HomeMy Public PortalAbout2004-060 Resolution Granting CUP Amend & Variance for Three Rivers Park for Chemical Storage BldgMember Workman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-60 RESOLUTION GRANTING CONDITIONAL USE PERMIT AMENDMENT AND VARIANCE FOR THREE RIVERS PARK DISTRICT FOR A CHEMICAL STORAGE BUILDING AT 2935 PARKVIEW DRIVE WHEREAS, the applicant, Three Rivers Park District has requested approval of a conditional use permit amendment to allow a chemical storage building up to 700-square feet in size; and WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval based on the characteristics of the use being in compliance with the intent of the zoning district; and WHEREAS, the conditional use permit amendment is to allow a new storage building on the site; and WHEREAS, the use would improve safety and be protective to the environment; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that it should and hereby does approve the request by Three Rivers Park District for a conditional use permit amendment to allow construction up to a 700- square foot chemical storage building at the Baker National Golf Course located at 2935 Parkview Drive, and NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota, that it should and hereby does approve the request by Three Rivers Park District for a variance to allow construction of the building authorized by this amended conditional use permit, in accordance with the plans and specifications that were approved by the Planning Commission and City Council, subject to the following findings and conditions: A. The variance to allow a building constructed of over 20% with metal is approved. based on the following findings: 1. There are exceptions or extraordinary circumstances that apply to the request due to the size of the subject property. 2. The literal interpretation of the Ordinance would deprive the applicant from constructing a building that would avoid environmental degradation. Resolution No.04-60 October 19, 2004 3. The special conditions are not self-created as the building would improve safety, protect the environment and is out of sight from the general public. 4. The variance would not confer on the applicant any special privileges that are denied to other lands. The accessory building is small in size given the excessive size of the property. 5. The variance request is the minimum necessary to eliminate hardship as it relates to safety and environmental protection. 6. The variance would not be materially detrimental to the ordinance or property in the same zone, as the building would maintain at least a 2,000-foot setback from any property line. B. A building permit is required prior to construction of the new accessory building. Dated: October 19, 2004. ATTEST: Chad M. Adams, City Administrator The motion for the adoption of the foregoing resolution was duly seconded by member Brinkman upon vote being taken thereon, the following voted in favor thereof: Workman, Lane, Zietlow, Brinkman and the following voted against same: (Absent: Smith) None Whereupon said resolution was declared duly passed and adopted.
