CITY OF TEMPLE CITY
CITY COUNCIL
MINUTES
MAY 21, 1985
INITIATION:
1. CALL TO ORDER:
Mayor Dennis called the regular meeting of the City Council to order at 7:30 p.m.
on Tuesday, May 21, 1985 in the Council Chamber of the City Hall.
2. The invocation was given by Father Kevin of St. Luke's Catholic Church, 9451
Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Dennis.
4. ROLL CALL:
Present: Councilmen- Atkins, Gillanders, Swain, Tyrell, Dennis
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Planning Director Shaw,
Parks and Recreation Director Kobett, Public Works Coordinator
Peterson and Julie Estrada of the Temple City Times.
Tom Desy, President, Temple City Chamber of Commerce, presented each member of the City
Council with an addressed letter envelope with the 25th Anniversary commemorative seal
and special Temple City Post Office May 18, 1985 cancellation as a token of appreciation
for their efforts in behalf of the City.
5. CONSENT CALENDAR:
On motion by Councilman Atkins, seconded by Councilman Swain, Items A through H
on the Consent Calendar were approved as recommended.
A. APPROVAL OF MINUTES - Regular Meeting of May 7, 1985
Approved as written.
B. AGREEMENT FOR COMMUNITY RECREATION PROGRAM WITH EL MONTE ELEMENTARY SCHOOL
DISTRICT
Council approved and authorized Mayor and City Clerk to sign renewed Community
Recreation Agreement between the City and the El Monte Elementary School Dis-
trict in which provides that the City will conduct a supervised recreation
program on the grounds of Cleminson School; that the District will make avail-
able facilities without charge; and that the City shall be responsible to pay
all charges it should incur with respect to operation of such a community
recreation program.
C. AGREEMENT FOR COMMUNITY RECREATION PROGRAM WITH TEMPLE CITY UNIFIED SCHOOL
DISTRICT
Council approved and authorized Mayor and City Clerk to sign renewed Community
Recreation Agreement between the City and the Temple City Unified School Dis-
trict in which provides that the City will conduct a supervised recreation
program at Emperor School and swimming at Temple City High; that the District
will make available facilities without charge; and that the City shall be
responsible to pay all charges it should incur with respect to the operation
of such a community recreation program.
D. LOMA- BIDWELL RESURFACING PROJECT
Council approved calendar of events; approved specifications; and authorized
solicitation of bids to open June 14, 1985 for the project.
E. STREET LIGHT CONVERSION - PHASE V
Council approved calendar of events; approved specifications; and authorized
solicitation of bids to open June 12, 1985 on the project.

F. PLANNING COMMISSION ACTION - MEETING OF MAY 14, 1985
Council received and filed memo from Planning Commission relating to action
taken at their regular meeting of May 14, 1985.
G. RESOLUTION NO. 85 -2358: INTENTION TO LEVY 1985 -86 ASSESSMENTS FOR CITY -WIDE
LIGHTING DISTRICT
Council accepted Engineer's Report; adopted Resolution No. 85 -2358; and set
public hearing for June 4, 1985.
H. RESOLUTION NO. 85 -2359: WARRANTS AND DEMANDS
Council adopted Resolution No. 85 -2359, a Resolution of the City of Temple
City allowing claims and demands in the amount of $216,256.82.

UNFINISHED BUSINESS:
A. ORDINANCE NO. 85 -561 (2nd reading) AMENDMENT TO THE TEMPLE CITY MUNICIPAL
CODE ADDING REGULATIONS TO REQUIRE THE INSTALLATION OF AUTOMATIC FIRE SPRINK-
LER SYSTEMS IN GARAGES WITH LIVING QUARTERS ABOVE THEM
City Manager Koski advised Council of a clerical change in Section 3802(h) of
Ordinance No. 85 -561 as it relates to the definition of multiple family
units.
Councilman Atkins moved to approve the ''clerical change in Section 3802(h) of
Ordinance No. 85 -561, seconded by Councilman Gillanders and unanimously
carried.
Councilman Tyrell moved to waive further reading and,adopt Ordinance No. 85-
561, an Ordinance of the City Council of the City of Temple City adding Sec-
tion 7109 of the Temple City Municipal Code amending section of the Los Angeles

