RESOLUTION NO. 18-9453
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE
CITY MANAGER TO SETTLE, SATISFY AND EXECUTE
LIEN RELEASES IN MITIGATION OF CODE
ENFORCEMENT LIENS ON PROPERTY LOCATED AT
2161 WILMINGTON STREET, OPA-LOCKA, FLORIDA IN
THE AMOUNT OF $15,327.21; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, a request to mitigate, satisfy and settle liens, recorded against property
located at 2161 Wilmington Street, Opa-locka, Florida, folio#: 08-2122-005-1070 ("the
property"), was made by Herman Fluitt/Eliose Fluitt, the property owner, to the City of
Opa-Locka ("City"); and
WHEREAS, the property was found to be in full compliance on August 21,
2017 as evidenced by the Compliance Affidavit attached hereto as Exhibit A;and
WHEREAS, the amount of said liens against the property is $20,436.29; and
WHEREAS, the City Manager reviewed the file and recommends a settlement in
the amount of$15,327.21 which is a 25%reduction;and
WHEREAS, the purpose of Code Enforcement is not to gain revenue from
enforcing fines and liens but to achieve compliance and revitalize the City; and
WHEREAS, the City Commission believes it is in the best interest of the residents
and citizens of the City of Opa-locka to accept $15,327.21 to settle and satisfy said liens
and execute lien releases.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF OPA LOCKA, FLORIDA:
Section 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
Section 2. AUTHORIZATION
The City Commission hereby authorizes the City Manager to accept $15,327.21, to
settle and satisfy Code Enforcement liens,payable in full within thirty (30) days, and
upon receipt of the funds, to cause releases of liens to be executed and recorded
therefore.

SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re-lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected copy of same with the City Clerk.
Section 4. EFFECTIVE DATE.
This Resolution shall take effect immediately upon adoption and is subject to the
approval of the Governor or his designee.

Staff Summary:
Due to the change of ownership,the property has increasingly improved. Prior to the change of
ownership,the property was always in violation of unsightly condition. It is in the best interest of the
City to seek Commission authorization to accept the proposed 75%settlement.
FProposed Action: Staff recommend approval for this resolution.
