RESOLUTION OVERRULING PROTESTS IN CONNECTION
WITH THE HEARING ON DEB T LIMITATION FOR THE
PROPOSED IMPROVEMENT OF BIRCH STREET BETWEEN
F`ERNWOOD AVENUE AND THE CITY PARK BY THE CON-
STRUCTION OF CEMENT CONCRETE CURBS, DRIVEWAYS,
SIDEWALKS, AND GUTTERS, AND THE REMQVAL OF
EXISTING PAftKWAYS, DRNEWAYS, AND TREES, TO-
GETHER WITH ALL INCIDENTAL AND APPURTENANT
WORK.
WHEREAS, the City Council of the City of Lynwood did, on
the 4th day of September 1956 approve an investigation report under
'�he provisions of Division 1 -I- of the Streets and Highways Code, cited.
as "Special Assessment Investigation, Limitation and Majority Protest
Act of 1931" as amended., upon the proposed improvement of Birch Street
between Fernwood Avenue and the City Park by the construction of
cement concrete curbs, d.riveways, sidewalks, and gutters, and the
removal of existing parkways, driveways, and. trees, together with
all incidental and appurtenant work, as shown on Plan No 1956-C-2
on file in the off'ice of the City Clerk of said City, and.
WHEREAS, said report having been dlaly prepared and filed.,
a hearing was held. by said Ci�y Council on the 16th day of October,
1956 in the manner provided in said. Act above referred to; and
WHEREAS, more than thirty d.ays ha.ve expired since che date
of mailing notices of hearing on said report;
NOW, TH�EREFORE, the Ci�y Council of the City of Lynwood.
does hereby resolve as follows:
1. That the protests made at said. hearing on said investi-
gation report be and the same are hereby overruled.
2. That the public interes�, convenience, and necessity
require the doing and making of the public improvement set forth and.
described ;n said report above referred to and. substantially in the
manner set forth;
3. That the project consisting of the proposed improvement
above referred to is feasible, and. that the land. to be assessed. will
be able to carry the burd.en of said. proposed. assessment.

�. That the estimated total amount proposed to be assessed.
upon any or all lots or parcels of land for the costs and expenses
of said proposed improvement d.oes not exceed the limitation of ind.ebted-
ness established and. set forth in said. act above referred. to and. will
not, by the levy thereof, cause said limitation to be exceeded in any
instance;
5. No majority protes� has been filed. wi�h the clerk of
the legislative body by the owners of the property ioroposed �o be
assessed '�o pay the costs and expenses of said proposed improvement.
6. That it is hereby ordered �hat the proceedings for the
making of said proposed improvement be undertaken pursuant to the
provisions of an Act of the Legislature of the State of California,
designated as Division 7 of the Streets and. Highways Code, cited. as
the "Improvement Act of 1911, and amendments thereto."
