AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, FOR
PROPERTY LOCATED AT 728 EAST MILLER STREET, CONSISTING OF PART OF INLOT NO.
755, JEFFERSON CITY, COLE COUNTY, MISSOURI, BY REZONING 0.15 ACRES FROM RA-2
HIGH DENSITY RESIDENTIAL TO PUD PLANNED UNIT DEVELOPMENT AND APPROVING A
PUD PLAN.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with,as said property owners submitted to the Planning and
Zoning Commission and City Council a PUD Plan for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RA-2 High Density Residential
to PUD Planned Unit Development: Part of Inlot No. 755 in the City of Jefferson, Missouri, described
as follows: Beginning at the northeasterly corner of said inlot;thence westerly along the northerly line
of said inlot, 52 feet 21/4 inches;thence southerly parallel with the easterly line of said inlot, 128 feet
9 inches; thence easterly parallel with the northerly thereof, 52 feet 2 1/4 inches to the easterly line
thereof; thence northerly along and with said line to the place of beginning. Containing 0.15 acres
more or less.
Section 2. The Preliminary and Final PUD Plan submitted by Stacy and Rose Huffman on file
in the Jefferson City Planning Division as Case No. P07022, to convert the existing church into a
karate school is hereby approved, subject to the conditions outlined in Section 3.
Section 3. Approval is made subject to the following conditions: (1) The underlying zoning
district for the purpose of determining allowed uses shall be RA-2 Multi-Family Residential with the
addition of karate school as an allowed use; (2) The existing trees at the rear of the property that are
larger than 3 inch caliper shall be preserved; (3) Fencing shall be a maximum height of six (6) feet,
shall be wood or maintenance free vinyl of a white or neutral color, and shall not extend into any front
yard; (4) The proposed gazebo shall be located in the rear yard, shall be a maximum size of 25' by
25' and shall be of a white or neutral color; and (6) Signage shall be as approved by the Planning &
Zoning Commission in Case No. P07022.
Section 4. No building expansion is authorized with the approval of this PUD Plan.
Section 5. Common Areas and Public Land. No common areas are proposed and no lands
are dedicated to public use with this PUD Plan.

The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday, August
20, 2007 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320
East McCarty Street, to consider rezoning land located at 728 E. Miller Street from RA-2 High
Density Residential to PUD Planned Unit Development, and a Preliminary and Final PUD Plan
for a karate school:
Section 1. Property Description: Part of Inlot No. 755 in the City of Jefferson, Missouri,
described as follows: Beginning at the northeasterly corner of said inlot; thence westerly along
the northerly line of said inlot, 52 feet 2 1/4 inches; thence southerly parallel with the easterly
line of said inlot, 128 feet 9 inches; thence easterly parallel with the northerly thereof, 52 feet 2
1/4 inches to the easterly line thereof; thence northerly along and with said line to the place of

Section 2. Rezoning application. The property is proposed to be rezoned from RA-2 High
Density Residential to PUD Planned Unit Development.
Section 3. PUD Plan. The Proposed Preliminary and Final PUD Plan involves
converting the existing church into a karate school. The underlying zoning district proposed for
the property for the purpose of establishing allowed uses is RA-2 High Density Residential, with
the addition of a karate school as an allowed use. The application was filed by Stacy and Rose

Case No. P07022 —728 E. Miller Street; Rezoning and Preliminary and Final PUD Plan.
Request filed by Stacy and Rose Huffman, property owners, to rezone approximately 0.15
acres from RA-2 High Density Residential to PUD Planned Unit Development and a
Preliminary and Final PUD Plan to operate an indoor athletic and exercise club/karate school
on the property. The property is located on the southwestern corner of the intersection of
East Miller Street and Cherry Street and is described as part of Inlot No. 755 in the City of
Jefferson, Missouri.
Mr. Stacy Huffman, 22246 Crum Road, Jamestown, Missouri, spoke regarding this request.
Mr. Huffman explained that the purpose of this request is to allow the existing church to be
converted into a marshal arts school. He stated that the hours of operation are generally from
6:00 p.m. to 9:00 p.m. and on street parking is available on Miller Street.
No one spoke in opposition to this request and no correspondence was received.
Mr. Barron gave the Planning Division staff report and explained that the most appropriate
underlying zoning is RA-2 with the addition of karate school as an allowed use. The applicant
intends to utilize on-street parking since the property does not have on-site parking and no on-
site parking is planned. The applicant attempted to arrange a parking agreement with the
Masonic Lodge, located on the opposite side of the intersection of Cherry and Miller Streets, but
was unsuccessful because of liability and insurance concerns. Mr. Barron also described the
landscaping, on-site improvement, and signage conditions outlined in the staff report.