County Building Code as it pertains to automatic fire sprinklers in garages,
seconded by Councilman Atkins and unanimously carried.
B. APPROVAL OF FINAL TRACT MAP 36735 LOCATED AT THE WESTERLY EXTENSION OF KEY
WEST STREET, SOUTH AND WEST OF LA ROSA DRIVE AND EAST OF ARDEN DRIVE /APPLICANT:
GEORGE WEIGAND FOR FAIRHAVEN DEVELOPMENT COMPANY
City Manager Koski stated that a Tentative Tract Map had previously been
approved for the westerly extension_ of_Key.West Street,', south and west of
La Rosa Drive and east of .Arden Drive. and the Final Map represents the third
phase of the overall. "Seaman School" single family subdivision.
Councilman Tyrell moved to accept the recommendations of the County Engineer's
Report approving the Final Tract Map; accepted easements; approved and accep-
ted work agreements and. securities; found project will not violate any of the
provisions of the Subdivision Map Act; instructed City Clerk to endorse on
the face of the Map acceptance of any dedications thereon; and accepted all
findings as outlined in staff memo dated May 15, 1985, seconded by Councilman
Atkins and unanimously carried.
7. NEW BUSINESS:
A PUBLIC HEARING: 7:30 P.M. - PROPOSED INTERIM AMENDMENT TO THE TEMPLE CITY
MUNICIPAL CODE ADDING REGULATIONS PERTAINING TO THE INSTALLATION OF SATELLIT
RECEIVING DISHES
City Manager Koski provided background information, stating that the Plannin
Commission on April 23, 1985, approved and recommended City Council approve
an interim amendment to the Temple City Zoning Code adding regulations per-
taining to the location, screening and appearance of satellite receiving
dishes. Commission recommends Council approve an interim ordinance to be
followed by a permanent ordinance once the model ordinance prepared by SPACE
(an organization representing the satellite dish antenna industry) has been
considered.
Mayor Dennis declared the public hearing open and invited anyone wishing to
speak to come forward.
There being no one wishing to address Council, Councilman Tyrell moved to close
the public hearing, seconded by Councilman Atkins and unanimously carried.

Councilman Atkins moved to certify Negative Declaration of Environmental
Impact, seconded by Councilman Gillanders and unanimously carried.
City Attorney Martin introduced Ordinance No. 85 -562, an Ordinance of the
City Council of the City of Temple City adding new sections 9333(8), 9352(9),
9362(7), 9373(C)(1), 9381(E), 9391(F), 9411(E), 9421 (B)(7) and 9152 relat-
ing to the appropriate zoning regulations for dish antennae for first read-
ing by title only.
Councilman Tyrell moved to waive further reading, seconded by Councilman
Atkins and unanimously carried.
B. PUBLIC HEARING: 7:30 P.M. - ASSESSMENTS FOR STREET IMPROVEMENTS - GREEN
STREET, GOLDEN WEST AVENUE, LEMON AVENUE, CURB & GUTTER PROJECT 84/85 -1 -
GABI .CONSTRUCTION CO., INC.
City Manager Koski reported that at the City Council's regular meeting of
November 6, 1984, Council ordered the Superintendent of Streets to cause the
work to be accomplished for new curbs and gutters on portions of Green Street,
Lemon Avenue and Golden West Avenue where they did not currently exist. Con-
struction is now complete and field- checked by City and County staff and
found to be constructed as specified. The City shares the cost of curbs and
gutters with the owners on a 50 -50 basis and picks up all cost for engineer-
ing design and inspection. It was pointed out that there is a change in
assessment for property owner O'Donnell at 9618 and 9624 Lemon Avenue. It
was assumed that the property owner paid the contractor directly; however, it
was later determined that this was not the case. Therefore, the driveway cost
should be changed from $396.40 to $798.03 and total assessment from $684.40
to $1,086.03 for 9618 Lemon; and driveway cost changed from $926.64 to
$1,328.26 and total assessment from $1,214.64 to $1,616.26 for 9624 Lemon
Avenue. The property owner is aware of the changes in assessments.
Mayor Dennis declared the public hearing open and invited anyone wishing to
speak to come forward.
There being no one wishing to address Council, Councilman Tyrell moved to
close the public hearing, seconded by Councilman Swain and unanimously carried.
Councilman Atkins moved to approve assessments as noted in the Superintendent
of Streets'Report of Completion of Construction and Costs of Construction with
noted change for property owner O'Donnell and instruct Superintendent of
Streets to notify property owners of assessments, seconded by Councilman Swain_
and unanimously carried.'
C. PUBLIC HEARING: 7:30 P.M. - ASSESSMENTS FOR SIDEWALK IMPROVEMENTS ON EAST
SIDE OF SULTANA BETWEEN BROADWAY AND LAS TUNAS DRIVE (Pursuant to Chapter 27,
Improvement Act of 1911, Streets and Highways Code)
City Manager Koski stated that at their January 15, 1985 regular meeting,
Council held a public hearing and requested the Superintendent of Streets to
order work to begin on construction of new sidewalks on the east side of Sul-
tana from Las Tunas to Broadway, wherever sidewalks were not currently installed
in accordance with Chapter 27 of the Streets and Highways Code. Construction
is now complete and has been field- checked by City and County staff and found
to be constructed as specified.
Mayor Dennis declared the public hearing open and invited anyone wishing to
speak to come forward.
There being no one wishing to address Council, Councilman Swain moved to close
.the public hearing, seconded by Councilman Atkins and unanimously carried.
Councilman Atkins moved to approve assessments as noted in the Superinten-
dent of Streets' Report of Completion of Construction and Costs of Construc-
tion; and direct the Superintendent of Streets to notify property owners of
assessments, seconded by Councilman Swain and unanimously carried.

