CITY OF MEDINA
RESOLUTION NO.04-34
RESOLUTION REAPPORTIONING SPECIAL ASSESSMENTS FOR KLINGELHUTZ
DEVELOPMENT COMPANY AND ROLLING GREEN BUSINESS PARK, LLC
WHEREAS, the city of Medina (the "City") previously undertook the construction of
sanitary sewer and water improvements in the vicinity of T.H. 55 and Co. Rd. 116 (the
"Improvements"); and
WHEREAS, the Improvements benefited certain lands including property legally described
on Exhibit A attached hereto (the "Property") and which is now owned by Klingelhutz
Development Company and Rolling Green Business Park, LLC (collectively, the "Owners"); and
WHEREAS, special assessments to pay for the Improvements were previously levied
against the Property pursuant to levy numbers 14572, 14573 and 14574; and
WHEREAS, the Property has been subdivided and Hennepin County and the Owners have
requested that the City reapportion the unpaid special assessments related to the above levies
pursuant to Minnesota Statutes, section 429.071, subd. 3; and
WHEREAS, the City is willing to reapportion the special assessments in accordance with
the County's and the Owners' requests so long as the full amount of the unpaid special assessments
remain a valid lien against the Property.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina as
follows:
1. The unpaid special assessments related to levy numbers 14572, 14573 and 14574 shall
be reapportioned against the Property in accordance with the amended assessment roll
attached hereto as Exhibit B.

2. The city staff is authorized and directed to take any and all steps necessary or
convenient to implement the intent of this resolution.

The motion for the foregoing resolution was duly seconded by member Smith
and upon vote being taken thereon, the followed voted in favor thereof:
Workman, Lane, Zietlow, Smith, Brinkman
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
