HomeMy Public PortalAbout2004-048 Resolution Approving Variances for 4629 Brook StMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-48 RESOLUTION REGARDING VARIANCES FOR 4629 BROOK STREET WHEREAS, Joseph Ahlstrom and Lark Ahlstrom (the "Applicants") are the fee owners of property located at 4629 Brook Street and legally described as the Southeasterly 20 feet of Lot 2, and the northwesterly 23 feet of Lot 3, Block 28, INDEPENDENCE BEACH, Hennepin County, Minnesota (the "Property"); and WHEREAS, the Applicants have proposed to construct a new house on the Property which would necessitate the following setback variances: 1) reduce front yard setback from 30' to 19'; 2) reduce east side yard setback from 10' to 8'; 3) reduce west side yard set back from 10' to 8'; 4) reduce minimum lot area from 9000 s.f. to 4300 sil; and 5) reduce minimum lot width from 60' to 43'; and WHEREAS, this matter was considered by the planning commission at its meetings on July 13, and August 10, 2004 and by the city council on September ?, 2004. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that the above variances are granted to the Applicants for the purpose of constructing a new house on the Property, subject to the following terms and conditions: 1. The variances are only for construction of the new house outlined in the plans submitted by the Applicants and approved by the city; Resolution No. 04-48 September 21, 2004 2. The variances must be utilized within one year of the date of this resolution by issuance of a building permit or the approvals hereby granted will be null and void; and 3. The Applicants must pay to the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of Medina that the above variances are justified because of the following hardships on the Property: 1. The variances are consistent with those of other houses and lots in the neighborhood; 2. The Property has frontage on two streets, requiring a front yard set back from both; and 3. The Property is an existing lot with an existing house which the Applicants could have remodeled without the need for the lot variances. Dated: September 21, 2004. ATTEST: A4„ 'lip K.
