CITY COUNCIL
MINUTES
APRIL 16, 1985
INITIATION
1. CALL TO ORDER:
Mayor Swain called the regular meeting of the City Council to
order at 7 :35 p.m. on Tuesday, April 16, 1985 in the Council
Chamber of the City Hall.
2. The invocation was given by Reverend Norlyn Brough of the Church
of the Nazarene, 9953 Las Tunas Drive.
3. The Pledge of Allegiance to the Flag was led by Mayor Swain.
4. ROLL CALL:
Present: Councilmen Atkins, Dennis, Gillanders, Tyrell, Swain
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Associate Planner
Bowman, Parks & Recreation Director Kobett, Public Works
Coordinator Peterson and Julie Estrada of the Temple City

PROCLAMATIONS:
A. Mayor Swain presented a proclamation for Occupational Therapy Week,
April 15 - 19, 1935. Accepting on behalf of the San Gabriel Valley
Occupational Therapy Association of California was Sheri Sollee,
the association's public relations chairman. Mrs. Sollee is a
former Temple City resident and Temple City High graduate.
B. Mayor Swain presented a proclamation to the Quota Club of Temple City.
Accepting the proclamation for "Shatter Silence Month, which is the
month of May, was Quota Club president, Nona Desy. Mrs. Desy pre-
sented the Mayor with two sample balloons which will be released in
Washington, D.C. by President Reagan and in Southern California on
May 1, 1985.
5. REORGANIZATION OF COUNCIL:
A. At this time, the City Clerk assumed the Chair and opened
nominations for the office of Mayor for the coming year.
B. Councilman Tyrell nominated Councilman Dennis for the office
of Mayor, seconded by Councilman Atkins. Councilman Tyrell
moved that nominations be closed and a unanimous ballot be
cast for Councilman Dennis for the office of Mayor, seconded
by Councilman Atkins and carried.
C. Mayor Dennis assumed the Chair and thanked the Council for
their vote of confidence and the opportunity to serve as Mayor
for the coming year, particularly since this is the City's
25th.. anniversary.
Councilman Tyrell nominated Councilman Atkins for the office
of Mayor Pro Tempore. Councilman Tyrell moved that nomina-
tions be closed and a unanimous ballot be cast for Councilman
Atkins for the office of Mayor Pro Tempore, seconded by Coun-
cilman Swain and carried.
Councilman Atkins thanked the Council for the opportunity to
serve as Mayor Pro Tempore,
D. Appointments: Mayor Dennis made the following committee
appointments, following which it was moved by Councilman Tyrell,
seconded. by Councilman Swain and unanimously carried that the
appointments be confirmed.

Councilman Tyrell moved to adopt Resolution No. 85- 2346, a Resolution of
the City Council of the City of Temple City, appointing a member of said
Council of said City to the RTD City Selection Committee pursuant to
Part 3 of Division 10 of the Public Utilities Code; and Resolution No.
85 -2347, a Resolution of the City Council of the City of Temple City
appointing an alternate Director of County Sanitation District 15, secon-
ded by Councilman Atkins and unanimously carried.
PRESENTATION:
On behalf of the City Council and the citizens of Temple City, Mayor
Dennis presented a plaque to Councilman Swain in appreciation of the out-
standing service given as Mayor during her term.
Councilman Swain thanked all the-members of the Council for the support
given during her term as Mayor. City Manager Koski was thanked for his
guidance, time and support which made the job of Mayor easier; and Coun-
cilman Swain requested that her thanks be conveyed to the staff at City
Hall for their efficient work. Her appreciation also went to the citi-
zens of the community for making this City the kind .of place it is; and
her special thanks went to her husband, Bill, for the support which he
has given during this past Council year.
6. CONSENT CALENDAR:
Councilman Atkins requested that Item B be removed from the Consent
Calendar.
On motion by Councilman Gillanders, seconded by Councilman Swain,
all other items on the Consent Calendar were unanimously approved.
A. APPROVAL OF MINUTES - Regular Meeting of April 2, 1985
Approved as corrected.

