SUBJECT: APPEAL OF THE PLANNING COMMISSION'S DECISION DENYING A
CONDITIONAL USE PERMIT TO ESTABLISH A 7,891 SQUARE FOOT
KARAOKE TELEVISION (KTV) BUSINESS IN THE CAMELLIA SQUARE
SHOPPING CENTER, LOCATED AT 9055 LAS TUNAS DRIVE , UNIT 125
RECOMMENDATION:
The City Council is requested to receive and file this report .
BACKGROUND:
1. On January 17, 2017, the City Council was scheduled to hold a public hearing to
consider an appeal of the Planning Commission's decision regard ing a conditional
use permit application for a karaoke television (KTV) business . The appellant/
applicant requested that the public hearing be continued to a later date. The City
Council voted to continue the public hearing to February 21 , 2017.
2 . On January 27, 2017 , the property owner submitted a letter (Attachment "A ") stating
that he was withdrawing his consent to the conditional use permit application .
ANALYSIS:
The property owner's consent is required for land use entitlement applications . Since the
property owner has withdrawn his consent to the application , the application is considered
withdrawn . The City Council public hearing has accordingly been cancelled.

Dear Scott and A dam ,
As the property owner of Camellia Square , we are notifying the City that our lease with
Rich D iamond KTV expired on January 3, 2017. We would like to move forward and
acquire new tenants for Building 1 Suite 125 (approx. 6,588 square feet)-the former KTV
space located at 9055 Las Tunas Drive.
As the property owner, I am withdrawing my consent for Rich Diamond KTV to be a tenant
at Camellia Square as referred to above and request that the Rich Diamond KTV
Conditional Use Permit application be withdrawn .
Please let me know if you have any questions.
