At The Brewster Town Office Building, 2198 Main Street, Brewster, MA MEETING MINUTES OF MARCH 21 , 2018 Present ; Vice- Chair Faythe Ellis, Elizabeth Taylor, Diane Pansire, Roland Bassett, Barbara Burgo and William Klein Absent : Paul Ruchinskas and Sharon Marotti Also Present ., Assistant Town Administrator Donna Kalinicic, Housing Coordinator Jill Scalise, Brewster Historical Society Steve Jones and Sally Gunning, Vice-Chair Faythe Ellis called the meeting to order at 4 : 45 pm and CPC Consultant Eric Dray called into the meeting by phone . The meeting moved first to Agenda Item #3 . Recording or Taping Notification : "As required by the Open Meeting Law we are informing you that the Town will be videotaping and/or audio taping this public meeting. In addition, if anyone else intends to either video or audlo tape this meeting they are required to h form the chair. " We request that all cell phones be turned off or to vibrate. 1 , Discussion and possible vote on application completeness , CPA eligibility, and timeliness of the Town ' s $ 285 , 000 request to acquire 0 Millstone Road for community housing purposes . Assistant Town Administrator Donna Kalmick reviewed the CPC application for the request for the Town to purchase 1 . 5 acres at 0 Millstone Road for the purpose of building affordable housing. The town tools land adjacent to this parcel in 2004 through a tax taking . In 2005 the town voted to either transfer and/or sell a number of parcels for affordable housing . This 2005 article was not written correctly in order for this parcel to be developed for affordable housing. The Select Board will review an article to correct this on March 26, 2018 and decide if it will appear in the Special Town Meeting warrant . This new article must pass Town Meeting via a 2/3 vote , Because this article will appear in the Special Town Meeting warrant, should it fail , the CPC article in the Annual Town Meeting would be indefinitely postponed . There was a review of the appraisal that is based on this being adjacent to the 15 acres . It is expected that if this goes ahead, that these two parcels will be joined with a look towards some kind of affordable housing project subject to public input. Another appraisal will be coming forward that will look at other pieces of land that were purchased for access to a larger parcels CPC Meeting Minutes Of March 21, 2018 Page 1 of 5 for development. The Housing Production Plan was briefly reviewed that has identified this area of town for affordable housing . The current appraisal is for $ 185 , 000 . The current purchase price is $275 , 000 with $ 10 , 000 allowed for surveys . The market appraisal was for placing one house on this property. The value may increase due to the fact that it allows access to the adjourning 15 acres and this will be determined upon receipt of the new appraisal . Possible conditions to this award were reviewed. It is felt that this application has not been received in a timely manner, though the CPC likes to be flexible as to deadlines . The town has come forward as soon as this project came out of Executive Session. Only on last Friday was it determined the other problems with this purchase . Motion made by Roland Bassett to accept the application as revised . Diane Pansire seconded. VOTE : 6- 0-0 2 . Discussion and possible vote, including conditions, the of the Town ' s $285 , 000 request to acquire 0 Millstone Road for community housing purposes . The Housing Subcommittee recommends that $285 , 000 be approved for community housing purposes including conditions and restrictions funding $ 100 , 000 to come fiom Community Housing Reserve and $ 185 , 000 to come from the Reserve Fund with Diane Pansire as liaison to the project. Upon learning of the other issues with the purchase, it is suggested that additional conditions be a satisfactory appraisal justifying the purchase price and approval by Town Meeting that the adjacent 15 -acre parcel be used for affordable housing, Motion made by Roland Bassett to approve $275 ,000 for the purchase and $ 10 , 000 for survey work including restrictions and conditions that $ 100,000 come from Community Housing Reserve and $ 185 ,000 to come from the Reserve Fund, that Diane Pansire will be the liaison to the project, that a satisfactory appraisal be received justifying the purchase price, and approval by Town Meeting that the adjacent 15- acre parcel be developed for affordable housing. Diane Pansire seconded . VOTE ; 6=0 -0 The meeting moved to Agenda item #4 . 3 . Discussion and possible vote, including conditions, on the Brewster Historical Society ' s $ 176, 000 historic preservation request to rehabilitate the Cobb House outbuilding. President of the Brewster Historical Society Sally Gunning reviewed the revised construction numbers that were previously distributed to the Committee . The Brewster Historical Commission has reviewed the project with regard to eligible CPC funding and recommends this project be funded in the amount of $ 135 , 000 . Concern was expressed over recent talks that sea captains were part of the slave trade , It was noted that at this time, there is no evidence that any of Brewster ' s sea captains took part in the CPC Meeting Minutes Of March 21, 2018 Page 2 of 5 slave trade, that the Cobb house is not a memorial to the Sea Captain Elijah Cobb, but a repository for the Brewster Historical Society' s historical artifacts . Should it come to light that any sea captain in the Town of Brewster was involved in the slave trade, it will be made part of the town ' s history, as that cannot be changed. Motion made by Roland Bassett to accept the Brewster Historical Society ' s revised request in the amount of $ 135 ,000 for the project and $ 5 ,000 for associated costs , and that the funding source will be the CPC Historical Reserve Fund