HomeMy Public PortalAboutCity Council_Minutes_1985-03-19_Regular 1985CITY OF TEMPLE CITY CITY COUNCIL MINUTES MARCH 19, 1985 INITIATION: 1CALL TO ORDER: Mayor Swain called the regular meeting of the City Council to order at 7:35 p.m. on Tuesday, March 19, 1985 in the Council Chamber of the City Hall. 2. The invocation was given by Elder John Stephens of The Reorganized Church of Jesus Christ of Latter Day Saints, 9468 Broadway. 3. The Pledge of Allegiance to the Flag was led by two Bluebirds from the Love Birds Troop of the Bluebirds Council of the Foothills. 4. ROLL CALL: Present: Councilmen - Dennis, Gillanders, Tyrell, Swain Absent: Councilmen- Atkins Also Present: City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks & Recreation Director Kobett, Public Works Coordinator Peterson and Julie Estrada of the Temple City Times Councilman Tyrell moved to excuse Councilman Atkins for cause, secon- ded by Councilman Gillanders and unanimously carried. I 5. CONSENT CALENDAR: Mayor Swain requested Item B (2) be removed from the Consent Calendar and Councilman Dennis requested that B (4) be removed. On motion by Councilman Tyrell, seconded by Councilman Gillanders, all other items on the Consent Calendar were unanimously approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of March 5, 1985 B. RECOMMENDATIONS FROM TRAFFIC COMMISSION MEETING OF MARCH 6, 1985 (1) REQUEST FROM AMERICAN RED CROSS - PARKING OF BLOODMOBILE AT 9440 GIDLEY STREET ON APRIL 23, 1985 Approved request from American Red Cross to allow parking of Bloodmobile and 8 - 10 vehicles, along with lifting the two -hour parking restrictions to accommodate the vehicles, at 9440 Gidley Street subject to the required Certificate of Insurance naming the City additionally insured. (3) LOWER AZUSA ROAD - SHORT TIME PARKING Approved recommendation to place a 15- minute green zone on the south side of Lower Azusa Road from 224' - 244' east of the east curbline prolongation of Glickman Avenue. (5) ADDITIONAL RED CURB - 4800 FRATUS /RIO HONDO Approved recommendation of 120' of red curb on the east and north side of Fratus, west of Rio Hondo Avenue in order to relieve a circulation problem at the curb of Fratus Drive prior to Rio Hondo Avenue. 1s ()p8 Council Minutes, March 19, 1985 - Page C. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF MARCH 12, 1985 (1) SET PUBLIC HEARING: REQUEST FOR APPROVAL OF TENTATIVE TRACT MAP 43590-TO ALLOW DEVELOPMENT OF A 6 -UNIT RESIDENTIAL CON- DOMINIUM (5562 Welland Avenue) Council set public hearing for April 2, 1985 to consider approval of Tentative Tract Map 43590 to allow development of a 6 -unit residential condominium with a street address of 5562 Welland Avenue. (2) SET PUBLIC HEARING: REQUEST FOR CHANGE OF ZONE FROM R -1 T R -3 (6002 Cloverly Avenue) APPLICANT /OWNER: ROBERT HEPLER Council set public hearing for April 2, 1985 to consider re- quest for zone change from R -1 to R -3 for property located at 6002 Cloverly Avenue and to introduce an ordinance for first reading for change of zone if approved. (3) PROPERTY NUISANCE CASE 85 -128 (5535 Pal Mal) Council adopted Resolution No. 85 -2341, a Resolution of the City of Temple City declaring certain premises to be a pub- lic nuisance and ordering abatement thereof. (4) PLANNING COMMISSION ACTION - MEETING OF MARCH 12, 1985 Received and filed memo from the Planning Commission relat- ing to action taken at their regular meeting. D. ACCEPTANCE OF BID - PURCHASE OF AIR - COOLED CONDENSER FOR EXISTING CITY HALL Council accepted the low bid from Air -Tro, Inc. in the amount of $6,800 and authorized the purchase and installation of a Russel Coil Company Thermo Temp Model TD37 air - cooled condenser for th existing City Hall. E REVISION OF SALARY SCHEDULE FOR DUPLICATING EQUIPMENT OPERATOR Council approved a revision of the hourly salary schedule for Duplicating Equipment Operator to $4.85 - 5.40 - 5.95. _ F. RESOLUTION NO. 85 -2339: EMPLOYMENT OF PERSONNEL (Budgeted) Adopted Resolution No. 85 -2339, a Resolution of the City Council of Temple City appointing budgeted personnel. G. RESOLUTION NO. 85 -2340: WARRANTS AND DEMANDS Adopted Resolution No. 85 -2340, a Resolution of the City Council of the City of Temple City allowing claims and demands in the sum of $272,224.08. CONSENT CALENDAR ITEM B(2) 10:00 P.M. FLASHING RED AND AMBER SEQUENCE Mayor Swain requested that this item be removed due to some prior opinions made by the Sheriff's Department that a review of the flashing signals on Baldwin and Temple City Boulevard should be made to determine if a change would improve traffic flow. Counc members felt there was no problem with the recommendation made b the Traffic Commission. Councilman Tyrell moved to receive and file Traffic Commission's recommendation that no change be made at this time for the flash- ing sequence lights. CONSENT CALENDAR ITEM B(4) ALLEY E/0 BALDWIN S/0 LIVE OAK AVENUE Councilman Dennis questioned the effectiveness of a 15 MPH sign being posted in the alley to disuade drivers during race track traffic hours from using it, Councilman Dennis recommended that traffic control officers on duty during race track traffic hours place a barricade at the north end of the alley to prevent use during those. hours. 