HomeMy Public PortalAbout2005-024 Resolution Approving Preliminary Plat for Ryan Co for Medina Retail Hwy 55 & Hwy 101Member Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-24 RESOLUTION APPROVING PRELIMINARY PLAT FOR RYAN COMPANIES US, INC FOR "MEDINA RETAIL" ON PROPERTY GENERALLY LOCATED NORTHWEST OF STATE HIGHWAY 55 AND COUNTY STATE AID HIGHWAY 101 WHEREAS, Ryan Companies US, Inc, has requested approval of a preliminary plat to allow construction of a commercial development on the 42.85-acre property which is legally described on Exhibit A attached hereto; and WHEREAS, the preliminary plat was reviewed by the Planning Commission at its meetings on November 9, 2004 and February 8, 2005 and following a public hearing thereon as required by law, the Planning Commission recommended denial thereof; and WHEREAS, the City Council on April 5 and April 19, 2005, reviewed the preliminary plat for its conformance with the City's ordinances, considered the recommendations of the Planning Commission and heard comments from the Applicant and other interested parties. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve the request by Ryan Companies US, INC, for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of a commercial development, in accordance with the plans and application received by the City on January 5, 2005, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the rezoning from UC to PUD and PUD general plan. 3. Development standards shall be as approved as part of the PUD. 4. The development shall be subject to all conditions of the PUD general plan approval. 5. The application is subject to the review and approval by the Elm Creek Watershed District. The applicant shall comply with any conditions of approval from the watershed. 1 6. The application is subject to the review and approval by Hennepin County. The applicant shall comply with any conditions of approval from the County. 7. The application is subject to the review and approval by MnDOT. The applicant shall comply with any conditions of approval from MnDOT. 8. The applicant shall pay all fees, on a lot -by -lot basis, prior to issuance of building permits. This shall include park dedication and water and sewer fees. All fees shall be paid according to the fee structure in place at the time of building permit issuance. Park dedication for outlots must be paid at the time of the first building permit payment. Sidewalks and Trails 9. Sidewalks and trails shall be as shown on the plans, except as otherwise noted. 10. The applicant must work with city staff to determine the location of the trail on the eastern end of Clydesdale Trail. 11. The applicant shall provide public benches and trash enclosures within these trail easements consistent with project architecture and design. Miscellaneous 12. The establishment of a storm water taxing district shall be approved prior to approval of the final plat and PUD final plan. 13. The OEA documents shall be submitted to the City for review and approval. These documents shall ensure to the satisfaction of the City that the ponds are privately maintained. 14. The plans shall be revised according to the City Engineer comments dated January 18, 2005. 15. The plans shall be revised per the comments of the Fire Marshall provided in the meeting minutes dated March 8, 2005. 16. The final plat shall be submitted within 180 days of the preliminary plat approval. 17. The applicant must submit title evidence satisfactory to the City Attorney prior to submission of the final plat. 18. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plat and related documents. 2 Dated: May 3, 2005 Bruce D.
