HomeMy Public PortalAboutOrdinance 5621 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO. 562 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, PROHIBITING THE PARKING OF VEHICLES ON CERTAIN STREETS BETWEEN 2:00 A.M. AND 6:00 A.M. FOR THE PURPOSE OF REGULATION FOR STREET SWEEPING PURPOSES IN ACCORDANCE WITH SECTION 22507.6 OF THE VEHICLE CODE OF THE STATE OF CALIFORNIA BE IT ORDAINED by the City Council of the City of Beaumont, California as follows: SECTION 1. DEFINITIONS (a) Vehicle A "vehicle" is a device by which any person or pro- perty may be propelled, moved or drawn upon a highway, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks in accordance with the definition as contained in Section 670 of the Vehicle Code of the State of California. (b) Street, Alley or Highway "Street" is a way or place of whatever nature, publically maintained and open to the use of the public for pur- poses of vehicular travel. "Street" includes highway and alley. "Alley" is any highway having a roadway not exceed- ing 25 feet in width which is primarily used for access to the rear or side entrances of abutting property; provided, that the City and County may designate by ordinance or resolution as an "alley" any highway having a roadway not exceeding 25 feet in width the foregoing is in line with the definitions set forth in Section 590 of the Vehicle Code of the State of California. SECTION 2. It is unlawful for anyone to leave parked or standing vehicles on streets or highways designated between the hours of 2:00 a.m. and 6:00 a.m. on dates enumerated. SECTION 3. The above prohibition has been enacted pursuant to Sections 22507 and 22507.6 of the Vehicle Code of the State of California. SECTION 4. It shall be unlawful for any person to park or leave standing on Monday, Wednesday and Friday any vehicles on the entire length of Beaumont Avenue and the entire length of 6th Street within the City limits, and the entire length of 14th Street within the City Limits, as provided by Section 2 of this Ordinance. SECTION 5. Citation of Vehicles. The Chief of Police or any member of his Department are authorized to cite as parking violations any violations of this ordinance. // Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION 6. Penalty Designated. A. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this ordinance is guilty of a misdemeanor. Except in cases where a different punishment is prescribed by any ordinance of the City, any person convicted of a misdemeanor under the ordinances of the City of Beaumont, shall be punished by a fine of not more than $500, or by imprisonment not to exceed six (6) months, or by both such fine and imprisonment. B. Any such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of this ordinance is committed, continued or permitted by any such person, and shall be punished accordingly. SECTION 7. Amendments.. This ordinance may be amended by resolutions of the City Council.
