CITY OF MEDINA
RESOLUTION NO.2005-13
DENYING REZONING FOR LYNMORE LLC ON PROPERTY LOCATED AT
500 HAMEL ROAD
WHEREAS, Lynmore LLC has requested approval of a rezoning from Urban
Commercial to Planned Unit Development on an 8.64-acre property legally described as
follows:
Lot 5, Auditor's Subdivision No. 241, Hennepin County, Minnesota, except
as follows:
(1)
The South 209.00feet of the West 209.00 feet of that part of Lot 5
lying Easterly of a line drawn at a right angle to the South line of said
Lot 5 as measured along said South Line.
(2) Beginning at the Northeast corner of said Lot 5; thence South along
the East line of said Lot 5 to a point of intersection with a line which
is parallel with and 30.00 feet distant Southerly (measured at right
angles) from the North line of said Lot 5; thence Westerly along said
last mentioned parallel line a distance of 588.00 feet; thence
Northerly at right angles a distance of 30.00 feet to the North line e of
said Lot 5; thence Easterly along the north line of said Lot 5; thence
easterly along the North line of said Lot 5 to the place of beginning.
WHEREAS, the applicant has made a request to allow the rezoning to planned unit
development to allow a 23-unit residential townhome development, and
WHEREAS, the Planning Commission has reviewed the request at a duly called public
hearing on February 8, 2005, and the Planning Commission recommended approval
thereof, subject to certain terms and conditions, and
WHEREAS, the City Council on March 1 and March 15, 2005 reviewed the application
for conformance with the City's Comprehensive Plan and ordinances, considered the
record before and recommendations of the Planning Commission and received written
and oral testimony from the applicant, and city staff and other interested parties,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does deny the
request by Lynmore LLC for the rezoning based upon the following findings:
1. The City's Comprehensive Plan guides the property as Urban Commercial.
2. The requested Comprehensive Plan amendment was denied.

3. The rezoning to a residential planned unit development would be inconsistent
with the land use designation within the City's comprehensive plan.
4. The requested rezoning is inconsistent with the City's plans to maximize
commercial development along the State Highway 55 corridor.
5. The requested rezoning would not provide an adequate transition or buffer from
the surrounding commercial uses.
6. The requested rezoning would render the adjacent commercial property
unbuildable due to the required setbacks adjacent to residential uses.

The motion for the adoption of the foregoing resolution was duly seconded by member
Cavanaugh upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh
And the following voted against same: (Absent: Brinkman, Smith)
None
Whereupon said resolution was declared duly passed and adopted.
