Mayor Pro Tern Sternquist called the City Council Regular Meeting to orde r at 7:30
p.m. in the Council Chambers located at 5938 Kauffman Avenue , Temple City .
2. ROLL CALL
PRESENT: Councilmember-Chavez, Fish , Man , Sternquist
ABSENT: Councilmember-Yu
ALSO PRESENT: City Manager Cook, City Attorney Vail , City Cle rk Kuo
Councilmember Chavez made a motion to excuse Mayor Yu for cause . Seconded
by Councilmember Fish.
3. INVOCATION
Pastor Jim Walden , First Baptist Church of Temple City, provided the invocation .
4. PLEDGE OF ALLEGIANCE
Boy Scout Troop #161 provided a flag ceremony and led those present i n the
Pledge of Allegiance .
5. CEREMONIAL MATTERS -PRESENTATIONS -None
6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA
Lucy Liou , Temple City resident, shared upcoming Neighborhood Watch meeting
dates.
7. CONSENT CALENDAR
Mayor Pro Tern Sternquist asked questions regarding item 7C , "THIRD
AMENDMENT TO THE AGREEMENT FOR USE OF FACILITIES WITH TEMPLE
CITY UNIFIED SCHOOL DISTRICT FOR GENERAL FACILITY USE".
City Manager Cook answered Mayor Pro Tern Sternquist's questions and stated
that this amendment stands on its own. Once the joint use agreement with the
school district expires , requests for use of facil ities will be considered on a case by
case basis.

A. APPROVAL OF MINUTES
The City Council is requested to review and approve Minutes of the Regular
C ity Council Meeting of January 3 , 2017 .

B . TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS -
MEETING OF DECEMBER 14, 2016
The City Counc il is requested to receive and file actions of the Regular
Transportation and Public Safety Commission Meeting of December 14 , 2016 .
Action : Received and filed .
C . APPROVAL OF THIRD AMENDMENT TO THE AGREEMENT FOR USE OF
FACILITIES WITH T EMPLE CITY UNIFIED SCHOOL DISTRICT
The City and District approved an amendment extending the term of the
Agreement to December 31, 2016. The Th ird Amendment will further extend
the term of the Agreement to March 31 ,2017.
Action : Appro ved the Third Amendment to the
Agreement for Use of Facilities with Temple
City Unified School District for general facility
use , extending the term of the agreement to
March 31 ,2017 .
D. FINAL SUBDIVISION MAP APPROVAL FOR TRACT MAP NO . 73258 , A SIX-
LOT SUBDIVISION AT 10034 , 10044 LA ROSA DRIVE
City Council is requested to approve the Final Tract Map for a six-lot
subdivision at 10034 , 10044 La Rosa Drive .

1. Received the Subdivision Improvement Agreement ;

2 . Approved the final subdivision map for Tract Map No . 73258;
3. Authorized the City Manager to execute the Subdivision Improvement

E. FISCAL YEAR (FY) 2016-17 CITY BUDGET-SECOND QUARTER BUDGET
AMENDMENTS
The City Council is requested to authorize staff to revise various budget
appropriations to ensure the spending levels are within budgeted
appropriations during the current fiscal year.

BILLS
The City Council is requested to adopt Resolution No . 17-5233 authorizing
the payment of bills .

8. PUBLIC HEARING
A. APPEAL OF PARKS AND RECREATION COMMISSION'S DECISION TO
REMOVE A HOLLY OAK TREE LOCATED IN THE PUBLIC RIGHT OF WAY
AT 10312 DAINES DRIVE
On November 23 , 2016 , staff received notice of appeals appealing the Parks
and Recreation Commission 's decision to remove the tree to the City Council.

Parks and Recreation Director Burroughs gave a brief introduction regarding
the appeal.
Parks and Recreat ion Manager Lawson gave a summary of the staff report.
City Council asked questions regarding the Holly Oak Tree .
City 's Arborist, Rob Cruse and City Attorney, Eric Vail , answered C ity Council
questions regarding the tree and the City's responsibility to comply with the
American Disab i lity Act.
Mayor ProTem Sternquist opened Publ ic Hearing .
Mark Enkelaar, Temple City resident , suggested cutting the sidewalk to
accommodate the tree trunk and pruning the roots under the sidewalk to
mitigate the damage to the sidewalk .
Jim Clift , Temple City resident , suggested removing the sidewalk to see what
can be determined about the root underneath and possibly slope the sidewalk
to accommodate the roots .
Hearing no further request to speak , Mayor Pro Tem Sternquist closed public
hea ring .
City Counc i l commented regarding the tree and possible liabi lity issues .
Councilmember Chavez made a motion to uphold the Parks and Recreation
Commission's decisio n to remove the tree . Seconded by Counci lmembe r Fis h

B. APPEAL OF PARKS AND RECREATION COMMISSION 'S DECISION TO
REMOVE A STONE PINE TREE LOCATED IN THE PUBLIC RIGHT OF WAY
AT 6333 ENCINITA AVENUE
On December 31, 2016, staff received notice of appeals appealing the Parks
and Recreation Commission's decision to remove the tree to the City Council.
Parks and Recreation Manager Lawson gave a summary of the staff report.
City Council asked questions regarding the Stone Pine tree and options to save
the tree .

