HomeMy Public PortalAbout2005-005 Resolution Granting Preliminary Plat Approval for Charles Cudd, N of Hwy55 N of Chippewa E of ArrowheadMember Brinkman introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-05 RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR CHARLES CUDD LLC. FOR PROPERTY GENERALLY LOCATED NORTH OF STATE HIGHWAY 55, NORTH OF CHIPPEWA ROAD AND EAST OF ARROWHEAD/HACKAMORE ROAD WHEREAS, Charles Cudd, LLC has requested approval of a preliminary plat to allow construction of 106 single-family homes on a 124-acre property which is legally described on Exhibit A attached hereto; and WHEREAS, the preliminary plat of the Subject Property was reviewed by the Planning Commission at its meeting on January 11, 2005 and, following a public hearing thereon as required by law, the Planning Commission recommended approval thereof, subject to certain terms and conditions; and WHEREAS, the City Council on February 1, 2005 and February 15, 2005, reviewed the preliminary plat for its conformance with the City's ordinances, considered the recommendations of the Planning Commission and heard comments from the Applicant and other interested parties; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, Minnesota that preliminary plat approval be granted to the Applicant for the Charles Cudd LLC preliminary plat, subject to the following terms and conditions: 1.A preliminary plat is approved to allow the creation of 106 single-family lots in accordance with the plans and application received by the City on December 23, 2004, except as amended by this resolution. 2.The development is subject to the PUD district standards; no other variances are granted or implied from the Zoning Ordinance Standards. 3.Prior to final plat application, the applicant must revise the plans to comply with the following conditions: a. The plans shall be revised according to the City Engineer comments per the attached memo dated January 3, 2005. b. The site plan must clearly identify the building setbacks. c. The building heights must be provided and identified on the elevations. d. The buildings must be sprinkled if over 30 feet in height. e. A plan must be submitted that shows how the applicant intends to vary home types. Resolution No. 2005-05 February 15, 2005 f. The applicant shall provide revised copies of the HOA documents/covenants for City review. The HOA documents must include 4-sided architecture, high -quality building materials and coordination of exterior colors. g. The HOA documents must also include accessory building/structure and fence restrictions. h. The HOA documents shall provide regulations for on -street parking including prohibition of outside parking of boats, RV's, etc.. i. The HOA documents must prohibit outside storage. j. The developer shall provide a list of builders with the PUD final plan. k. The developer shall submit garage details. 1. The developer shall revise the plans to include parking details. m. The applicant must submit signage details. n. Drainage and utility easements must be provided over all wetlands and ponds. o. The applicant must submit lighting details. p. The street names on the plans must be revised. q. The developer shall submit details on the trail design. r. The applicant must address safety concerns in relation to Arrowhead/Hackamore Road with City staff as well as consult with the City of Corcoran. s. The right-of-way along Arrowhead/Hackamore Road must be satisfactory to City staff or the applicant must return to the Planning Commission for further discussion. t. The developer shall agree with the Public Improvement Funding Commitment letter prepared by the City Administrator, dated January 27, 2005. 4. Prior to release of the final plat for filing, the applicant must comply with the following conditions: a. The applicant must obtain all necessary permits from Elm Creek Watershed District and the wetland LGU. b. The Hamel Fire Chief shall approve of the plat as submitted or the plat must be revised. c. The Fire Marshall shall approve of the plat as submitted or the plat must be revised. d. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plat and related documents. e. The developer must submit title evidence satisfactory to the City Attorney. 5. The application for final plat must be submitted to the City within 180 days of preliminary plat approval or the preliminary plat shall be considered void, unless a Resolution No. 2005-05 February 15, 2005 2 written request for time extension is submitted by the applicant and approved by the City Council. 6. Park dedication fees must be paid at $2,000 per unit, at time of building permit, for a total of $212,000. 7. The applicant shall provide to the City a digital copy of the legal description. 8.
