except where the plans indica.te that said work shall be omitted. That all of the work or improvement a£oresaid shall be done and performed in accordance witih and to the grades shown on Plans and _1_ - i Specifications No. 1954-J-3 on file in the office of the,City Clerk of said City. Said plans are hereby referred to for a full and com- plete description of said proposed work and for the grades to which the work is to be done and said plans and specifications are by � reference mad.e a part hereof and shall govern for all details of the proposed work. � That the�total estimated cost of said work or improvement is the sum of Nine Thousand Ninety-seven and No/100ths Dollars ($j,097.00). That said contemplated work is of general public benefit and the ' said City Council hereby determines that forty per cent (40%) of the cost of said proposed improvement shall be paid from the general fund of said City. . Section 2: That said contemplated work or improvement, in . the opinion of said City Council, is of more tha.n loca.l or ordinary public benefit, and said City Council hereby determines and declares , that the district to be benefited by said work or improvement, and to be assessed to pay the costs and expenses of such work or improvement, is shown on Plan No. 1954-J-4 on file in the office of the City Clerk of said City, to which reference is hereby made for a full and complete description of the assessment district. Section 3: The City Council hereby determinea and declares that serial bonds shall be issued in the manner and form provided in Division 7 of the Streets and Highways Code cited as the "Improvement Act of 1911", as amended, bearing interest at the rate of six per cent per annum to represent each assessment of Twenty-five Dollars ($25.00) or over remainin� unpaid for thirty days after the date of recordation of the warrant; said serial bonds shall extend over a period ending nine years from the second day of January next succeeding the next October fif'teenzh £ollowing their date. Said bonds and interest thereon shall be paid at the office of the City Treasurer and the same shall be dis- bursed by him, all as provided in the said "Improvement Act of 1911", as amended. -2- Section 4: Notice is hereby given that the provisions of that certain Act of the Legislature of the State of California desi�- nated as the Streets and Highways Code, Division 4, cited as the "Special Assessment Investigation Limitation and Majority Protest Act ' of 1931", as amended, have heretofore been fully complied with and all the reports required under the provisions of said Act are on file in the office of the City Clerk of said City, open to public inspection, and may there be examined by all interested persons. Section 5: The proceedings for the aforesaid work or im- provement shall be taken under an Act of the Legislature of the State of California designated as the Streets and Highways Code, Division 7, cited as the "Improvement Act of 1911", and amendments thereto. Section 6: _.The City Engineer is hereby directed to make a diagram of the property af£ected or benefited.by said proposed work or improvement as described herein and to be assessed to pay the costs and expenses of said work, showing each separate lot, piece, or parcel of land and the dimensions of each such lot, piece, or parcel of land and the relative location of the same to the work or improvement proposed to be done, all within the limits of said assessment district. Section 7: Notice is hereby�given that on Tuesday, the 21st day of December, 1954 at.the hour of 8:00 o�clock p,m., at the Council Chambers in the City Hall, 11330 Bullis Road, in the City of Lynwood, any and. all persons having any objections or protests to said proposed work or improvement, or to the extent of the district to be assessed, or to the grades to which the work is proposed to be done, may�appear before sa.id City Council and show cause why said proposed work or im- provement should not be carried out in accordance �aith this Resolution. Seetion 8: The City Engineer, who is the Superintendent of Streets, is hereby directed to post notices of the passage o£ this Resolution in the time, form, and manner required by law. Section 9: The City Clerk shall certify to the passage of this Resolution by the City Council of said City o£ Lynwood and cause the same to�be published twice in t�he Lynwood Press, a weekly netvspaper -3- published and' circulated in said City and hereby designated by said City Council for the purposes aforesaid, Said Clerk is also directed to mail notices of the adoption of this Resolution of Intention in the time, form, and ma.nner, and to the persons, a.11 as provided in said "Improvement Act o£ 1911", as amended, _-'`` �.
