HomeMy Public PortalAbout044-1998 - Rezoning - Salisbury Rd along SR 38ORDINANCE NO. 44-1998 A SPECIAL ORDINANCE AMENDING ZONING MAP FOR THE PROPERTY LOCATED WEST OF AND ALONG SALISBURY ROAD IN THE NE1/4 SECTION 3-TOWNSHIP 16-RANGE 14 CENTER TOWNSHIP; AND THE PROPERTY LOCATED SOUTH OF AND ALONG STATE ROAD 38 IN THE SE ¼ SECTION 34-TOWNSHIP 17-RANGE 14 WEBSTER TOWNSHIP WHEREAS, the zoning map designates and describes as A-1 Agricultural District the property located west of Salisbury Road, south of State road 38, and north of Noland’s Fork Road; and WHEREAS, it is desirable to change the zoning designation to C-4 Special Use for a mobile home park; NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation of the property described below, and the same is hereby changed to C-4 Special Use District for a Mobile Home Park. Seventy-six and sixty-seven hundredths (76.67) acres off of the east side of the Northeast Quarter of Section 3, Township 16 North, Range 14 East, except seven (7) acres off the west side of the above described tract, leaving sixty-nine and sixty-seven hundreths (69.67) acres. Also, being a part of the Southeast Quarter of Section 34, Township 17, Range 14 East, and bounded as follows, to wit: Beginning at a marked stone in the South line of said Section and one hundred (100) rods and seven (7) links west of the Southeast corner of said Section; thence North one hundred nine (109) rods and twenty-three (23) links to a marked stone standing one and eighteen hundreths (1.18) rods South of true place; thence East forty-two and six tenths (42.6) rods to a stone at the bond of the Richmond and Williamsburg Turnpike Road; thence South one hundred nine (109) rods and twenty-three (23) links to the South line of said Section; thence West forty-two and six tenths (42.6) rods to the place of beginning, containing twenty-nine (29) acres and forty-two (42) rods. Excepting therefrom a tract conveyed by deed recorded in Deed Record 176, Page 15 and more particularly described as follows, to wit: That part of the Southeast Quarter of Section 34, Township 17, Range 14 East, being more particularly described as follows: Beginning at a point fifty and one-half (501/2 rods south and eighty-seven and sixteen Hundredths (87.16) rods east of the northwest corner of said Quarter Section, thence East sixteen (16) rods to a stone corner at the former junction of Washington and Williamsburg Turnpikes; thence South forty-four (44) degrees, forty-eight (48) minutes East eighteen and three-tenths (18.3)feet; thence South eight (8) feet, more or less, to the center of State Road #38; thence Northwestwardly along said center line by curve to the left having a radius of nine hundred fifty-five and thirty-seven hundredths (955.37) feet, one hundred fifty-five and eight-tenths (155.8) feet; thence North seventy-four (74) degrees and one (1) minute West one hundred thirty-seven and two-tenths (137.2) to the place of beginning, containing twenty-seven hundredth (0.27) of an acre, and leaving twenty-eight and ninety-nine (28.99) acres, and containing in all ninety-eight and sixty-six hundredths (98.66) acres, more or less.
