HomeMy Public PortalAbout2004-023 Resolution Granting CUP to Wright-Hennepin Cooperative Electric Associationk Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-23 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO WRIGHT-HENNEPIN COOPERATIVE ELECTRIC ASSOCIATION WHEREAS, Wright -Hennepin Cooperative Electric Association (the "Applicant') is the owner of property located on Willow Drive and legally described as Lot 1, Block 1, Medina Parks Second Addition, Hennepin County, Minnesota (the "Property"); and WHEREAS, the Applicant has proposed construction of an electric substation on the Property; and WHEREAS, the city's zoning ordinance allows the proposed use in the zoning district by conditional use permit; and WHEREAS, the application was considered by the planning commission on October 14, 2003; and WHEREAS, the application was reviewed by the city council on November 4, 2003, March 3, 2004 and April 6, 2004; and WHEREAS, it has been determined that the Applicant's proposed use of the Property will not impede the orderly development of adjacent properties for the purposes for which they are zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that a conditional use permit be granted to the Applicant for construction of an electric substation on the Property, subject to the following terms and conditions: 1. The parking lot and driveway be constructed to a 9 ton capacity; Resolution No. 04-23 April 20, 2004 1 2. All exterior lighting must be designed and installed to be downcast only, with a maximum of 0.2 foot candles at the property line and the light poles may be a maximum of 30' in height; 3. Landscaping must be installed in accordance with an approved landscape plan, which must include a variety of evergreen material; 4. The Applicant must comply with all requirements of the city engineer and watershed district, including approval of the site drainage plan; 5. Approval is granted only for the site elements shown on the approved plan. Any changes or additions will require consideration of an amended conditional use permit; and 6. The Applicant must pay to the city an administration fee in the amount necessary to reimburse the city for the cost of reviewing this application. Dated: April 20, 2004. ATTEST: Chad M.
