SUBJECT: ACCEPTANCE OF WORK FOR THE LIVE OAK PARK WALKING PATH PROJECT AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION RECOMMENDATION: The City Council is requested to : 1. Accept the work performed by Principles Contracting, Inc. on the Live Oak Park Walking Path Project (CIP No . P16-01); 2 . Authorize the City Clerk to file the Notice of Completion for recordation with the County of Los Angeles Registrar-Recorder; and 3 . Release the 5 % retention payment 30 days after recordation . BACKGROUND: 1. On May 20 , 2014 , the City was notified of a competitive grant program in the Fifth Supervisorial District for projects to improve and/or rehab ilitate existing public parks and /or development of new small public park facilities . 2 . On August 19, 2014 , the City Council adopted Resolution No . 14-5021 authorizing the Interim City Manager or his designee to apply for the 2015 Competitive Excess Grant Program to fund a new rubberi zed walking/jogging path at Live Oak Park. 3. On January 22 , 2015 , the City was notified that the Live Oak Park Walking/Jogging Path (Project) had been awarded a $240 ,000 grant through the Fifth Supervisorial District's 2015 Competitive Excess Funds Grant Program . 4. On August 26 , 2015 , the City entered into a Design Professional Services Agreement for Landscape Architectural and Construction Project Management City Council February 7 , 2017 Page 2 of 3 Services with Community Works Design Group (CWDG) in support of the Project in the amount of $24,500 . 5 . On December 15, 2015 , the City Council approved the design plans submitted by CWDG and authorized staff to solicit construction bids for the Project. 6 . On February 4 , 2016 , a Notice Inviting Bids was published in the Temple City Tribune for the Project with a March 1, 2016 deadline for submittal of bids. Notices were also sent to si x plan rooms . 7 . On March 1, 2016, the City Clerk opened the three bids received by the published deadline . All bids were significantly over the architect's estimate and the project budget. 8 . On Marc h 15, 2016 , the City Council rejected all bids for the Project and di rected staff to re-bid the Project with additive alternates . 9 . On March 21 , 2016, a Notice Inviting Bids was published in the Temple City Tribune for the Project with a deadline for submittal of bids of April 19 , 2016. Notices were sent to all plan holders from the first bid process as well as the six plan rooms . 10 . On April 19 , 2016 , the City Clerk opened the six bids received by the published deadline . 11 . On May 17 , 2016, the City Council awarded a public works contract, in the amount of $282 ,500 to Principles Contracting , Inc. (Principles) for the Project. 12 . On June 6 , 2016, the City issued a Notice to Proceed to Principles. 13 . On July 8 , 2016 , after the San Gabriel Valley Conservation Corps (SGVCC) had completed relocation of the existing irr igation lines , Principle s commenced work on the Project. 14 . On December 15 , 2016 , a punch list walk was conducted for the Project with City staff, the landscape architect, contractor and rubber surfacing subcontractor. 15 . On December 22 , 2016 , the Project was completed and opened to the public . 16. On January 5 , 2017 , Un ited Sports Surfacing of America (USSA), a subcontractor for the project, filed a Stop Payment Notice with the City claiming Pr inciples had not paid them the tota l amount due . 17. On January 9 , 2017 , USSA filed a Release of Stop Payment Notice with City after they had been paid in full by Principles . City Council February 7, 2017 Page 3 of 3 ANALYSIS : Pri ncip les and its s ub contractors have completed all work as required per the contract and subsequent adju stments . The City approved one change order, eliminating all Decomposed Granite (D G) from the project, which res u lted in a credit of $19 ,174. City staff i nitially insta ll ed D G per the approved plans , but has subsequently determined concrete in those areas will provide a cleaner transition and w i ll eliminate the possibility of DG being carried onto the surfacing . The cost for the original purchase and installation of DG , as well as the installation of concrete, is approximately $15 ,000 , less t ha n the $19 ,17 4 c redit and within the approved project budget. To date , City staff has subm itted one payment request for grant funds to the Los Angeles County Regional Park and Open Space District (District) in the amount of $180 ,144.21. The remaining $59 ,855.79 will be requested within the next few weeks once all payment app lications for the contractor have been processed . CITY STRATEGIC GOALS : Approva l of t h is item will promote or further t he C ity 's Strategic Goa ls of Public Hea lt h and Safety and Qua lity of Life . FISCAL IMPACT: The Project will be completed under the approved budget of $340 ,000 . A summary of project costs is listed below . City staff completed a number of items related to this project, including t he p urchase and installation of DG and numerous irrigation repairs. Those costs have been deducted from the project budget and are listed as Misc. Expenditures in the tab le below. The installation of the concrete will be about $10 ,000 .