8. COMMUNICATIONS:

A. TEMPLE CITY UNIFIED SCHOOL DISTRICT LETTER RE: 25TH ANNIVERSARY CELEBRATION
City Manager Koski reported receipt of a letter addressed to the members of
the City Council from Wesley Bosson, Superintendent, Temple City Unified
School District, showing appreciation for the invitation extended to the
Governing Board of the School District to attend the City's 25th Anniversary
Celebration. Mayor Dennis read the letter.
B. RESIGNATION OF JOHN GARVER FROM TRAFFIC COMMISSION
Mayor Dennis reported receipt of resignation from the Traffic Commission by
Commissioner John Garver effective August 1, 1985.
Councilman Tyrell moved to accept with regret the resignation of John Garver
from the Traffic Commission. effective August 1, 1985, seconded by Councilman
Atkins and unanimously carried.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Julie Estrada of the Temple City Times reported the many complimentary comments
made to her by residents of Temple City concerning the 25th Anniversary dinner
held on Friday, May 17. All comments she had heard were extremely favorable.
RECESS TO CRA:
At this time Council recessed to meet as the Community Redevelopment Agency; approved
the Minutes of the regular meeting held May 7, 1985; approved continuance of consider-
ation of precise plan of development for the southwest corner of Rosemead Boulevard
and Las Tunas Drive to June .4, 1985 meeting and authorized staff to obtain a prelim-
inary appraisal report; and accepted low bid of Robert F. Olson to initiate appraisals
of land within the Rosemead Boulevard Redevelopment Project and direct the Executive

Director of the Agency to enter into agreement for said services. The Minutes are s
forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:

11. MATTERS FROM CITY OFFICIALS:
A. ORDINANCE NO. 85 -563: URGENCY ORDINANCE REGARDING ALCOHOLIC BEVERAGES AND
FIREWORKS STANDS
At Council's direction, City Attorney Martin prepared and introduced Ordin-
ance No. 85 -563, an Urgency Ordinance of the City Council of the City of
Temple City adding subsection (m) to Section 3118 of the Temple City Munici-
pal Code.regarding alcoholic beverages and fireworks stands by title only.
Councilman Tyrell moved to waive further reading and adopt Urgency Ordinance
No. 85 -563, which takes effect immediately, seconded by Councilman Atkins and
carried on a roll call vote.

B. INTERIM REPORT - NOTICE OF TERMINATION RE: LOS ANGELES COUNTY EAP AMBULANCE
AGREEMENT NO. 3071
Council received staff. memo indicating that the County of Los Angeles will
terminate all EAP Ambulance Agreements with contract cities effective June
30, 1985 and will prepare a new agreement on or before that date. There will
be no interruption of existing services until such time as a new contract
can be negotiated. The County will absorb all cost regarding indigent resi-
dents. The City will have the option to pursue County ambulance services or
contract directly with a local provider.

