V. CONSENT AGENDA
A. Resolution Establishing 2023 Appointments and Designations to Various City Services,
Authorities, Commissions and Agencies – Mayor Martin has reviewed this document and
made the City Council liaison recommendations. The Park Commission and Planning
Commission liaisons, along with the commission chairs and staff members conducted
interviews for the open Park and Planning Commission positions and have included their
recommended appointments in the attached resolution.

VII. PRESENTATIONS
A. Medina Legislative Priorities Discussion with Representative Kristin Robbins –
Representative Kristin Robbins will be present at the meeting. Staff and Council
identified several legislative priorities at the December 20th City Council Meeting to
discuss with Representative Robbins.
B. Resolution Recognizing City Attorney Ron Batty for 36 Years of Service to the City of
Medina – Ron Batty has contributed greatly to Medina during his 36 years of public
service to the City. Mayor Martin will read the resolution and honor Ron for his 36 years
of service.

VIII. NEW BUSINESS
A. Fire Assets Discussion Update – Mayor Martin, Council Member DesLauriers and staff are
meeting with Hamel Fire and Loretto Fire on January 3rd on this topic and will provide a
verbal update at the City Council Meeting.

DECEMBER 20, 2022
The City Council of Medina, Minnesota met in work session on December 20, 2022, at 6:00 p.m.
at the Medina City Hall, 2052 County Road 24, Medina, MN.
I. Call to Order
Members present: Cavanaugh, DesLauriers, Martin, Albers, Reid
Members absent: None
Also present: City Administrator Scott Johnson, City Clerk Caitlyn Walker, Finance
Director Erin Barnhart, Public Works Director Steve Scherer, Planning Director Dusty Finke,
and Police Officer Dave Hall
II. Republic Services/Randy’s Sanitation Agreement Discussion
Matt Herman and Deb Gatz of Republic Services presented a five-year renewal to the existing
agreement for collection and disposal of residential solid waste, recyclables, and compostables.
Gatz presented on the overall relationship between the City and Randy’s Sanitation. Randy's
Sanitation has been acquired by Republic Services. Randy’s Sanitation has been the sole hauler
for Medina since 2008. Gatz explained that with the exclusive contract, Randy’s has provided
extra consideration of the roads, provides free service to city buildings and parks, and provides
extra services at the Clean-Up Day. Herman presented on the proposed offer of the five-year
extension with a 4% increase each year. He explained that the contract language provided to
Council is a rough copy. Herman shared he believes these increases are modest during a time of
historic inflation and increasing fuel and labor costs. Herman compared the proposed costs to
other cities, which demonstrated the proposed prices provides a modest increase to Medina
residents. He also explained the Blue Bag Organics program is an important part of their services
that is not provided by other haulers in Hennepin County at the scale that exists in Medina.
The Council expressed general support for the proposed pricing structure, however, Mayor
Martin presented several issues with the proposed contract language. She stated that almost all of
the new language added by Republic Services to the existing contract needs to be changed or
removed as it makes the contract essentially useless in providing quality prices and services to
residents. She stated the contract needs to be presented to the City with significant changes
before the City Attorney should review the contact. She also stated the contract issues need to be
resolved quickly, or the city should elicit bids from other haulers.
Herman thanked the Council for their feedback and said he understood their concerns with the
contract language. He said he will work with Republic’s attorneys to present new contract
language the following day. He expressed he is confident they can find language that will
address all of Mayor Martin’s concerns. Mayor Martin thanked Gatz and Herman for their time.
III. Affordable Housing Policy Discussion
Planning Director Dusty Finke presented on the work staff have been doing for the City’s
affordable housing policy. Finke explained that the City needs to create a housing action plan

and establish affordable housing goals to meet the requirements of participating in the Livable
Communities Act (LCA). The City has already agreed to the goal of creating 134-244 affordable
housing units for the 2021-2030 period. The housing action plan can establish additional housing
goals. Therefore, staff is requesting council input on additional goals that should be included in
the plan. Additionally, the City has been levying funds to meet the minimum affordable and
lifecycle housing opportunity amount (ALHOA) that communities that enroll in LCA are
supposed to spend on an annual basis. The City has not spent these funds and staff is requesting
input on how these funds should be spent in alignment with the City’s housing goals.
The City Council agreed they would like the City to focus on creating units for the 30-50% area
medium income affordability. They also want to preserve and improve the low and middle
housing stock that already exists in the city. Council expressed interest in creating affordable
housing that would allow more people that work in Medina to live here. For the ALHOA funds,
Council discussed creating a policy that provides a fee waiver per affordable unit that helps meet
the City’s housing goals. Council also discussed the different situations in which the City would
consider supporting Tax Increment Financing, such as for supporting mixed-income housing,
and more rental and multifamily housing. Staff will take this feedback provided by Council to
begin drafting the housing plan for Council review at a future date.
IV. Adjourn
Albers made a motion to adjourn the meeting at 7:02 p.m. on December 20, 2022. Cavanaugh
seconded the motion.

