HomeMy Public PortalAbout2004-028 Resolution Approving Concept Plan for County State Hwy 29Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-28 RESOLUTION APPROVING CONCEPT PLAN FOR COUNTY STATE AID HIGHWAY 29 Whereas, the City of Medina, the City Maple Plain, MNDOT and the County in anticipation of development in this Northwest quadrant have negotiated a Concept Plan for future improvements to CSAH 29 attached to and made part of this resolution, and; Whereas, this Concept Plan has been accepted by MNDOT and County of Hennepin and; Whereas, the City Council, Planning Commission and Park Commission have reviewed the Concept Plan and request that trees along the east side of CSAH 29 Right -Of -Way be preserved in relationship to the proposed trail construction, and the City Staff has discussed the Concept Plan with the property owners adjoining CSAH 29 in the City of Medina, and; Whereas, City Council, City of Maple Plain, has adopted the Concept Plan for improvements to CSAH 29 with the condition that a permanent access to Loree's be included in the final plan. Now, therefore, be it resolved, that the City Council, City of Medina, adopts the Concept Plan for Improvements to CSAH 29 including conditions that a permanent access to Loree's be included in the final plan, and that trees be preserved along the east side of the CSAH 29 Right - Of -Way involving the trail construction. Adams, City Administrator The motion for the adoption of the foregoing resolution was duly seconded by member Workman and upon vote being taken thereon, the following voted in favor thereof: Workman, Lane, Zietlow, Smith and the following voted against same: (Absent: Brinkman) None Whereupon said resolution was declared duly passed and adopted. Resolution No. 04-28 May 4, 2004 NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina that the above variances are justified because of the following hardships on the Property: 1. The variances are consistent with those of other houses in the neighborhood; 2. The Property contains an existing house, the location of which on the lot constrains development elsewhere on site; and 3.