Councilman Tyrell moved to suspend action regarding Los Angeles County EAP
Ambulance Agreement No. 3071 pending receipt and review of the proposed
replacement program, seconded by Councilman Gillanders and unanimously carried.
C. ANNUAL RABIES CLINIC - RECOGNITION OF VOLUNTEER SERVICES - DR. MANUAL FREITAS,
VETERINARIAN
Council received staff memo requesting public recognition of Dr. Manual Freitas
for his volunteer efforts in service to the community. Dr. Freitas has volun
teered his services free of charge for the last seven years and has been
especially helpful to residents by answering their questions and providing
them with literature free of charge regarding pet.care.
Councilman Atkins moved to present Dr. Freitas with a certificate of recogni-
tion at the June 4, 1985 Council meeting, seconded by Councilman Tyrell and
unanimously carried.
. REQUEST RECEIVED FROM PONY LEAGUE TO CONDUCT A YOUTH DANCE AT LIVE OAK PARK
Council was in receipt of a staff . memo and copy of letter from Temple City
Pony -Colt League requesting use of Live Oak Park for the purpose of holding
a fund- raising dance for 7th to 9th grade students on Saturday, June 15, 1985
from 7:00 to 9:30 p.m.
Councilman Tyrell moved to approve Temple City Pony -Colt League's request for
use of Live Oak Park on June 15, 1985 from 7:00 to 9:30 p.m. with the stipu-
lation that there be no food or drink inside the auditorium and subject to
the usual insurance requirements and adherence to all established rules, regu-
lations and policies for use of the park for this purpose, seconded by Council -
man Atkins and unanimously carried.
E. ACCEPTANCE OF PROPOSAL FROM RECREATION SYSTEMS, INC. - DESIGN SERVICE FOR
TEMPLE CITY PARK
City Council received staff memo giving the background information on the
proposal for design services for Temple City Park. At their regular meeting
of April 16, 1985, City Council authorized staff to retain the services of
a licensed architect to design a play apparatus area and shade shelter for
the park. Said project is to be partially developed with available State
Grant Funds in the amount of $15,060. Necessary funds in excess of State
Grant Funds is to be the responsibility of the City. The low bidder, Recre-
ation Systems, Inc. was chosen for the project; and, following a Council
Study Session on May 20, 1985, staff solicited and received a proposal from
Recreation Systems for a landscape analysis of the park. Said service will
include an inspection of all plant material, and recommendations for removal,
location and type of new plantings at a total additional cost of $250,with the
fee based upon the availability of detailed site information from the City.
Councilman Tyrell moved to accept the low bid of Recreation Systems, Inc. for
design services of play apparatus area and shade shelter; and landscape
analysis for Temple City Park, seconded by Councilman Gillanders and unani-
mously carried.
F. CAMPBELL BILL - SB1091 /CLAREMONT - McKENNA STUDY
Councilman Gillanders reported on his trip to Sacramento for the hearing
regarding the Campbell Bill on "No- property Tax Cities ". Upon arriving in
Sacramento, Councilman Gillanders was informed that the bill was taken off
hearing and that most of the cities had been notified of this fact and,
therefore, they were not in attendance. Subsequently, the bill was replaced
on the calendar with five Counties and their lobbyists being represented.
During the hearing, two of Senator Campbell's bills were combined, one of
which returns increased Motor Vehicle Tax funds to the Counties' special dis-
districts that would offset the monies that would go to the no- property tax
cities, along with other amendments to the bill. The position that several
of the assemblymen were taking was a "wait- and -see" attitude pending a
decision by Temple City as to whether or not they will proceed with litiga-
tion to be supported by the Claremont- McKenna Study.
Councilman Swain moved to authorize the Council to proceed with Phase II of
the Claremont- McKenna Study results, seconded by Councilman Tyrell and unani-
mously carried.

12. ADJOURNED TO CLOSED SESSION:
On motion by Councilman Atkins, seconded by Councilman Tyrell and unanimously
carried, the meeting adjourned at 8:15 p.m. to a Closed Session pursuant to
Section 54956.9 of the Government Code regarding pending litigation of TOWN &
COUNTRY, INC. vs. CITY OF TEMPLE CITY et al in the North Meeting Room of the
City Hall.
13. RECONVENED AS CITY COUNCIL:
City Council reconvened to their regular meeting at 8:50 p.m. City Attorney Mar ,
while in Closed Session, stated that the City had received civil rights inquiries
regarding: 1) the fortune - telling ordinance; and 2) our Latin character only sig
ordinance.
The City Council authorized the City Attorney to re -study these ordinances in order
to bring them into compliance with present -day civil rights limitations.
14. ADJOURNMENT:
On motion by Councilman Gillanders, seconded by Councilman Swain and unanimously
carried, the meeting adjourned at 8:55 p.m. The next regular meeting of the
City Council will be held Tuesday, June 4, 1985 at 7:30 p.m. in the Council Cham-
ber.
