Agreement & Private Rd Agreement for Robert Bradley 3000 Hamel RdMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2005-31 APPROVING FINAL PLAT, DEVELOPMENT AGREEMENT AND PRIVATE ROAD AGREEMENT FOR ROBERT H. BRADLEY FOR PROPERTY LOCATED AT 3000 HAMEL ROAD WHEREAS, Robert H. Bradley has requested approval of a Final Plat for "Leawood Farms" on property legally described on Exhibit A attached hereto; and WHEREAS, the City has prepared a development agreement and a private road agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve the final plat for Robert H. Bradley for Leawood Farms; and FURTHER, that the development agreement and private road agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement and private road agreement on behalf of the City; and 1. No wetland impact or buffer impact is allowed. FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved in accordance with the plans received by the City on April 15, 2005 and April 25, 2005, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City. 3. The private road agreement must be executed by the developer and the City. 4. Development standards shall be according to the preliminary plat approvals granted by the City Council on February 15, 2005, and as may be amended. FURTHER, that the following conditions be met prior to issuance of building permits: 1. The applicant must comply with the conditions of the Pioneer -Sarah Creek Watershed Management Commission as noted in the April 25, 2005 letter of approval. Resolution No. 2005-31 June 7, 2005 1 2. Park dedication fees must be paid in full, $8,000 per unit, $72,000 total, upon issuance of the first building permit. 3. The developer must submit title evidence satisfactory to the City Attorney. 4. The developer must sign the conservation easement and submit to the City Attorney. 5. The applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plat and related documents. 6. The applicant must comply with all City, County and State requirements for septic and well installation. Copies of such permits shall be provided to the City. 7. The Building Inspector must approve the soil percolation tests and septic system designs prior issuance of building permits. Septic sites must be staked prior to beginning any construction on site. 8. The Building Inspector must inspect the existing septic system to ensure compliance with Rule 7080 and City standards. 9. The developer must notify buyers in writing of the horse trail location. 10. The developer must notify buyers of Lot 6 and Lot 7 of the road easement with the adjoining property owners to the east. While two 60-foot easements exist, the City requires use of the existing 60-foot right-of-way access to Hamel Road. 11. The developer shall reach agreement with the existing users of the shared road easement to Lot 6 and Lot 7 and provide to the City a maintenance agreement in a form that is satisfactory to the existing owners and the City. This agreement shall be in place prior to issuance of any permits for Lot 6 and Lot 7. 12. The building plans must include grading, drainage and erosion control plans with each building plan submitted. 13. The applicant shall comply with all conditions from the City Engineer's memo dated May 3, 2005. 14. The landowners must comply with the Wetland Conservation Act. 15. Best Management Practices (BMPs) for erosion control shall be employed. 16. The final plat must be filed with the County Recorder within 60 days of the date of the City Council resolution granting final approval or the final plat shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council.