D. CIVIL DEFENSE -GOALS AND OBJECTIVES REGARDING EMERGENCY RE-
SERVE AND OPERATIONS CENTER PROGRAMS
Council approved in principle the goals and objectives set
forth for the Temple City Emergency Reserve and Emergency Oper-
ations Center as contained in staff memo of April 10, 1985.
E. RECOMMENDATIONS FROM TRAFFIC COMMISSION MEETING - APRIL 3, 1985
(1) ANNUAL REVIEW OF PERMIT TO CROSS OVER PEDESTRIAN MALL
PUBLIC PARKING LOT NO. 5, PARKING DISTRICT NO. 3 -
A.W. DRIVER, 9611 LAS TUNAS DRIVE
Council approved renewal of agreement for crossing over
the pedestrian mall at the above location subject to the
usual conditions.
(2) PLACEMENT OF RED CURB - 5023 BALDWIN AVENUE
Council concurred with Traffic Commission's recommendation
to paint a red curb at 5023 Baldwin Avenue as a safety
precaution.
(3) ZONING ORDINANCE AMENDMENT REQUIRING LANDLORDS TO PROVIDE
OFF- STREET PARKING
Council requested the Planning Commission to review and
offer evaluation as to whether a zoning ordinance amend-
ment would be effective in requiring landlords to include
in the rental of any unit a minimum of one, covered, off-
street parking space; and, for any units constructed
since the first recodification of the Zoning Ordinance,
the minimum number of covered or enclosed spaces required
by the Zoning Ordinance.
F. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING - APRIL 9, 1985

PROPERTY NUISANCE CASE 85 -131 (9129 RANCHO REAL ROAD)
Council adopted Resolution No. 2351, a Resolution of the
City Council of the City of Temple City declaring certain
premises to be a public nuisance and ordering abatement
thereof. ",e
(2) APPROVAL OF PARCEL MAP 16966 AT 6329 SULTANA AVENUE,
OWNER /APPLICANT: RON OWEN
Council set public hearing for May 7, 1985 to consider re-
quest for parcel map at 6329 Sultana Avenue.
(3) PROPOSED AMENDMENT TO TEMPLE CITY MUNICIPAL CODE ADDING
REGULATIONS TO REQUIRE THE INSTALLATION OF AUTOMATIC FIRE
SPRINKLER SYSTEMS IN GARAGES WITH LIVING QUARTERS ABOVE
THEM
Council set public hearing for May 7, 1985 to consider pro-
posed amendment to the Temple City Municipal Code adding
regulations regarding fire sprinkler systems.
(4) CLARIFICATION OF AMBIGUITY: APARTMENTS IN R -2 ZONE
Council concurred with Planning Commission's clarification
and recommended that Commission proceed with the process
of amending the Zoning Code to reflect the clarification
of ambiguity with an appropriate change.
(5) PLANNING COMMISSION ACTION:
Received and filed memo from the Planning Commission re-
lating to action taken at their regular meeting of April 9,
1985.

G. ACCEPTANCE OF BID - INTALLATION OF LANDSCAPE PLANTING AND IRRI-
GATION SYSTEM FOR NEW CITY HALL
City Council accepted the low bid from Greenscapes in the sum
of $19,975 to install landscape planting and irrigation system
for the new City Hall.
H. RESOLUTION N0. 85 -2350: WARRANTS AND DEMANDS
Council adopted Resolution No. 85 -2350, a Resolution of the Cit
Council of the City of Temple City allowing claims and demands
in the sum of $65,991.72.
CONSENT CALENDAR B. APPLICATIONS FOR FIREWORKS STANDS - 1985
Councilman Atkins expressed concern about rumors that the City of Hope
fireworks booth was being run by others than members. As no representa-
tives from the City of Hope were present, Councilman Swain recommended
that Council continue consideration of this application for a fireworks
stand until May 7, 1985. City Manager Koski referred to Temple City
Municipal Code Section 3117 wherein is stated: "No person other than
the licensee organization....shall operate the stand for which the license
is issued....no person shall be paid consideration for selling or other-
wise participating in the sale of fireworks at such stand...."
Mr. Les Beauchamp, representative of the Lions Club, stated that members
of the Lions Club were concerned about problems they had run into with
the operator of the City of Hope fireworks booth.
Councilman Tyrell moved to approve applications for fireworks stands from
the Lions Club, Temple City DeMolay, American Legion., Temple City Y's
Men's Club, Temple City High Baseball, Y.M.C.A., Explorer Post #171,
Nazarene Youth, Kare Youth League; reject application from Temple City
Yudan Shakae as they do not hold a non - profit status as yet; and post-
pone decision to May 7, 1985 on City of Hope's application, seconded by
Councilman Gillanders and unanimously carried.
7. UNFINISHED BUSINESS:
A. ORDINANCE NO.. 85-560 (2nd reading) REQUEST FOR APPROVAL OF CHANGE
OF ZONE FROM R -1 TO R -3, 6002 CLOVERLY AVENUE, APPLICANT /OWNER:
ROBERT HEPLER
Councilman Tyrell moved to read by title only Ordinance No. 85 -560,
an Ordinance of the City Council of the City of Temple City approv-
ing a change of zone from R -1 to R -3 in Case No. 85 -746, seconded
by Councilman Atkins and unanimously carried.
Councilman Gillanders moved to adopt Ordinance No. 85 -560, secon-
ded by Councilman Atkins and carried on a.roll call vote.

