HomeMy Public PortalAbout2005-004 Resolution Granting Approval of Varinace for 2874 Lakeshore AveMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-04 RESOLUTION GRANTING APPROVAL OF A VARIANCE FOR 2874 LAKESHORE AVENUE WHEREAS, Duane and Vicki Keskitalo have requested approval of a 7-foot variance from the 30-foot front -yard setback requirement for the 6,000 square foot property legally described as follows: Lot 5, Block 28 Independence Beach WHEREAS, the City Council finds that not granting the variance would deprive the applicants of rights enjoyed by other properties in the same district; and WHEREAS, the City Council finds that extraordinary circumstances do exist because the lot has two 30-foot setback requirements which represent a large portion of a small - size lot; and WHEREAS, the lot is a substandard lot due to size, and a porch was previously located on the lot; and WHEREAS, the proposed porch does not encroach any further than the existing deck and the City finds that the variance is the minimum action necessary to alleviate the hardship; and WHEREAS, the Planning Commission on December 14, 2004 reviewed the application for its conformance with the City's ordinances and heard comments from the applicant and other interested parties, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, Minnesota that a variance be granted to Duane and Vicki Keskitalo for the property described above, subject to the following terms and conditions: 1. The applicant must obtain a building permit prior to beginning construction. 2. The variance is only to permit the 4-season porch presented in the plans received by the City on October 27, 2004. 3. Per Section 825.47 of the Code, the variance is only valid for one year from the date of approval. Resolution No. 2005-04 January 18, 2005 Page 2 Dated: January 18, 2005 Bruce D.
