CITY OF MEDINA
RESOLUTION NO.2005-14
DENYING PLANNED UNIT DEVELOPMENT GENERAL PLAN FOR
LYNMORE LLC ON PROPERTY LOCATED AT 500 HAMEL ROAD
WHEREAS, Lynmore LLC has requested approval of a planned unit development
general plan to allow a 23-unit residential townhome development on an 8.64-acre
property legally described as follows:
Lot 5, Auditor's Subdivision No. 241, Hennepin County, Minnesota, except
as follows:
(1)
The South 209.00 feet of the West 209.00 feet of that part of Lot 5
lying Easterly of a line drawn at a right angle to the South line of said
Lot 5 as measured along said South Line.
(2) Beginning at the Northeast corner of said Lot 5; thence South along
the East line of said Lot 5 to a point of intersection with a line which
is parallel with and 30.00 feet distant Southerly (measured at right
angles) from the North line of said Lot 5; thence Westerly along said
last mentioned parallel line a distance of 588.00 feet; thence
Northerly at right angles a distance of 30.00 feet to the North line e of
said Lot 5; thence Easterly along the north line of said Lot 5; thence
easterly along the North line of said Lot 5 to the place of beginning.
WHEREAS, the applicant has made a request to allow flexibility in design via a planned
unit development (PUD) for a 23-unit residential townhome development, and
WHEREAS, the Planning Commission has reviewed the request at a duly called public
hearing on February 8, 2005, and the Planning Commission recommended approval
thereof, subject to certain terms and conditions, and
WHEREAS, the City Council on March 1 and March 15, 2005 reviewed the application
for conformance with the City's Comprehensive Plan and ordinances, considered the
record before and recommendations of the Planning Commission and received written
and oral testimony from the applicant, and city staff and other interested parties,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does deny the
request by Lynmore LLC for approval for the planned unit development general plan
based upon the following findings:
1. The City's Comprehensive Plan guides the property as Urban Commercial.

2. The City's zoning ordinance classifies the property as Urban Commercial.
3. The requested land use plan amendment and rezoning were denied.
4. The proposed PUD general plan is not in compliance with the City's PUD
standards.
5. The proposed PUD does not meet the city standards, which require a higher level
of design than what might normally be expected as it is not a more sensitive
development, which preserves natural topography and prevents soil erosion, and
is not a more creative and efficient use of the land.

The motion for the adoption of the foregoing resolution was duly seconded by member
Cavanaugh upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh
And the following voted against same: (Absent: Brinkman, Smith)
None
Whereupon said resolution was declared duly passed and adopted.
