AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,VACATING AND RELINQUISHING THE HEALTH COURT RIGHT-OF-WAY LOCATED AT CHRISTY DRIVE, SOUTH OF FLORA DRIVE. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council finds that the following described right-of-way is surplus property of the City and are no longer needed for any public purpose: Health Court right-of-way as described by Central Missouri Medical Place Subdivision,a plat of record, recorded in Book 11 page 738, Cole County Recorder's office, being a part of the South Half of the Southeast Quarter of Section 13, Township 44 North, Range 12 West, Cole County Missouri, more particularly described as follows: From the Southwest corner of the Southeast Quarter of said Section 13, Township 44 North, Range 12 West, thence N1015'1XE, along the Quarter Section Line,252.26 feet to the easterly right-of-way line of Christy Drive(U.S. Highway 54 right-of-way); thence northerly, along the easterly right-of-way line of Christy Drive the following courses: N52 006'35"E 238.60 feet; N36 046'47"E 301.70 feet; thence N40 035'38"E 400.00 feet; thence N29°42'27"E 21.23 feet, to the Point of Beginning; thence continuing N29°42'27"E 50.06 feet,to the northwesterly corner of Central Missouri Medical Place;thence leaving said right-of-way, • along the right-of-way of Health Court the following courses; along a curve to the left, having a radius of 183.00 feet, a distance of 5.28 feet, the chord being S61°36'15"E 5.28 feet; thence S62 025'48"E 130.77 feet;thence along a curve to the left, having a radius of 425.00 feet,a distance of 86.14 feet, the chord being 70 055'36"E 86.00 feet; thence along a curve to the right, having a radius of 475.00 feet, a distance of 215.24 feet, the chord being S63045'11 7"E 213.40 feet; thence S50 046'14"E 41.92 feet;thence along a curve to the right, having a radius of 50.00 feet, a distance of 227.88 feet, the.chord being S79 04779"W 75.96 feet; thence N30 051'44"W 20.21 feet; thence along a curve to the left, having a radius of 425.00 feet, a distance of 166.08 feet, the chord being N65 032'18"W 165.02 feet, thence along a curve to the right, having a radius of 475.00 feet, a distance of 96.28 feet,the chord being N70 055'36"W 96.11 feet;thence N62 025'48"W 130.77 feet; thence along a curve to the right, having a radius of 233.00 feet, a distance of 9.49 feet, the chord being N61 015'47"W 9.49 feet, to the Point Of Beginning and containing 0.68 acre. Section 2. The right-of-way described in Section 1 is hereby relinquished,and the City does hereby release and abandon whatever interest it has in the right-of-way, subject to reservation of an easement in that portion vacated for the maintenance, repair, location and relocation of all sanitary sewer, storm drainage sewer, or public utilities now existing or hereafter to be constructed within said street right-of-way. Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary legal document relinquishing all of the City's interest in the tract of ground described in Section 1, subject to the easement retained in Section 2. • Bill 2007-43 Page 1 1 Section 4. Health Court is a 500 foot long cul-de-sac off of Christy Drive approximately 200 feet south of Flora Drive. Two lots have access off of Health Court. The front lot has access off of Christy Drive while the <�rear lot has access only off of Health Court. The property owner of the rear lot intends to build a medical office building. Their plans are to vacate the Health Court right-of-way in order to create a flag lot with frontage on Christy Drive and remove the requirement for a cul-de-sac at the end of Health Court. The property owner of the front lot would transfer their interest in the right-of-way to the rear lot. No contact has yet been made with utility companies that could be affected by this right-of-way vacation but the staff recommendation is to retain easement rights along the right-of-way in order to provide for utility access to both lots. Staff recommends approval of this request.
