A SPECIAL ORDINANCE VACATING THE PUBLIC PLACE (ALLEY) DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF LOT NUMBER TEN (10) IN THE J.H. MORRIS SUBDIVISION OF TRACT 240 ON THE
OFFICIAL MAP OF THE CITY OF RICHMOND, THENCE WEST ONE HUNDRED FORTY-EIGHT AND ONE-HALF (148.50) FEET TO THE SOUTHWEST CORNER OF SAID LOT TEN (10), THEN SOUTH TWELVE (12) FEET TO THE
NORTHWEST CORNER OF LOT NUMBER ONE (1) IN THE HADLEY ADDITION TO THE CITY OF RICHMOND AS LAID OUT BY ELIJAH COFFIN, THENCE EAST ONE HUNDRED FORTY-EIGHT AND SIXTY-SIX HUNDREDTHS (148.66)
FEET TO THE NORTHEAST CORNER OF SAID LOT NUMBER ONE (1), THENCE NORTH TWELVE (12) FEET TO THE PLACE OF BEGINNING.
WHEREAS, Reo Sparks and Smarrelli General Contractor, Inc., owners; have petitioned Common Council of Richmond, Indiana, requesting the vacation of the public place (Alley) described
as follows:
Beginning at the southeast corner of Lot Number Ten (10) in the J.H. Morris Subdivision of Tract 240 on the Official Map of the City of Richmond, thence West One Hundred Forty-eight
and one-half (148.50) feet to the Southwest corner of said Lot Number (10), thence South Twelve (12) feet to the Northwest corner of said Lot Number One (1) in the Hadley Addition to
the City of Richmond as laid out by Elijah Coffin, thence East One Hundred Forty-eight and Sixty-six Hundreths (148.66) feet to the Northwest corner of said Lot Number One (1), thence
North Twelve (12) feet to the place of beginning.
WHEREAS, all of the owners of all land abutting the above described public way have joined in said petition requesting vacation, ad
WHEREAS, the abutting land owners have waived notification by the City Clerk as required by statute, and
WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition June 15, 1998, after publishing legal notice thereof at least 10 days in advance
of said hearing as required by statute, and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition May 28, 1998, after publishing legal notice thereof at
least 10 days in advance of said hearings as required by ordinance, and
WHEREAS, it is desirable to vacate said public way,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public way described
below is hereby vacated and the abutting property owners shall acquire ownership of the land heretofore dedicated as a public way as indicated below, to wit:
The public place (Alley) described as follows:
Beginning at the southeast corner of Lot Number Ten (10) in the J.H. Morris Subdivision of Tract 240 on the Official Map of the City of Richmond, thence West One Hundred Forty-eight
and One-half (148.50) feet to the Southwest corner of said Lot Number (10), thence South twelve (12) feet to the Northwest corner of said Lot Number One (1) in the Hadley Addition to0
the City of Richmond as laid out by Elijah Coffin, thence East One Hundred Forty-eight and Sixty-six Hundreths (148.66) feet to the Northeast corner of said Lot Number One (1), thence
North Twelve (12) feet to the Place of beginning, in the City of Richmond
Passed and adopted this 22nd day of June 1998, by the Common Council of the City of Richmond, Indiana.
