HomeMy Public PortalAbout2005-030 Resolution Authorizing Publication of Ord 385Member Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-30 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 385 BY TITLE AND SUMMARY WHEREAS, the city council of the city of Medina has adopted Ordinance No. 385 an ordinance granting CenterPoint Energy Resources Corp., d/b/a CenterPoint Energy Minnesota Gas a nonexclusive franchise for the transportation, distribution, manufacture and sale of gas energy; and WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, Ordinance No. 385 is 6 pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk -treasurer shall cause the following summary of Ordinance No. 385 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 385. The ordinance establishes a franchise between Medina and CenterPoint for the transportation, distribution, manufacture and sale of gas energy in the city for a period of 20 years. The franchise grants CenterPoint the right to use the public ways and public grounds to place facilities used to serve customers within the city. The franchise establishes the terms and conditions of use of the public property by incorporating terms from the city's right-of-way management ordinance. The franchise also authorizes the city to require a franchise fee from CenterPoint. The city's franchise fee authority is preserved in this franchise but must be exercised by adoption of a separate ordinance. The full text of Ordinance No. 385 is available for inspection at Medina city hall during regular business hours. Chad M.