and Faythe Ellis will be the liaison. Diane Pansire seconded . VOTE : 6-0-0 Eric Dray recommends some oversight be made for the materials to be used in the restoration of this project and this will be outlined in the acceptance letter that will need to be signed by both parties involved . It is recommended that the building be restored onsite with as much original material as possible being used . The foundation and floor system needs to be addressed . It is expected to use as much of the original materials as possible and it is not expected to remove any of the walls from the property . It is felt that this cannot be known until the building is started to be taken apart . It is highly suggested that the Secretary of the Interior standards be strictly adhered to . The structural engineer report states that a portion of the building and the roof framing structure need to be removed . Eric Dray does not feel that CPC monies should be used to bring a building up to current building codes , as this is not an acceptable use of CPC funds . Concern expressed about the number of changes made to the building over the years . It is hoped to not take down all of the walls, but it is felt the back wall and the roof system will need to be removed . Until this building restoration begins , it is unknown what will be required . Because this is a historic building, there are concessions to the current building codes . It is important that the building be safe for the public . The most concern is the roof system that may have been compromised over the years . All of Eric Dray ' s recommendations will be stipulated in the award letter . The Brewster Historical Society plans on working in conjunction with Eric Dray ' s recommendations . The $ 5 , 000 of associated cost is for Eric Dray ' s services . Eric Dray hung up . The meeting moved back to Agenda item # 1 . 4 . Acceptance of the Town Open Space Committee ' s open space acquisition funding request. Elizabeth Taylor distributed the application for the Open Space Committee ' s request for a land acquisition . This will be reviewed by the Committee and voted on at the next meeting. This request will be $ 1 . 75 million and $ 35 , 000 for project related management of the application, applying for grants, and surveys . The funding will be $230 ,000 from the Brewster Conservation Trust and it is expected that a number of grants will be applied for, There is a state grant for $400, 000 along with a federal grant to help fund this purchase . The article mentions bonding for some or all of it depending on the grants received . Motion made by Roland Bassett to accept the Brewster Open Space Committee ' s open space acquisition funding request for 0 Long Pond Road , Barbara Burgo seconded . VOTE : 6-0-0 CPC Meeting Minutes Of March 21, 2018 Page 3 of 5 5 , Discussion and possible votes on conditional award letters to Community Development Partnership, Brewster Housing Authority, and the Recreation Department for its Tennis Court Rehabilitation and Athletic Field ADA Improvement requests . There was a review of the Cape Housing Institute Award Letter. Community Development Partnership was consulted in putting this award letter together, Motion made by Roland Bassett to accept the Cape Housing Institute Award Letter as presented. Diane Pansire seconded . VOTE : 6- 0-0 The Brewster Housing Authority Award letter was reviewed . Requirements and conditions were added into the award letter. Barbara Burgo abstained from voting on the award letter, Motion made by Roland Bassett to accept the Brewster Housing Authority Award letter as presented. Elizabeth Taylor seconded . VOTE : 5-04 There was a review of the ADA award letter. Since there is a request to move this request into the Special Town Meeting some of the dates in the letter need to be reviewed. There was a review of the Tennis Court award letter. It was decided that the last sentence of this award letter should be inserted in all award letters and others will be amended to include this language about returning the letters within 15 days . The award letters are to be reviewed by Town Counsel , 16 . Vote to approve minutes of the February 14, 2018 and February 28 , 2018 meetings ,] Motion made by Roland Bassett to approve the meeting minutes of February 14, 2018 as amended. Elizabeth Taylor seconded, VOTE : 6-0-0 Motion made by Diane Pansire to approve the meeting minutes of February 28 , 2018 as presented , William HIein seconded . VOTE : 54 -1 I 7 , Items that the chair could not reasonably anticipate , Motion made by Diane Pansire to approve the Housing Subcommittee minutes of March 16, 2018 as written . Barbara Burgo seconded . VOTE : 3 -0-0 Peggy Jablonski will be joining the CPC at the next meeting , There was a request for one of the CPC members to make the presentation on one of the warrant articles at town meeting because Paul Ruchinskas needs to recuse himself. CPC Meeting Minutes Of March 21, 2018 Page 4 of 5 t There was an update on the Bikeway project and Roland Bassett, as liaison will follow up with the Bikeway Committee . It was suggested to schedule the Bikeway Committee to come into the CPC at a future meeting to give an update . There will be a discussion on receiving updates from approved applicants on the next agenda. i 8 . Next meeting : Wednesday, March 28 , 2018 @ 4 : 45 p .m, at Town Hall . The next meeting is scheduled for Wednesday, March 28 , 2018 at 41445 pm . 9 . Executive Session in accordance with MGL Chapter 39 , Section 23B (6) to consider the purchase, taking, lease, or value of real property if such discussion may have a detrimental effect on the negotiating position of the governmental body. There is no reason to go into Executive Session at this meeting. Motion made by Roland Bassett to adjourn the meeting at 5 : 56 pm. William Klein seconded .
