A SPECIAL ORDINANCE VACATING THE PUBLIC WAY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EAST RIGHT-OF-WAY LINE OF SOUTH 18TH STREET, SAID POINT BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS: COMMENCING AT THE NORTHWEST CORNER OF THE NORTHEAST QUARTER OF SECTION 9, TOWNSHIP 13 NORTH, RANGE 1 WEST, AND RUNNING THENCE NORTH 90 DEGREES, 13 MINUTES AND 00 SECONDS
EAST, ALONG THE NORTH LINE OF SAID NORTHEAST QUARTER, 763.53 FEET TO THE INTERSECTION OF SAID NORTH LINE WITH THE EXTENSION OF THE EAST RIGHT-OF-WAY LINE OF SAID SOUTH 18TH STREET;
THENCE SOUTH 00 DEGREES, 03 MINUTES AND 05 SECONDS EAST, ALONG SAID EAST RIGHT-OF-WAY LINE, 304.56 FEET TO THE BEGINNING POINT OF THIS DESCRIPTION, AND RUNNING THENCE FROM SAID BEGINNING
POINT, NORTH 90 DEGREES, 13 MINUTES AND 00 SECONDS EAST, PARALLEL TO SAID NORTH LINE, 412.63 FEET TO A POINT; THENCE SOUTH 00 DEGREES, 01 MINUTE AND 25 SECONDS EAST, 100.01 FEET TO
A POINT; THENCE SOUTH 89 DEGREES, 13 MINUTES AND 00 SECONDS WEST, PARALLEL TIO SAID NORTH LINE, 412.59 FEET TO A POINT ON SAID EAST RIGHT-OF-WAY LINE, THENCE NORTH 00 DEGREES, 03 MINUTES
AND 05 SECONDS WEST, ALLONG SAID EAST RIGHT-OF-WAY, 100.01 FFET TO THE END OF THIS EASEMENT DESCRIPTION, CONTAINING AN AREA OF 0.947 ACRES.
WHEREAS First Richmond Corporation and MP Realty Group have petitioned Common Council of Richmond, Indiana, requesting the vacation of the public way described as follows:
Beginning at a point on the east right-of-way line of South 18th Street, said point begin more particularly described as follows: Commencing at the northwest corner of the Northeast
Quarter of Section 9, Township 13 North, Range 1 West, and running thence north 89 degrees, 13 minutes and 00 seconds east, along the north line of said Northeast Quarter, 763.53 feet
to the intersection of said north line with extension of the east right-of-way line of said South 18th Street; thence south 00 degrees, 03 minutes and 05 seconds east, along said east
right-of-way line, 304.65 feet to the beginning pint of this description, and running thence from said beginning point, north 89 degrees, 13 minutes and 00 seconds east, parallel to
said north line, 412.64 feet to a point; thence south 00 degrees, 01 minute and 25 seconds east, 100.01 feet to a point; thence south 89 degrees, 13 minutes and 00 seconds west, parallel
to said north line, 412.59 feet to a point on said east right-of-way line, thence north 00 degrees, 03 minutes and 05 seconds west, along said east right-of-way, 100.01 feet to the
end of this easement description.
WHEREAS one of the two owners of all land abutting the above described public way have joined in said petition requesting vacation, and
WHEREAS in the abutting land owners who did not join in said petition have been notified by the City Clerk as required by statute, and
WHEREAS said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition June 15, 1998, after publishing legal notice thereof at least 10 days in advance
of said hearing as required by statute, and
WHEREAS the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a p[ublic hearing on said petition May 28, 1998, after publishing legal notice thereof at
least 10 days in advance of said hearings as required by ordinance, and
WHEREAS it is desirable to vacated said public way,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond,
Indiana, that subject to the preservation of easements for existing utilities, the public way
described below is hereby vacated and the abutting property owners shall acquire
ownership of the land heretofore dedicated as a public way as indicated below, to wit:

thence north 00 degrees, 03 minutes and 05 seconds west, along said east right-of-way, 100.01 feet to the end of this easement description.
Passed and adopted this 22nd day of June, 1998, by the Common Council of the City of Richmond, Indiana.