Ms. McMillan suggested forwarding a separate ordinance to the City Council restricting
parking on Cherry Street, south of Miller Street. She stated that most parking regulations are
reviewed by the Transportation and Traffic Commission and a concurrent recommendation is
needed. Ms. McMillan explained that the type of development in this neighborhood is
predominately single family residential and the uses in the neighborhood do not generate a lot of
on street parking.
Mr. Huffman explained that there would be typically be no more than 10 children present at
one time, with a maximum occupancy of 15 children. He stated that most parents will drop off
and pick up their children, while the children in the immediate neighborhood could walk to the
karate school. Mr. Huffman explained that the hours of operation will remain the same during
the week, but weekend hours could vary. He also stated that there will be periodic fundraising
events that should not cause parking problems.
Mr. John Riley (an associate of Mr. Huffman), 1434 Bald Hill Road, spoke regarding this
request. Mr. Riley stated that due to the amount of area that each student requires, no more
than about 14 children could be training in the building at any one time.
Mr. Bickel moved and Mr. Gresham seconded for the following:
A. To recommend approval of rezoning 0.15 acres from RA-2 to PUD to the City Council.
B. To recommend approval of the Preliminary and Final PUD Plan to the City Council, subject to the
following conditions:
1. The underlying zoning district for the purpose of determining allowed uses shall be
• RA-2 Multi-Family Residential with the addition of karate school as an allowed use;
2. On-street parking spaces shall be utilized to meet the parking requirement applicable
to the property. No parking associated with this property shall be allowed on Cherry
Street south of Miller Street;
3. The existing trees at the rear of the property that are larger than 3 inch caliper shall
be preserved and not removed;
4. The proposed fence shall be a maximum height of 6 feet and shall not protrude in
front of the front face of the existing building. The fence shall be wood or
maintenance free vinyl and shall be of a white or neutral color;
5. The gazebo in the rear yard shall be a maximum size of 25' by 25' and shall be of a
white or neutral color;
6. Allowed signage as follows:
a. One sign attached to the front of the building. Maximum size of 24 square
feet. To be located above the front entrance no more than 20 feet above
street level.
b. One sign attached to the rear or side of the building. Maximum size of 24
square feet. To be located no more than 32 feet above street level.
C. One (existing) announcement board. Maximum size of 12 square feet.
d. No signage shall be painted directly on the building.
C. To recommend the prohibition of parking on Cherry Street south of Miller Street to the City
Council.

Besides brining the electrical and plumbing up to code, extensive repairs and
maintenance are planned. The following activities, repairs and remodeling may occur.
1. Restore the hardwood floors.
2. Replace the windows with energy efficient windows.
3. Build a roof over the front porch area reconfigure the front entryway to be
handicap accessible.
4. Extensive maintenance on the wooden decks. Not to change the size.

