CITY OF MEDINA
RESOLUTION NO.04-73
RESOLUTION APPROVING LOT CONSOLIDATION FOR
THE GRAMERCY CLUB AT ELM CREEK
WHEREAS, The Gramercy Club at Elm Creek (the "Applicant") is the fee owner of two
parcels, Parcel A and Parcel B, located near the intersection of T.H. 55 and CSAH 101 and has
requested permission from the city of Medina (the "City") to consolidate the two parcels pursuant to
Section 820.03 of the Medina city code; and
WHEREAS, Parcel A is legally described in Exhibit A attached hereto; and
WHEREAS, Parcel B is legally described in Exhibit B attached hereto; and
WHEREAS, the'Applicant has also applied to plat Parcel A and Parcel B as Gramercy Club
at Elm Creek and has requested approval of the lot consolidation as an interim measure prior to final
approval of the plat, which is expected in early 2005; and
WHEREAS, the consolidation of Parcel A and Parcel B (collectively, the "Property") is
legally described in Exhibit C attached hereto; and
WHEREAS, the Medina city council has on this date reviewed the Applicant's request and
has determined that it is in the best interest of the Applicant and the City that the lot consolidation
be approved prior to final approval of the plat.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that the Applicant's request for a lot consolidation of Parcel A and Parcel B is hereby
granted.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota that the lot consolidation hereby approved shall be valid only until the plat of
Gramercy Club at Elm Creek has been recorded at Hennepin County, after which said lot
consolidation shall be of no further force and effect.

The motion for the adoption of the foregoing resolution was duly seconded by member Brinkman
and upon vote being taken thereon, the following voted in favor thereof:
Workman, Weir, Zietlow, Smith, Brinkman
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.

has read and understands the conditions of the above lot consolidation resolution, agrees to said
conditions and agrees to the recording of this resolution against the Property.

Parcel A is described as follows:
That part of the East 532.8 feet of Lot 25, Auditor's Subdivision No. 241, Hennepin County,
Minnesota, which lies south of the following described line:
Commencing at a point on the East line of said Lot, 578 feet North of
the Southeast corner of said Lot; thence West and parallel with the
South line of the Northeast Quarter of Section 12, Township 118,
Range 23 to the West line of said East 532.8 feet.
Except the South 100 feet of the West 269 feet and also except the South 30 feet of the East 263.8
feet of the above described property.
