HomeMy Public PortalAboutSPRC Minutes 1995-09-13 ISite Plan Review Committee 9/13/95 Minutes 11 SITE PLAN REVIEW COMMITTEE 9/13/95 MINUTES PRESENT: PAUL HALKIOTIS; JON EITELBACH; STEVE EDWARDS; MACFARLANE; BOB CANNING; DICK GOULD; MARK VINCENT SANDY ABSENT:CHUCK MEDCHILL FORMAL REVIEW. Location: 43 Rte 28. Applicant: Helen Addison. Description: Use some office space as gallery space for a fine art gallery. The informal review was held on 8/9/95. Also present: Helen Addison, applicant; Attorney Duane Landreth; Will Joy; Herb Holmes. The Committee reviewed a letter addressed to the Chairman, Paul Halkiotis, from Attorney Landreth, dated 9/12/95. The letter outlined the project and requested walvers from certain requirements of CH 164-33. Paul said that the issue lS the decision of Building Commissioner that this proposed use of an art gallery could be called a place of assembly, and this triggers other lssuess related to parking, septic and handicapped access. Duane Landreth used graphics to illustrate both the existing and proposed use of the building. He said a special permit may be required because of current parking regulations, and because the proposed use is retail and it is in the shoreline district. He explained the difference between a retail art gallery and a place of pubic assembly. Herb Holmes described the proposed changes as well. He also noted that under current parking requirements, the existing use would require 16 spaces and the proposed use would require 15 spaces. Currently, 12 spaces are provided. Helen Addison described some of the art work and artists that she will be working with. Paul asked how often openings will be held, and how many people would be expected to attend those openings. Duane Landreth referred to the state Building code definition of an A-3 structure, which includes art galleries. Jon said that the use will be determined to be a retail space or a ISite Plan Review Committee 9/13/95 Minutes 21 place of assembly depending on how the room is set up. The number of showings and how many people will be in the room are also to be considered when determining if the structure is A3 or not. Helen said this will be a gallery to sell art. She does not want to have a lot of people in the gallery at one time. She does not want to describe how she will set it up yet because she does not know. She wants to sell the art on a one-on-one basis. Duane Landreth referred to several letters from various businesses submitted by the applicant supporting the project and offering use of their parking spaces. Sandy Macfarlane said that the committee has no plans showing what is there now. She asked if there were any plans that show some of the things that the applicant is seeking waivers from. Duane Landreth said there is no inventory plan. The cost to the applicant to provide an inventory plan would be considerable. Discussion occurred regarding how many people may be at an opening. Will Joy noted that, if this is determined to be an assembly use, the space can be posted to not exceed 50 persons. Jon said it can't be posted; occupancy is set by the number of people who can fit in that room according to the state code; occupancy lS determined by square footage. Comments from committee members: Jon noted that 164-34 C (1) would prohibit usage of parking areas located across Rte 28 (with a 60-foot layout) . Jon asked about handicapped access. He informed the applicant the Federal Government will require handicapped access. Jon said that they can't grant the waivers unconditionally. He has to determine if this will be called a place of assembly or not. Herb Holmes they have lights on all the doors and in the parking lot. The walk is also lit, and there is a cross walk directly across from the Bank of Boston. ISite Plan Review Committee 9/13/95 Minutes 31 Bob Canning asked about the Title V inspection, and was informed that it was done. There is still Board of Health business that needs to be completed. Bob wants clarification that there lS an easement In place for parking spaces #11 + #12. Dick Gould needs to know what the determined use would be. Without a site plan showing what is there, he will take Duane Landreth's word for what is referred to in his letter as "unchanged." Discussion occurred regarding the way the state building code defines retail use and art gallery. Paul, no formal site plan has been submitted. give blanket waivers. He lS reluctant to Paul said he would like to continue the Formal Review to allow time for Jon to review additional information that has come in, and for Bob to review Health Department issues. MOTION: Bob Canning moved to continue this hearing until 10:30 AM on September 27, 1995. VOTE: 6-0-0, unanimous. The applicants were informed that they can appeal Jon's decision that a Formal Review is required. SECOND INFORMAL REVIEW. Location: 12 West Road. Applicant: David Southern. The first informal review was held on 7/12/95. Dave Southern explained the information he was presenting as a result of the 7/12/95 informal review. A letter from Ryder and Wilcox, addressed to Pat Ballo, Assistant Health Agent, dated 7/31/95, estimated the sewage flow for the site. This addressed the Health Department's concerns. The revised plan showed the number of parking spaces that will be provided. Emergency lighting and exit slgns will be installed. To clarify parking, numbers depicting parking spaces will be shown on the retaining wall. Jon suggested that the handicapped space be moved back to a flatter ISite Plan Review Committee 9/13/95 Minutes 41 area. The underground storage tank will be removed. Paul said that if the handicapped parking space lS relocated, it will need to be shown on a revised plan. Paul read a memo addressed to him from Chuck Medchill, Water Superintendent, dated 9/13/95, noting that he had verified the location of the water line, and that, for the purposes of Site Plan Review, the Water Department's concerns have been met. Paul recommend that the Building Commissioner waive the Formal Review, and, that a revised plan be submitted by the applicant. MOTION: Steve Edwards moved that the committee accept the information as submitted, providing a revised plan showing handicapped parking is reviewed and accepted by Jon Ei telbach, and that the revised plan be submitted within 2 weeks. VOTE:5-0-1, Bob Canning abstained Adjournment
