HomeMy Public PortalAbout2005-003 Resolution Granting Final Plat Approval for Gramercy Club of Elm CreekMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-03 RESOLUTION GRANTING FINAL PLAT APPROVAL FOR GRAMERCY CLUB OF ELM CREEK WHEREAS, the city of Medina (the "City") has received an application from Gramercy Corporation (the "Developer") regarding the platting of certain land in Medina located generally north of T.H. 55 and east of CSAH 101, which land is legally described in Exhibit A attached hereto (the "Property"); and WHEREAS, the plat of the Property submitted by the Developer was reviewed by the planning commission on January 11, 2005 and, following a public hearing thereon as required by law, the planning commission recommended approval of the plat, subject to certain terms and conditions; and WHEREAS, on January 18, 2005, the city council reviewed the plat for its conformance with the ordinances of the City and the General Plan of Development previously approved by the City to guide development of the Property, considered the recommendations of the planning commission, and heard the comments of the Developer and other interested parties regarding the matter; and WHEREAS, the final plat has been reviewed by city staff for its conformance with the City's ordinances. NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota that final approval of the plat of Gramercy Club of Elm Creek is hereby granted, subject to the following terms and conditions: Resolution No. 2005-03 January 18, 2005 1. The Developer must pay an administrative fee to the city in an amount sufficient to reimburse the city for the costs of reviewing the plat of the Property; and 2. The Developer must file the final plat for the Property with Hennepin County within 60 days of the date of this resolution or the final approval hereby granted shall be null and void. Resolution No. 2005-03 2 January 18, 2005 EXHIBIT A KNOW ALL MEN BY THESE PRESENTS: That The Gramercy Club At Elm Creek, a Minnesota cooperative corporation, owner and proprietor, of the following described property situated in the County of Hennepin, State of Minnesota, to wit: The East 532.8 feet of Lot 25, Auditor's Subdivision No. 241, Hennepin County, Minnesota, except the South 100 feet of the West 269 feet thereof, and also except the South 30 feet of the East 263.8 feet thereof, lying South of the following described line: Commencing at a point on the East line of said Lot, 578 feet North of the Southeast corner of said Lot; thence West and parallel with the South line of the Northeast Quarter of Section 12, Township 118, Range 23, to the West line of said East 532.8 feet. Together with All that part of Lot 25, Auditor's Subdivision No. 241, Hennepin County, Minnesota described as follows: Commencing at a point on the South line of said Lot 25 which point is 532.8 feet West of the Southeast corner of said Lot 25; thence North and parallel to the East line of said Lot 25, a distance of 578 feet; thence West and parallel with the South line of said Lot 25 to the West line of said Lot 25; thence Southerly along the West line of Lot 25 to the Southwest corner of said Lot 25; thence East along the South line of said Lot 25 to the point of beginning. Has caused the same to be surveyed and platted as GRAMERCY CLUB AT ELM CREEK, and does hereby donate and dedicate to the public for public use forever the trail, highway, drive and road, and the easements as shown on this plat for drainage and utility purposes.
