ORDINANCE NO: 643
AN ORDINANCE CONCERNING THE AMENDMENT OF CHAPTER 7,
ARTICLE 3 OF THE CITY CODE OF BEL AIRE, KANSAS, IN
CONNECTION WITH PROHIBITED REPTILES, EDUCATIONAL
DISPLAYS AND PET STORES, ALL WITHIN THE CITY OF BEL AIRE,
SEDGWICK COUNTY, KANSAS.
Be it ordained by the Governing Body of the City of Bel Aire, Kansas:
Section 1. AMENDING SECTION 7.3.3 (b) OF THE BEL AIRE
MUNICIPAL CODE:
(b) The harboring, keeping, or maintaining of any inherently dangerous animal, or
hybrid of such, is hereby prohibited within the city, except by:
1) A circus or sideshow duly licensed to conduct business within the City,
2) A pet store may display not more than 5 inherently dangerous reptiles for
educational purposes only, if and only if the pet store;
i. Earns 50% or more of its income from the sale of pets, pet
food, or pet supplies,
ii. Maintains insurance covering the liability for inherently
dangerous animals present at the business location, insurance
requirements shall be set in City Reptile Educational Display
Safety Policy
iii. Maintains certification by the State Department of
Agriculture for each inherently dangerous animal and
complies with all federal and State laws.
iv. Maintains a list of adequate security measures, including
measures preventing reptile escape from secondary
containment measures, and a catastrophic event plan
specifically addressing limitations present at the business
location.
v. Provides City building inspector an affidavit of all inherently
dangerous animals onsite and the security measures in place
to enclose those animals.
vi. All such displays shall be limited by City Reptile Educational
Display Safety Policy
Section 1. AMENDING SECTION 7.3.8 OF THE BEL AIRE MUNICIPAL
CODE:
E. Inherently dangerous animals are prohibited within the City, except for animals
temporarily allowed as part of a properly insured and humane circus, travelling
zoo, other non-resident entity or City licensed pet store educational reptile display
in conformance with section 7.3.3(b) of this code.
SECTION 2. REPEAL. All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 6. EFFECTIVE DATE. This ordinance shall take effect and be in
force from and after the publication of its summary in the Ark Valley News, and
official City newspaper.
