CITY OF MEDINA
RESOLUTION NO.04-61
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR KELLER
ESTATES
WHEREAS, Keller Estates, LLC (the "Applicant") has applied to the city of Medina (the
"City") to plat certain property located generally west of Willow Drive and south of the Medina
Momingside neighborhood (the "Subject Property"), which the property is legally described on
Exhibit A attached hereto; and
WHEREAS, the plat of the Subject Property, to be known as Keller Estates, was reviewed
by the planning commission at its meetings on April 13, August 10 and September 15, 2004 and,
following public hearing thereon as required by law, the planning commission recommended
approval thereof, subject to certain terms and conditions ; and
WHEREAS, the city council on September 7 and October 5, 2004 reviewed the preliminary
plat for its conformance with the City's ordinances, considered the recommendations of the
planning commission and heard comments from the Applicant and other interested parties.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina,
Minnesota that preliminary approval be granted to the Applicant for the plat of Keller Estates,
subject to the following terms and conditions:
1. Prior to preliminary plat approval, the Applicant must submit revised storm water
management plans which meet all city requirements for both water quality and
quantity;
2. Prior to final plat approval, the Applicant must demonstrate that the 7,291 sq. ft.
wetland on the western side of the Subject Property and the 7,153 sq. ft. wetland on
proposed Lots 2 and 3, Block 1, Keller Estates have been mitigated or that they have
purchased the required wetland credits in compliance with the Wetlands
Conservation Act. Preference for mitigation shall be within the portion of Medina
within the Minnehaha Creek watershed district or, secondly, elsewhere within
Medina;
3. Prior to final plat approval, the Applicant must submit plans regarding the
subdivision in compliance with the requirements of the city engineer;
4. Prior to final plat approval, the Applicant must submit a letter from the city of Orono
stating that all prerequisites of Orono have been met by the Developer and that
Orono has agreed to provide sanitary sewer and water to the subdivision. In
addition, Orono must have executed an amendment to the agreement with Medina

dated August 10, 1981 regarding sanitary sewer which permits service to the
subdivision;
5. Prior to final plat approval, the Applicant must submit a landscape plan for the
subdivision that provides for the installation of two trees a minimum of two and one-
half inches caliper to be planted in the front yard of each new lot in the subdivision;
6. Prior to final plat approval, the Applicant must demonstrate that all conditions of the
Minnehaha Creek watershed district have been met;
7. Prior to final plat approval, the Applicant shall submit a plan for the proposed rain
garden which includes design details and a list of proposed plantings;
8. Prior to initiation of any site work within the subdivision the Applicant must install
signs on Willow Drive at Morningside Road and at the access road to the Subject
Property to use the access road for all construction traffic;
9. Prior to initiation of any site work within the subdivision, the Applicant must submit
an inventory of significant trees. Deciduous trees of at least 8 inches caliper and
coniferous trees of at least 6 inches caliper are considered significant. Construction
limit lines shall be adjusted to preserve significant trees on the Subject Property;
10. The Applicant must remove the debris located in the southwest corner of proposed
Lot 1, Block 1, west of the mowed area;
11. The Applicant must resubmit the application for additional review by the planning
commission if the number of lots within the subdivision is changed due to the
wetlands;
12. The Applicant must install a fence around the NURP pond if determined to be
desirable by the City;
13. The Applicant must provide for a five foot non -mowed buffer around the wetlands;
14. The Applicant must install a sump pump drainage system for all homes within the
subdivision which shall include a six inch corrugated pipe adjacent to the sanitary
sewer for the footing drains and a stub into the basement for the sump pump;
15. Any subdivision monument signs must meet city sign ordinance requirements;
16. Prior to final plat approval, the Applicant must grant to the City a 15 foot trail
easement along the west side of Willow Drive. The remainder of the park
dedication requirement shall be met by payment of cash in lieu;
17. Prior to final plat approval, the Applicant must submit documents satisfactory to the
city attorney assuring that the home owners within the subdivision will be

responsible for the maintenance and repair of the storm water drainage system,
including the NURP pond and the rain garden. The City also intends to establish a
storm water improvement tax district including the Subject Property.
18. Prior to final plat approval, the Applicant shall revise the storm water management
plans in a manner acceptable to the city engineer to expand the size of the NURP
pond towards the proposed right-of-way in the southwest corner of the subdivision;
19. Prior to final plat approval, the Applicant shall enter into a subdivision agreement
satisfactory to the city to provide for construction of public improvements within the
subdivision; and
20. The Applicant shall pay to the city a fee in an amount sufficient to reimburse the city
for the cost of reviewing the plat and drafting and negotiating the subdivision
agreement, which shall include an enhanced warranty period for the storm water
improvements, and related documents.

Whereupon said resolution was declared duly passed and adopted.