1 Council Minutes, March 19, 1985 - Page 3 Councilman Gillanders moved that traffic control officers on duty during the hours of race track traffic place a barricade at the north end of the alley east of Baldwin and south of Live Oak. Avenue and remove the barricade at the time their post position is completed, seconded by Councilman Dennis and unanimously carried. 6. UNFINISHED BUSINESS: A. PUBLIC HEARING: ASSESSMENTS FOR CURB AND GUTTER IMPROVEMENTS (SO. SIDE OF GRAND AVE. BETWEEN EL MONTE AVE. & PERSIMMON AVE.) E.G.N. CONSTRUCTION CO. (Chapter 27, Improvement Act of 1911, Streets & Highways Code) City Manager Koski provided background information stating that at the regular meeting of the City Council on February 21, 1984, Council found the project to be in the best public interest and adopted Resolution No. 84 -2239 ordering the construction of curb and gutter improvements on the south side of Grand Avenue bet- ween El Monte Avenue and Persimmon Avenue. In September of 1984 the curb and gutter were installed as part of a larger project. The work was completed and on January 15, 1985 was given final acceptance by the Council. At the regular meeting of March 5, 1985, Council set public hearing for assessments for March 19, 1985. Total cost of construction amounted to $1,517.76, to be shared 50 -50 by the City and property owners. Mayor Swain declared the public hearing open and invited anyone wishing to speak to come forward. There being no one that came forward to speak to the issue, Councilman Gillanders moved to close the public hearing, secon- ded by Councilman Dennis and unanimously carried. Councilman Dennis moved to approve the assessments as reported in the Superintendent of Streets' Report of Completion of Con- struction and Costs of Construction dated February 26, 1985, and directed the Superintendent of Streets to notify property owners and collect assessments, seconded by Councilman Tyrell and unani- mously carried. B. PUBLIC HEARING: ASSESSMENTS FOR ALLEY IMPROVEMENTS (BETWEEN PERSIMMON AND EL MONTE AVE. FROM GRAND TO EL MONTE CITY LIMIT) E.G.N. CONSTRUCTION CO. (Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Manager Koski provided background information stating that the City Council at its regular meeting of October 18, 1983, in response to a petition for alley improvements, approved Resolu- tion No. 83 -2202 and ordered the reconstruction of the alley located between Persimmon Avenue and El Monte Avenue extending southward from Grand Avenue to the El Monte City limits. In September of 1984 the alley was constructed as part of a larger project and was accepted by the Council at its regular meeting of January 15, 1985. At its regular meeting of March 5, 1985, Council set public hearing for March 19, 1985 for assessments. Council was referred to the Report of Completion of Construction and Costs of Construction. City accepts all engineering, design and inspection costs as well as other extra items and shares the cost of the actual construction on a, 50 -50 basis with adjacent property owners. The average cost per property is $194. Mayor Swain declared the public hearing open and invited anyone wishing to speak to come forward. oaf 5 026. Council Minutes, March 19, 1935 - Page 4 Mary McGraw, 4858 El Monte Avenue, asked Council how the assess- ment billing would be handled. City Manager Koski responded by saying that the assessment would be billed in one lump sum. For those who wished to have the assessment added to their tax bill, the City would have to place a lien on the property in order that, should the property go to sale, the future owner would be aware that there was an amount owing. Bills will be going out in the next week to ten days and there is thirty days given in which pay the bill. Should there be a problem for anyone making thi payment, arrangements could be made with the City. Councilman Gillanders moved to close the public hearing, secon by Councilman Dennis and unanimously carried. Councilman Dennis moved to approve the assessments as reported in the Superintendent of Streets' Report of Completion of Construc- tion and Costs of Construction dated February 26, 1985, and di- rected the Superintendent of Streets to notify property owners and collect assessments, seconded by Councilman Gillanders and unanimously carried. 