The Georgia Environmental Protection Division administers the rules. In most cases, the rules require both the owner and the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the building. This meeting got us pretty much at a stalemate and if you would allow, I would like to turn it over for your decision, not that I don 't have one, but rather based upon Mr. Boykin consistently stating that there would be "actions"taken against the city if this was not allowed to be continued. Here is a brief summary of what transpired for your review and interpretation. 1) The reps for the property are stating this project is for an "existing deck"which is what they are referring to the current state of the top of the carport although it was only permitted as a carport and as such was never required to met setbacks cause it was not an accessory use,which a deck would make it; 2) Mr. Simmons stated that he had DC Construction pull the permit for him so that he would be able to do the work for himself and their name in permit only,which would not have been allowed by our office as Mr. Simmons is not the legal owner and no Homeowner Affidavit has ever been completed for this property by anyone; 3) After this, Mr. Boykin also reminded us that Mr.Simmons had only hired DC Construction after he was told that what he wanted to do was in need of a variance in late June of this year by Dianne Otto and then he comes back with someone else pulling a permit for work not described in the permit; 4) The original building permit for the "handrails to be installed on an existing deck" stated the value at$600 and Mr.Simmons stated that the new material was coming in today that he spent$1300.00 on,which is in addition to what was already there; 5) We instructed them that the stop work order would upheld and no work could continue until they received a variance and Mr. Boykin began his insinuations of legal action at that point given that PUD within our LDC states no specific requirements for setbacks and we stated that we would be able to treat them at 10'which would be the minimum for any setback in any zoning district that we allow. Essentially they were stating that 0' lot lines would be allowed as there are no recorded setback for the area; 6) Once again we restated that the work exceeded the allowed scope of the permit and that is where we came in to the conversation about what is a deck?Our LDC references a deck "means a raised,flat, and floored roofless platform adjoining a dwelling or structure.A deck is not considered to be a part of the structure for living area measurement purposes;however, it is required to meet all front,side, and rear yard setbacks. Flooring for a deck is generally made of wood material set upon piers." 7) It was then stated that once again we need to keep the stop work order in effect until the City Attorney can provide an interpretation; 8) They requested that they be able to repair the roof where it had been cut for replacement of the roofing materials (no permit for that work either), so we decided to, at no charge, provide them with a permit explicitly stating they could only make the roof repairs and no new work could be began until stop work order was lifted or variance granted. I feel that the City is the right on this one and although it is a PUD in name only,that doesn't allow them to skirt around the requirements to get them what they would need. However, it is your opinion that I would like to proceed with on this one as it was an attorney doing most of the talking and threatening legal actions if they don't get what they want. 1 Jonathan H. That is different obviously than what the normal rules would be & I frankly do not know the answer. I assume this is on one of the units & one of the other unit owners is complaining. There are some covenants but I doubt they cover this issue- I can try to get them to you or I know Boykin has them. I guess it is worth meeting with them but I cannot be there tomorrow& I did not understand you thought I needed to be. I can though talk to Noble when needed & I will do whatever I can to help. I would not concede that just because it is in a PUD that all zoning &related issues are off the table. If that were the case, they could build to property lines or too high. This was presented as"installing handrails to existing deck." It is actually creating a deck on top of a carport.As you know, a carport can be located anywhere on a property but a deck cannot be in the setbacks without variance approval. We received a complaint this morning from a neighbor which led to a closer look at the permit application and the work being done. Ray Hord posted a stop work order this morning. Tim Sessions (significant other of the property owner?)telephoned earlier this afternoon about the stop work order. When I informed him that the permit had been issued in error he said that he was going to call his lawyer and hung up. Attorney Noble Boykin (cell 657-2753)just contacted me. He said that this property is zoned PUD and that he is involved with the other Gulick property that is in litigation.Attached is a SAG IS map of the location.