6. Roof will need to be replaced on the steeple.

1. Repair foundation cracks along the left side. Backhoe work to repair the
wall and put in new drain tile.

Case No. P07022—728 E. Miller Street; Rezoning and Preliminary and Final PUD Plan. Request filed by
Stacy and Rose Huffinan, property owners, to rezone approximately 0.15 acres from RA-2 High Density
Residential to PUD Planned Unit Development and a Preliminary and Final PUD Plan to operate a karate school on
the property. The property is located on the southwestern corner of the intersection of East Miller Street and
Cherry Street and is described as part of Inlot No. 755 in the City of Jefferson,Missouri.
Notification
By publication in the newspaper, by letter to adjacent and affected property owners within 185 feet, and by
posting a sign on the property.
Nature of Request
The applicant recently purchased this property and intends to convert the existing church into a karate school.
The property is currently zoned RA-2 High Density Residential. A karate school would be classified as an
indoor athletic and exercise club,which is not permitted in the RA-2 zoning district. The applicant has applied
to rezone the property to PUD in order to establish a karate school as an allowed use so that the existing
building can be utilized as a karate school. The applicant is also proposing some optional site improvements
including a fence, gazebo, and landscaping.
Location
The subject property is located on the southwestern corner of the intersection of East Miller Street and Cherry
Street.
Staff Analysis
Permitted Uses. The applicant intends to convert the existing church building into a karate school. Based on
the surrounding zoning and intended use of the property,the most appropriate underlying zoning is RA-2 with
the addition of karate school as an allowed use.
Parking. The parking requirement for a health club/fitness center is 1 space for every 200 square feet. The
size of the proposed karate school is 2000 square feet which would require a total of 10 parking spaces. The
property does not have any on-site parking spaces and no on-site parking spaces are planned. The applicant
intends to utilize on-street parking to serve the karate school operation. On-street parking in this area is
restricted to one side of the road on Miller Street(west of Cherry Street)and one side of the road on Cherry
Street(north of Miller Street). Staff believes that parking on Cherry Street should be restricted so as not to
interfere with the operation of the Transit System and Central Maintenance Facility.
Although the owner of the property attempted to arrange a parking agreement with the organizers of
the Masonic Lodge(on the opposite side of the intersection of Cherry Street and Miller Street)an agreement
could not be made due to liability and insurance concerns.
Sidewalks. There are existing sidewalks along E. Miller Street.
Landscaping. The applicant proposes a general landscaping of the site with small plants in the front and a
Japanese garden in the rear of the property. The applicant also proposes to remove the brush and trees near the
rear fence row. Staff believes that the existing trees in the rear of the property serve to buffer this residential
area from the traffic and associated noise generated by Highway 50/63 and should remain in place.

Sig s. The applicant proposes signage as follows:
1. Front sign over the door—3 foot tall by 8 foot wide(24 square feet).
2. Back sign painted on the back of the building— 2 sections each 4 foot tall by 10 foot wide (80
square feet).
3. Existing Announcement Board located in the front yard facing the intersection of Miller Street and
Cherry Street—4 foot tall by 3 foot wide(12 square feet).
Staff believes that 80 square feet of signage on the rear of the building is out of character with the area and that
signage on the rear of the building should be limited to 24 square feet. Also, no signs should be painted
directly on the building.
Lighting. The applicant proposes to replace the existing lighting on the building with similar fixtures.
Site Improvements. The applicant shows an optional wood or maintenance free vinyl privacy fence along the
western property line(maximum height 6 foot,to be painted white or a neutral color). An optional gazebo is
also shown in the rear yard(maximum size 25 foot by 25 foot).
Building improvements. The applicant is proposing a variety of general maintenance and repair activities to
the exterior of the building including painting the building a white or light tan natural color,building a roof
over the front porch and reconfiguring it to be handicap accessible, and replacing the roof on the steeple.
Staff Recommendation
Staff recommends approval of the Preliminary and Final PUD Plan subject to the following conditions:
1. The underlying zoning district for the purpose of determining allowed uses shall be RA-2 Multi-Family
Residential with the addition of karate school as an allowed use.
2. On-street parking spaces shall be utilized to meet the parking requirement applicable to the property. No
parking associated with this property shall be allowed on Cherry Street south of Miller Street.
3. The existing trees at the rear of the property that are larger than 3 inch caliper shall be preserved and not
removed.
4. The proposed fence shall be a maximum height of 6 feet and shall not protrude in front of the front face of
the existing building. The fence shall be wood or maintenance free vinyl and shall be of a white or neutral
color.
5. The gazebo in the rear yard shall be a maximum size of 25' by 25' and shall be of a white or neutral color.
6. Allowed signage as follows:
a. One sign attached to the front of the building. Maximum size of 24 square feet. To be located
above the front entrance no more than 20 feet above street level.
b. One sign attached to the rear or side of the building. Maximum size of 24 square feet. To be
located no more than 32 feet above street level.
c. One(existing) announcement board. Maximum size of 12 square feet.
d. No signage shall be painted directly on the building.
