HomeMy Public PortalAbout2005-019 Resolution Vacating Flowage Easement Todd & Michelle KingMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-19 RESOLUTION VACATING FLOWAGE EASEMENT WHEREAS, Todd H. King and Michelle W. King (the "Owners") are the fee owners of property located in Medina and legally described as Lot 6, Block 2, Wild Meadows Fourth Addition (the "Property"); and WHEREAS, the Owners previously granted a flowage easement to the city of Medina (the "City") over a portion of the Property (the "Previous Easement"); and WHEREAS, the Previous Easement was recorded on March 1, 2004, in the office of the Hennepin County Recorder as document no. 8302222; and WHEREAS, due to changes in the Owners' plans for the Property, it is necessary for the Owners to grant the City a new flowage easement over the Property; and WHEREAS, it is necessary for the City to vacate the Previous Easement, which shall be replaced by the new easement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Medina, Minnesota, that the Previous Easement is hereby vacated, subject to the following terms and conditions: 1. Vacation of the Previous Easement is subject to receipt by the City of a replacement easement satisfactory to the City; and 2. The City staff is hereby authorized and directed to record the replacement easement and to file the notice of vacation of the Previous Easement with the Hennepin County Recorder and Auditor.