B. TEMPLE CITY PARK IMPROVEMENTS
City Manager Koski advised the Council that the Parks & Recre-
ation Commission recommended approval of application for funding
under the State Grant Funds, the Roberti- Z'Berg Urban Open-
Space and Recreation Program on a 25% matching basis. The appl
cation would be filed for the proposed improvement of play app -
ratus at Temple City Park at its present location and construc-
tion of shade shelter and picnic table area in the park.

Councilman Gillanders moved to approve use of State Grant Funds
for Temple City Park improvements; authorize filing of appli-
cation; adopt Resolution No. 85 -2349; and authorize services
of an architect to design plans and specifications, seconded
by Councilman Atkins and unanimously carried.

9. COMMUNICATIONS:
A. APPEAL OF OPP DENIED BY TRAFFIC COMMISSION - LORI JANTZ, 4840
AGNES AVENUE
Councilman Gillanders moved to receive and file memo from Traffic
Commission, seconded by Councilman Swain and unanimously carried.
Mayor Dennis suggested that a letter be sent to Lori Jantz ad-
vising her that the Council concurred with Traffic Commission's
decision to deny over -night parking permit._
10. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK

RECESS TO CRA:
At this time, Council recessed to meet as the Community Redevelopment
Agency; approved the Minutes of the regular meeting of April 2, 1985;
approved the organizational structure of the City Council to be the same
for the Community Redevelopment Agency. The Minutes are set forth in
full in the records of the Agency.

12. MATTERS FROM CITY OFFICIALS:
A. PROCLAMATION - TEACHER APPRECIATION WEEK, MAY 5 - 11, 1985
Mayor Dennis approved a Proclamation for Teacher Appreciation
Week, indicating the Council's appreciation for the public
school teachers throughout the communities and recognizing the
service which they provide for us and the young people.
B. REQUEST FOR STUDY SESSION WITH CITY COUNCIL - PARKS & RECRE-
ATION COMMISSION
Council agreed on May 20, 1985 as a date o. meet in study session
with the Parks.& Recreation Commission.
C. SET PUBLIC HEARING - STREET IMPROVEMENTS- LOMA AVENUE, BETWEEN
BIDWELL & LAS TUNAS .(5752 - 5762 Loma Avenue) - Pursuant to
Chapter 27, Improvement Act of .1911, Streets.& Highways Code
:Council set public hearing for May 7, 1985, for street improve-
ments on Loma Avenue. •
D. OLD CARS WEEK, MAY 11 - 19, 1985
Councilman Atkins advised Council that recently the California
Legislature passed a Resolution declaring the week of May ,11 -
19, 1985 as Old Cars Week. Councilman Atkins recommended the
City support this State resolution by issuing a Proclamation
signed by the Mayor also declaring the week of May 11 - 19,
1985 as Old Cars Week in Temple City. Council concurred.

E 25TH ANNIVERSARY AND DEDICATION OF NEW CITY HALL
Councilman Swain advised Council that plans are going well for
the 25th Anniversary celebration activities and also the dedi-
cation of the new City Hall. All residents' in the community
are Welcome'to all the festivities planned. An invitation will
be printed in the local newspapers in order to apprise the
citizens of all the activities planned and that all are encour
aged to participate.
F LEGISLATION - SB 1091
Councilman Gillanders reported on his trip to Sacramento to
meet with Senator Newton Russell in order to solicit his sup-
port as a member of the Senate Local Government Committee for
passage of SB 1091. Councilman Gillanders clarified for those
in the audience that the property tax they pay to the County
is being used in_part to benefit other cities. Temple City is a no
property tax city and, since the passage —of Proposition -13,'
has been ineligible to receive any of these funds. Passage of
SB 1091 would entitle Temple City to receive approximately
$600,000 additional revenue annually from the property taxes
presently paid by residents.'' Should this bill not pass, liti-
gation is being contemplated for the retrieval of these funds.
G. STREET LIGHTS
Councilman Tyrell passed on a complaint he had received regard-
ing the street lighting in the 6000 block of Cloverly Avenue.
Residents did not feel the lights in their area is sufficient.
City Manager stated that the voltage to lights will be measured
by staff.
H. TRAFFIC SIGNAL - WOODRUFF AND TEMPLE CITY BOULEVARD
Mayor Dennis advised Council of an expression of thanks from
a Temple City senior citizen and his wife for the City instal-
ling the traffic signal at Woodruff and Temple City Boulevard.
Councilman Swain stated that she had received many words of
appreciation for the street lights at a Senior Citizens meet-
ing she had attended.
13. ADJOURNMENT:
On motion by Councilman Swain, seconded by Councilman Gillanders,
the meeting adjourned at 8:30 p.m. The next regular meeting of the
City Council will be held on Tuesday, May 7, 1985, in the Council
Chamber of the City Hall.
