LYNWOOD CITY COUNCIL, APRIL 28 1999 1^ The City �Council met in a Special Session in the City Hall, 11330 Buliis Road, on the above date at 9:44 a.m. Mayor Sanchez presiding. . Councilman Byrd, Reyes, Richards and Sanchez answered the roll ca1L Councilman Rea was absent. . . , Also present were Interim City Manager Davis, City Attorney Thever, City Clerk - " Hooper, City Treasurer Pygatt and Department Heads. �� ��� � Cit Clerk Hoo er announced the A en � � • y p g da had been duly posted in accordance with The Brown Act. PUBLIC ORALS None CLOSED SESSION It was then moved by Councilman Richards, seconded by Councilman Byrd and carried to recess to ajoint closed session with Lynwood Redevelopment Agency at 9:47 a.m. Council reconvened at 10:50 a.m. City Attorney reported by a 3 to 1 vote with one absent, the City Council was advised of the opinion letter provided by special counsel, Donna Melby of Sedgwichk, Detert, Moran & Arnold. This letter advises that by Apri130, 1999, a rejection is claimanYs failure to file a timely claim. However, the City's rejection of this claim does not prevent Ms. Richards filing a late claim.with the City, to adjudicate the substantives issues of the case. ��' � The City Attorney further advised the City Council that at such time of filing of a late . "' claim, there will be two (2) issues that need Yo be resolved. One, the late claim matter. Two, the employment status issue. � City Council instructed the City Attorney not to send claim of rejection at this time. The City Councilmembers were appraised that failure to send such a letter of rejection, will prohibit the City from asserting the defense of a late claim when Ms. Richards files the lawsuit against the City. City Council further instructed that the issue of employee status should be resolved administratively by the manager. And, for the Interim City Manager and the City ` Attorney to come back with the options of resolutions to Ms. Richards' claim at a later date. It was moved by Councilman Reyes, seconded by Councilman Byrd to adjourn at 11:05 a.m. . Before adjournment Coui.cilman Byrd and Mayor Sanchez inquired on the progress for a Business License for Atlantic Auto Center on Imperial Highway across from Bank of �I America, also inquired on the progress on the 19 houses to be built on Edgebrook, 8 � units on Lynwood Road and the Home Dollars 1 year action plan. �, Community Development Director Chicots stated he would look into the progress of each project and report to CounciL ving no further discussion, Mayor Sanchez declared meeting adjourned at 11:06 p.m. � �� ��� � ��� � RI O SANCHEZ, Mayor ANDREA L.