7. NEW BUSINESS: None 8. COMMUNICATIONS: None 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: None wished to address the Council. RECESS TO CRA: 1 At this time Council recessed to meet as the Community Redevelopment Agency; and approved the Minutes of the regular meeting held March 5, 1985. The Minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. CITY CLERKS' ASSOCIATION ANNUAL CONFERENCE, APRIL 18 - 20, 1985 Councilman Gillanders moved to approve Chief Deputy City Clerk's attendance at the City Clerks' Association Annual Conference in Oakland April 18 - 20, 1985 and authorize necessary expenditures, appropriate funds and amend the adopted budget accordingly, secon- ded by Councilman Tyrell and unanimously carried. B. ACCEPTANCE OF BID - PURCHASE OF CHAIRS FOR COUNCIL CHAMBER Councilman Gillanders moved to accept the low bid from Coordin ated Resources, Inc. in the amount of $3,163.64 for the purcha of seven conference chairs for the Council Chamber and authorize purchase of said chairs, seconded by Councilman Dennis and unani- mously carried. C. SECURITY OF PUBLIC FUNDS At the suggestion of Councilman Tyrell, City Manager Koski re- viewed the investment of City funds and the security behind them. The policy of the City has been to invest the bulk of its reserve funds in the Bank of America, Security Bank and the Local Agency Investment Fund, which is.administed by the State of California. 15 025 1 1 Council Minutes, March 19, 1985 - Page 5 Banks are regulated by Government Code. California law requires public funds to be collateralized; that is, the depository must secure its public fund accounts by maintaining, with the agent of the depository, securities having a market value of at least 110% of the value of the public fund accounts. If the bank uses mortgage- backed securities, the market value of the mortgage backed securities must be at least 150 %. The bank may not inter- change classes of securities without prior approval of the trea- surer. The City's auditing firm, McGladrey Henrickson, requests a report on collateral each year. The City Treasurer and City Manager are presently preparing a resolution for the City Council's consideration on the policy of investing City funds. D. CLAREMONT McKENNA STUDY (CONSTITUTIONAL REFORM GONE AWRY: THE NO- PROPERTY TAX CITIES .& PROPOSITION 13) Councilman Tyrell expressed concern about the degree of progress being made regarding the results of the study made by Claremont McKenna College. The study has been sent to Warren Beebe, a con- stitutional attorney, for his review and opinion. Council sche- duled this matter for a study session in early April. E. AMBULANCE SUIT (CITIES vs L.A. COUNTY) Councilman Tyrell stated that the Motion to Join was granted; therefore, all cities will be joined into the lawsuit which is being set for trial. However, each city will have to prove its own case. F. CAMPBELL BILL Mayor Swain referred to communications from California Contract Cities and the City of Norwalk for Council's support for Senator Campbell's bill which would extend a 10G property tax credit to all of the remaining non - sharing property tax cities in the State. City Attorney Martin stated the City would gain from the legis- lation and did not feel that support by the cities for this leg- islation would affect future litigation. G. MAINTENANCE OF ALLEY/PAINTING OF DOUBLE LINES Councilman Gillanders raised the issue of alley maintenance north of Lower Azusa Road and easterly of Pal Mal which serves resi- dents within the City of Temple City and also the commercial development of the City of El Monte. Public Works Coordinator Peterson was asked to investigate the situation. Councilman Gillanders also referred to the faded condition of the double lines on Lower Azusa Road in the vicinity of the Von's Market offices between Ryland and Birchland. Public Works Co- ordinator Peterson will follow up on this matter also. 12. ADJOURNMENT: On motion by Councilman Tyrell, seconded by Councilman Dennis, meet- ing adjourned to executive session at 8 :15 p.m. Next regular meeting of the City Council will be held Tuesday, April 2, 1985 at 7:30 p.m. in the Council Chamber of the City Hall.
