Minutes of June 12 , 2018
MOTION by Arthur Stewart to accept the Minutes of June 12 , 2018 as distributed . Second by Bruce
MacGregor. VOTE 4- 0 -0
New Application :
18 -05 Andrew and Dana Gilbert at 29 Cranview Road ( Map 10 Lot 57) , (and located in the RR zoning
district , seek a Special Permit under MGL 40A , section 6 and Brewster Zoning Bylaw 179- 179 , Table
2 , note 13 to Transfer a previously approved Special Permit to a new owner.
Members hearing this application are ; Bruce MacGregor , Arthur Stewart , John Nixon , William Hoag
and Brian Harrison .
Mrs . Gilbert gave a brief overview of this application ;
• They purchased this property in 2017
• Plans to renovate are underway to make this a fulltime residence for their large , extended
Family .
• After applying for a building permit it was noted that the previously permitted In - Law
apartment permit must be transferred to the new owners ( Gilberts) through ZBA process .
• Use will remain basically the same , accommodating family elders and younger members of
the family .
• No rentals , long term use .

• Septic system had been deemed within # of bedrooms total ,
• This unit is not visible from the street and set away from the home .
• Proper access and egress have been met .
DISCUSSION OF THE Board .
• Previous permit ( 06-32 ) Conditions should still be in effect (with the exception of #2 ) ;
1 ) The petitioner wishes to renovate the second floor of an attached garage to allow for an
accessory apartment of 598 square feet .
2 ) The apartment is to be used by a health care assistant to assist Mrs . Schilke as her health
requires .
3 ) The apartment is in compliance with the terms of the By- Law .
4) In conformance with the terms of the By- Law the petitioner will allow use by a health care
provider or other allowed occupant only .

18 -06 Malcolm + Mary Rancourt, property owner at 87 Long Pond Road , ( represented by Attorney
Benjamin Zehnder) , Map 56 Lot 17 , in the RM zoning district . The applicant seeks a Variance under
MGL 40A and Brewster Zoning Bylaw 179 . 6 (C) ( 1 ) residential structures prohibited in Wetlands
Conservancy District) to construct a single family residential dwelling .
Members hearing this application are ; Bruce MacGregor , Arthur Stewart , Jeanne Kampas , John
Nixon , and William Hoag .
Attorney Benjamin Zehnder represented the applicant .
Mr . and Mrs . Rancourt were present at the hearing .
Attorney Zehnder gave an overview for the Board ;
• Modular home has been designed
• When the applicant applied for a building permit it was flagged within Conservancy soil area .
• Protected wetlands , isolated area
• Variance criteria ; hardship - " housing in place " held up , lot can ' t be developed , taxed as
buildable .
• Property held in common ownership

• Other buildings built on in this area
• Generally ask for test holes at points of foundation within Conservancy soils . Plan
shows test borings
• 4 test holes were done , 3 test holes identify the soil components