Mark Enkelaar, Temple City resident , shared that trees were removed from the
publ ic right of way on the 6200 block of Longden . He also requested City
Council consider sav ing the Stone Pine tree .
Hearing no further request to speak , Mayor Pro Tem Sternquist closed pub l ic
comment.
City Council commented on the tree and potential liab i lities for not removing the
tree .
Councilmember Man made a motion to uphold the Parks and Recreation
Commission's dec ision to remove the tree . Seconded by Counci lmember

C. APPEAL OF PLANNING COMMISSION 'S DECISION DENYING A
CONDITIONAL USE PERMIT TO ESTABLISH A 7 ,891 SQUARE FOOT
KARAOKE TELEVISION (KTV) BUSINESS IN THE CAMELLIA SQUARE
SHOPPING CENTER , LOCATED AT 9055 LAS TUNAS DRIVE , UNIT 125
App licant has f iled an appeal of the Planning Commission 's decis ion to
establish a 7 ,891 square feet KTV establishment in the Camellia Square
Shopping Center.
Mayor Pro Tem Sternquist shared that the C ity rece ived a notice from the
app l icant the day befo re the meeting req uesti ng the hearing be co ntinued .
City Council discussed possible actions they can take.
Mayor ProTem Sternquist opened Public Hearing.
Mr . Lee , Temple City resident, spoke against approval of the karaoke television
business .
Angeline , Temple City resident on Lama , spoke against approva l of t he karaoke
te levis ion business . Requested City post information i n Chin e se regarding
p ub li c hearings on Cit y 's website and prov ide trans lators for publ ic speakers at
Co uncil meetings .

D. COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS FOR FISCAL YEAR
2017-2018
City Council will consider Community Development Block Grant (CDBG)
Programs and allocations for Fiscal Year (FY) 2017-2018 .
City Manager Cook gave a brief introduction on the CDBG Programs .
Associate Planner Gulick gave a summary of the staff report.
City Council commented and asked questions on the proposed allocations for
the various programs.
Mayor Pro Tern Sternquist opened public hearing . Hearing no request to
speak , Mayor Pro Tern Sternquist closed public hearing .
Councilmember Man made a motion to authorize the City Manager to amend
CDBG-funded program allocations up to 50 percent of the approved allocation ;
and adopt the staff recommended CDBG-funded programs and allocations for
FY 2017-2018 . The total CDBG funds will include the estimated allocation of
$179 ,000 for FY 2017-2018 , plus $71 ,000 of unallocated funds carried over
from FY 2016-2017 :

A . AD HOC RECOMMENDATION ADJUSTMENT TO PUBLIC ARTS
COMMISSION
The City Counci l is requested to rev iew the Public Arts Comm ission Ad Hoc's
recommendation pertaining to the Publ ic Arts Commission .
City Manager Cook gave an overview of the Pub lic Arts Commiss ion and a brief
summary of the staff report .
Public Arts Commission Ad Hoc Committee (i .e ., Councilmember Chavez and
Man) shared the result of their discussion with the existing Public Arts
Commissioners .
Mayor Pro Tem Sternquist opened public comment. Hearing no request to
speak , Mayor ProTem Sternquist closed public comment.
Counci lmember Chavez made a motion to direct staff and City Attorney to
proceed with changes to the municipal code to effectuate adjustment to the

10. NEW BUSINESS
A. FIRST READING AND INTRODUCTION OF ORDINANCE NO . 17-1021
CHA NGING THE REFERENCE NUMBER OF ORDINANCE NO . 16-1019 TO
16-1020 PERTAINING TO ADOPTION OF 2017 BUILDING CODES
Due to typographical error, the ordinance to adopt by reference and amend the
2017 Bu ilding Code was inadvertently presented by staff and adopted by the
City Council on December 20, 2016 , with the incorrect reference number. The
proposed ordinance corrects the error by renumbering the ordinance .
Community Development Director Forbes gave a brief summary of the staff
report.

first reading by title only , changing the reference number of Ordinance No . 16-
1019 to 16-1020; waived further reading of Ordinance No . 17 -1021 ; and
schedu led the second reading of Ord inance No . 17-1021 for February 7 , 2017.

12. UPDATE FROM CITY MANAGER
Commented on the inc ident on Temple City Boulevard last week ; shared that the
Royal Court for the Camellia Festival will be announced this week ; Teen CERT
Training class will beg i n this weekend , Neighborhood Watch meeting will begin this
Thursday ; and that the City continues to work with the County on drafting an
agreement for the library renovation .
13. UPDATE FROM CITY ATTORNEY
City Attorney Va il commented briefly on the t ime allotted to pub lic speakers
requ iri ng translation during Council meetings . He added that the City is not
requ ired by law to prov ide translators for public speakers at Council meetings .
