SUBJECT: ADOPTION OF RESOLUTION NO. 10-4686 APPROVING THE
ENGINEERING AND TRAFFIC SURVEY AND RECOMMENDED SPEED
LIMITS
SUMMARY
The City Council is requested to consider the adoption of Resolution No. 10-4686
approving the Engineering and Traffic Survey and recommended speed limits.
BACKGROUND
1. On September 20, 2005, our City Traffic Engineer completed the Engineering
and Traffic Survey and recommended speed limits.
2. On November 1, 2005, the City Council approved the Engineering and Traffic
Survey and recommended speed limits.
3. In May 2010, our City Traffic Engineer completed a new Engineering and Traffic
Survey and recommended speed limits.
Sections 22357 and 22358 of the California Vehicle Code (CVC) authorize local
authorities to establish prima facie speed limits on streets and roads under their
jurisdiction. Prima facie speed limits are specific limits stated in the CVC or specific
limits established on the basis of an engineering and traffic survey authorized by the
CVC.
Sections 40801 and 40802 of the CVC require that engineering and traffic surveys
support the prima facie speed limit before speed limits can be enforced by radar. The
law specifies that surveys be conducted every five (5) years to ensure that posted
speed limits are kept reasonably current.
In determining the speed limit, important factors such as prevailing speeds, unexpected
conditions, and collision records are examined. Speed limits should be established at
the nearest 5 miles per hour (MPH) increment to the 85th percentile speed. The 85th
percentile speed is defined as that speed at or below which 85 percent of the traffic is
moving and is often referred to as the critical speed. Speed limits established on the
basis of the 85th percentile conform to the consensus of those who drive highways as to
what speed is reasonable and prudent, and are not dependent on the judgement of one
or a few individuals. However, in matching existing conditions with the traffic safety

needs of the community, engineering judgement may indicate the need for a further
reduction of 5 MPH.
The basic speed law (22350 CVC) states that no person shall drive at a speed greater
than is reasonable or prudent. The majority of the drivers comply with this law. Speed
limits set at or slightly below the 85th percentile speed provide law enforcement officers
with a means of controlling the drivers who do not conform to what the majority
considers reasonable and prudent.
Temple City's Engineering and Traffic Survey
Our City Traffic Engineer has prepared an Engineering and Traffic Survey for 35 street
segments in the City, which are identified on the Citywide Speed Survey Summary. The
Engineering and Traffic Survey was conducted in accordance with the procedures
outlined in the California Manual on Uniform Traffic Control Devices (CA-MUTCD) for
Streets and Highways dated January 2010, as required by law.
Data regarding the prevailing speeds of vehicles, traffic collisions, visibility restrictions,
roadway conditions, pedestrian activities, on -street parking, and land use adjacent to
the roadways was collected for the Engineering and Traffic Survey. Radar speed
measurements were taken during off-peak periods for heavily travelled streets and
during non -congested peak periods on lightly travelled streets. All surveys were
conducted in clear weather and the radar measurements were taken from an unmarked
vehicle. Accident data was obtained from the computerized accident records system
maintained by the State of California Statewide Integrated Traffic Records System
(SWITRS).
FISCAL IMPACT
This item does not have an impact on this year's Fiscal Year (FY) 2010 — 2011 City
Budget. The Engineering and Traffic Survey was conducted using funds allocated in
the FY 2009 — 2010 City Budget.

RESOLUTION NO. 10-4686
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPROVING AND ADOPTING THE ENGINEERING AND TRAFFIC
SURVEY AND RECOMMENDED SPEED LIMITS
WHEREAS, Pursuant to Sections 22357 and 22358 of the California Vehicle Code (CVC) local
authorities may establish prima facie speed limits on streets and roads under their jurisdiction; and
WHEREAS, Pursuant to Sections 40801 and 40802 of the California Vehicle Code (CVC) an
Engineering and Traffic Survey was conducted to establish prima facie speed limits on streets and roads in
the City of Temple City; and
WHEREAS, Section 627 of the California Vehicle Code (CVC) defines the term engineering and
traffic survey and lists the requirements deemed necessary by CalTrans.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Temple City approves
and adopts the Engineering and Traffic Survey and recommended speed limits.
PASSED, APPROVED, AND ADOPTED on this 3rd day of August 2010.
