AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING 3.08 ACRES FROM RS-2 LOW DENSITY RESIDENTIAL TO RA-1 HIGH DENSITY
RESIDENTIAL, FOR LAND LOCATED NORTHWEST OF THE INTERSECTION OF OLD LOHMAN
ROAD AND SOUTH COUNTRY CLUB DRIVE, LOCATED IN PART OF THE NORTHWEST
QUARTER OF THE NORTHWEST QUARTER OF SECTION 17, TOWNSHIP 44 NORTH, RANGE
12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI AND ENDORSING AN AMENDMENT
ON THE DEVELOPMENT PLAN MAP OF THE COMPREHENSIVE PLAN TO REFLECT SUCH
CHANGE.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the
zoning map and the proposed zoning change would necessitate a change to the
Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is rezoned from RS-2 Low Density Residential
to RA-1 High Density Residential: Part of the Northwest Quarter of the Northwest Quarter of Section

follows: From the Southwest corner of Section 8, township 44 North, Range 12 West, Cole County,
Missouri; thence N6°32'04"W, along the Section Line, 813.10 feet to the most northerly corner of a

The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday, August

Rezoning and Comprehensive Plan Amendment. Request filed by Dale and Alvyne
Scheperle, property owners, to rezone approximately 3.08 acres from RS-2 Low Density
Residential to RA-1 High Density Residential and an associated amendment to the
development plan map of the comprehensive plan. The property is located on the northern
corner of the intersection of Old Lohman Road and South Country Club Drive. The property
is described as part of the Northwest Quarter of the Northwest Quarter of Section 17,
Township 44 North, Range 12 West, Cole County, Missouri. (Central Missouri Professional
Services, Consultant)
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke
regarding this request. Mr. Bates distributed a visual depicting the area to be rezoned. He.
explained that the intent of the rezoning request is to allow the construction of duplexes. Mr.
Bates stated that a preliminary plat will be brought before the Commission in the near future.
Mr. Bill Wise, 4710 Old Lohman Road, expressed concerns of an increase in traffic, safety of
children walking to school and retaining the integrity of the adjoining single family residential
neighborhood.
Correspondence in opposition to the rezoning request was received from Bill, Keely, Emily
and Jake Wise, 4710 Old Lohman Road.
Mr. Barron gave the Planning Division staff report and explained that the purpose of the
rezoning request is to match the zoning of the rest of the property and to make the property
• available for a combination of duplex and multi-family residential development.
Mr. Nunn moved and Mr. Jordan seconded to recommend approval of rezoning
approximately 3.08 and an associated comprehensive plan amendment to the City Council. The
motion passed 6-0 with the following votes:

A. There was no error when the existing zoning was adopted.
B. South Country Club has been improved by the City as an arterial roadway.
Development continues westerly. The school district is building a new
elementary school at Apache Flats and is expanding Lawson Elementary.
C. There is currently a shortage of duplex and multifamily lots in the City.
D. The proposal would appear to compliment the Comprehensive Plan.
E. The property is bordered on the northeast by C-1 zoning. The property to the
west is not in the City. The property to the south is largely industrial.
F. All public facilities are readily available.
• G. The total number of units is not anticipated to require a site specific traffic
impact study.
H. As previously mentioned, the City has made substantial thoroughfare
improvements in the area.
I. The density of the development is not anticipated to have a significant
environmental impact.
J. The overall tract is 7.73 acres and is bordered by a natural buffering creek to
the northeast.
K. The type of housing proposed should benefit the community as residential
development.

f. Whether public and community facilities,such as utilities,sanitaryand storm sewers,water,police and
fire protection, schools, parks and recreational facilities, roads, libraries, solid waste collection and
disposal, and others are adequate to serve development for the type and scope suggested by the
• proposed zone. If utilities are not available, whether they can be extended reasonably.
g. Whether there is an adequate supply of land available in the subject area and the surrounding
community to accommodate the zoning and community needs.

First and foremost our family is against rezoning the property outlined

to RA-1 High Density Residential.
We are against changing the zoning for the following reasons:
The current properties that are adjacent to or near to the property in
question are single residence homes that create a neighborhood of
home owners. By rezoning the property to high density residential,
the value of the existing single family homes could be hurt because
the neighborhood becomes a mix of home owners in single family
homes and renters in apartment buildings or duplexes.
The current layout of newly zoned rental properties proposed by Mr.
Sheperle (he gave us a copy) would create a complex of a minimum
of 23 duplexes or possibly more if apartments are erected. This
scenario would mean a minimum of 46 working families (92 cars,
possibly more) driving away daily from their apartments/duplexes
from one road that connects to Old Lohman Rd. Since Mr. Sheperle
does not reside on the property he may not be aware that Old
Lohman Road is a very busy, VERY dangerous and narrow road
with few lines, no sidewalks, blind entrances to all existing
properties (including his property) and speeding vehicles (some over
40 mph) coming down the hill on a daily basis. I know of at least one
fatal accident on this road since residing there. Any additional
housing will add to the traffic strain on this street.
We received 2 different zoning/annexation letters in December of
2002 and January 2003 when Mr. Sheperle voluntarily annexed the
back part of his property into the city. When we received the letter,
we called the planning and zoning department for clarification. The
planning and zoning department faxed us a zoning exhibit outlining
the proposal. We noticed that some of the property (on the other side
of the creek) was C-1 which we figured was commercial and the
other section was RA-1 which (our mistake in not understanding the

• code) was residential and that Mr. was Sheperle going to build a few

houses up hill from the creek. There was no mention at all in any
conversations about the property with Mr.Sheperle or the city, about
what RA-1 meant. The wording of the letter that we that we just
received is totally different than the letters of 2002/2003. If we had
Known the RA-1 meant High Density Multi Family, we would have
opposed it in late 2002 / early 2003. Now of course we can't do
anything about the back part of the property unless Mr. Sheperle
would agree to file to re-zone it RS-2 - single family.
In late May/Early June of this year Mr. Sheperle showed us his
proposed building plan and said that it was "up to us" whether or not
we would "allow" the zoning change to High Density Residential. We
called him on Monday June'l2th and told him that we were against
changing the zoning to High Density Residential. He had either filed
already by that date or went ahead and filed anyway. We do not
know. He did not call us to let us know that he filed. We found out
when we saw the sign by the road and called Eric Barron at the
planning office for more information.

Although we appreciate him coming to us with his proposals for this
new development ahead of time; he did not come to us in late 2002 or
early 2003 when at that time he voluntarily annexed into the city and
zoned part of his land multi-family. As previously stated, we would
have opposed it then had we known the zoning codes.
To conclude: At this time we must oppose the rezoning of the
property in case #P07023 that borders Old Lohman Rd to High
Density Residential. We do not feel it is in the best interest of all the
home owners involved for the reasons outlined above. Thank you for
