RESOLUTION NO.2005-12
DENYING COMPREHENSIVE PLAN AMENDMENT FOR LYNMORE LLC ON
PROPERTY LOCATED AT 500 HAMEL ROAD
WHEREAS, Lynmore LLC has requested approval of a comprehensive plan amendment
from Urban Commercial to Multi Family Residential on an 8.64-acre property legally
described as follows:
Lot 5, Auditor's Subdivision No. 241, Hennepin County, Minnesota, except
as follows:
(1>
The South 209.00 feet of the West 209.00 feet of that part of Lot 5
lying Easterly of a line drawn at a right angle to the South line of said
Lot 5 as measured along said South Line.
(2) Beginning at the Northeast corner of said Lot 5; thence South along
the East line of said Lot 5 to a point of intersection with a line which
is parallel with and 30.00 feet distant Southerly (measured at right
angles) from the North line of said Lot 5; thence Westerly along said
last mentioned parallel line a distance of 588.00 feet; thence
Northerly at right angles a distance of 30.00 feet to the North line e of
said Lot 5; thence Easterly along the north line of said Lot 5; thence
easterly along the North line of said Lot 5 to the place of beginning.
WHEREAS, the Planning Commission has reviewed the request at a duly called public
hearing on February 8, 2005, and the Planning Commission recommended approval
thereof, subject to certain terms and conditions, and
WHEREAS, the City Council on March 1 and March 15, 2005 reviewed the application
for conformance with the City's Comprehensive Plan and ordinances, considered the
record before and recommendations of the Planning Commission and received written
and oral testimony from the applicant, and city staff and other interested parties,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does deny the
request by Lynmore LLC for the comprehensive plan amendment based upon the
following findings:

1. Following a lengthy planning process, the City of Medina adopted the
Comprehensive Plan in 2001 and guided the property as Urban Commercial as
part of a plan to maintain a commercial corridor along State Highway 55.
2. The City has seen a demand for commercial and industrial development along
State Highway 55 and there is a limited amount of property under the commercial
designation within the City.
3. The Comprehensive Plan encourages development that utilizes existing
infrastructure and expands the City's current revenue base in the commercial
corridor along State Highway 55.
4. The Comprehensive Plan ensures that adequate buffers are created between
commercial and residential zoning districts utilizing buffers such as increased
setbacks, parks and open space. Introduction of a residential use on the property
would have a negative impact on adjacent commercial properties.
5. The Comprehensive Plan discourages closed off or disconnected multi -family
developments.
6. The use of the property for commercial purposes continues to be consistent with
the City's vision for the property and nearby land.
7. The City is required by law to update its Comprehensive Plan at least every 10
years, during which process land use designations are re-examined. If not
developed in the interim, the City will use that opportunity to review the land use
designation of the property to determine whether the property at that time remains
better suited for commercial or some other land use.

The motion for the adoption of the foregoing resolution was duly seconded by member
Cavanaugh upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh
And the following voted against same: (Absent: Brinkman, Smith)
None
Whereupon said resolution was declared duly passed and adopted.
