HomeMy Public PortalAbout2004-067 Resolution to Approve a Simple Subdivision for Charles Cudd LLCMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.04-67 A RESOLUTION TO APPROVE A SIMPLE SUBDIVISION FOR CHARLES CUDD, LLC WHEREAS, the applicant, Charles Cudd, LLC has requested approval of a simple subdivision to split a 77.65 acre parcel described as follows: The South Half of the Northeast Quarter of Section 3, Township 118, Range 23, Hennepin County, Minnesota, into two parcels located both east and west of Hackamore Road and north of Chippewa Road; and WHEREAS, the simple subdivision would result in Parcel A, described on Exhibit A attached hereto, being 1.32 acres, and WHEREAS, the simple subdivision would result in Parcel B, described on Exhibit A attached hereto, being 76.33 acres, and WHEREAS, the simple subdivision would result in contiguous development of the property when it is combined with the Bridgewater at Lake Medina Plat; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that it should and hereby does approve the request by Charles Cudd, LLC for a simple subdivision, in accordance with the plans and specifications that were approved by the City Council, subject to the following findings and conditions: 1. The applicant must pay an application fee. 2. The newly created Parcel A must be combined with the Bridgewater at Lake Medina plat to eliminate the creation of a substandard lot and to meet the ordinance standards. 3. The trees must be preserved per the Public Works Supervisor comments. 4. The road shall be moved off of the centerline to the east per the Public Works Supervisor comments. 5. A legal description of the 33 feet along the east edge of Parcel B must be provided. This 33-foot area will be a city easement. Resolution No. 04-67 November 16, 2004 Dated: November 16, 2004. Resolution No. 04-67 November 16, 2004 EXHIBIT A PARCEL A That part of the South Half of the Northeast Quarter of Section 3, Township 118, Range 23, Hennepin County, Minnesota, lying southeasterly of the following described line: Commencing at the southeast corner of said South Half of the Northeast Quarter; thence North 01 degrees 13 minutes 50 seconds East on an assumed bearing along the east line of said South Half a distance of 833.09 feet to the point of beginning of the line to be described; thence South 22 degrees 09 minutes 09 seconds West a distance of 86.32 feet; thence southerly 173.73 feet along a tangential curve concave southeasterly, having a central angle of 11 degrees 25 minutes 46 seconds and a radius of 870.89 feet; thence South 10 degrees 43 minutes 23 seconds West, tangent to said curve, a distance of 534.34 feet; thence southerly 29.99 feet along a tangential curve concave easterly, having a central angle of 10 degrees 06 minutes 25 seconds and a radius of 170.00 feet; thence South 00 degrees 36 minutes 58 seconds West, tangent to said curve, a distance of 30.00 feet to the south line of said South Half and said line there terminating.