Scherer stated that staff is working to establish ice for the skating rinks while managing 5
snow clearing. He stated that there are two candidates for the open position on the Park 6
Commission. He noted that the December meeting has been canceled. 7

Finke reported that the Planning Commission did not hold a December meeting. He 10
stated that at the January meeting the Commission will most likely review the updated 11
plans for Meander Park and Boardwalk. 12

DesLauriers agreed that case should go back before the Planning Commission before 14
returning to the Council. 15

Albers asked if a date has been set for interviewing candidates. 17

Finke provided different options and advised that he would follow up to find the best 19
date, noting that there are three candidates for the two positions. 20

A. Discuss Key Items for State Funding for Representative Kristin Robbins 24

Johnson noted that Representative Robbins will be attending the January meeting and 26
advised that staff developed a draft of key items that could be discussed. He asked for 27
input from the Council. 28

Martin commented that while almost everyone in the community would have access to 30
broadband, there is still the matter of cost to connect. She stated that her two neighbors 31
split the cost for connection, paying $3,000 each. She commented that most people do 32
not need cable television but require internet service for school or work. She 33
commented on the poor internet service available to residents which is provided for the 34
same cost as the better internet service in neighboring communities. She stated that 35
she would like to see a legislative push for those utility companies to invest in 36
infrastructure in the communities served. 37

Albers asked if the list needs to be prioritized. He agreed that all the items listed make 39
sense. 40

DesLauriers agreed that all the items are important. 42

Cavanaugh provided a suggestion about providing Wi-Fi service throughout the 44
community. 45

Johnson stated that staff worked with the Council to establish a date of Thursday, 48
January 4, 2024 for the employee appreciation event for 2023. 49

Albers complimented public works on the excellent job they have been doing clearing 1

Martin commented that there were a few meetings the previous day at City Hall with the 4
development branch of Interfaith Outreach to talk about a potential housing development 5
with Common Bond. She provided details on the potential timing for additional 6
consideration of the project. She stated that some members of the Council and staff 7
also met with the Loretto, and Hamel fire department groups related to the consolidation 8
of those two groups into one and provided a brief update. She stated that they also met 9
with representatives from the Long Lake Fire Department about potential shared 10
services with Orono. 11

Albers asked if funding from the State would be helpful in these situations and 13
suggested it be added to the list for the upcoming discussion with Representative 14
Robbins. 15

p.m. to discuss active litigation filed against the City by Chris Sele, Michelle Sele, and 28
Brad Sankey with the City’s legal counsel pursuant to Minn. Stat. 13D.05, Subd. 3(b). 29

Discussion Topics for January 3, 2023 Meeting with Rep. Robbins:
• Funding for Future Fire Station and Infrastructure costs to serve a new area fire district - $12 to
$15 million
• Expand broadband options in Medina – Regulatory issue with area broadband/cable companies

RESOLUTION NO. 2023-XX
RESOLUTION RECOGNIZING AND HONORING CITY ATTORNEY RON BATTY
FOR 36 YEARS OF DEDICATED SERVICE TO THE CITY OF MEDINA
WHEREAS, City Attorney Ron Batty has provided years of public service to the Medina
community starting November 25, 1986; and
WHEREAS, throughout City Attorney Ron Batty’s service to the City of Medina several
significant projects have taken place including:
The Uptown Hamel Tax Increment Financing Redevelopment District and
infrastructure improvements;
Four decennial Comprehensive Plan reviews and updates;
Public Improvement Projects which allowed for the paving of streets throughout
the community;
Acquisition of land and financing for construction of the City’s water treatment
plant, and installation of several water supply wells and the raw water line;
Completion of numerous park developments and improvements including Hamel
Legion Park, the Park at the Fields of Medina, Hamel Community Building,
Hamel Field House, Medina Lake Preserve, Rainwater Nature Preserve, Tomann
Preserve, and acquisition of new park land at Chippewa Road/Mohawk Drive;
Guiding Medina with planning the renovations for the new Public Works/Police
Facility at 600 Clydesdale Trail; and
Creation of a Financial Management Plan and Road Improvement Funding
Policy;
New Commercial projects including approvals including Rockler, Twinco-
Romax, Polaris, Thorpe Distributing, Hennepin County Public Works, Medina
Clydesdale Marketplace, Hamel Station, Open Systems International, and
Wealshire;
Residential Developments including Foxberry Farms, Wild Meadows, Medina
Highlands, Medina Ridges, Bridgewater, The Enclave, Fields of Medina, Deer
Hill Preserve, Reserve of Medina, Villas at Medina Golf and Country Club,
Okalee Senior Housing, Marsh Pointe Preserve, and Weston Woods; and

WHEREAS, Mr. Batty braved the elements and assisted residents by unloading tons of
garbage at dozens of City Clean-Up Days and impressed City staff with his cooking skills after
winning the only City staff Chili Cookoff in which he took part; and
WHEREAS, Mr. Batty provided extraordinary counsel and guidance on general business
matters, public improvement projects and matters related to the efficient provision of services to
the City; and
WHEREAS, Mr. Batty has been a trusted member of the City’s staff team, contributing
to a positive workplace with him calm and reassuring demeanor, and has been a great mentor for
staff members throughout his tenure.
THEREFORE, BE IT RESOLVED, that the City Council of the City of Medina acknowledges
and thanks City Attorney Ron Batty for his 36 years of service to the community.

Land Use Application Review
A) Meander Park and Boardwalk – Meander Rd, east of Arrowhead Dr – Medina Ventures had
requested PUD General Plan and Preliminary Plat approval for a development to include four
residential units north of Meander Rd, and commercial uses south of Meander Rd including a
venue, restaurant, daycare, and speculative retail space. The Planning Commission held a public
hearing on November 9 and recommended approval, provided the twinhomes were not used for
lodging units. The Council reviewed at the December 6 meeting, provided feedback, and tabled
the application to allow the applicant to finalize plans. Staff intends to present updated
architectural information to the Planning Commission on January 10 and City Council on
January 17.
B) Loram/Scannell Medina Industrial – Loram and Scannell have submitted materials for the City
to prepare an EAW for a warehouse/industrial development east of Arrowhead Drive, south of
Highway 55, to the south of Loram’s existing facility. The council approved the findings of fact
and made a negative declaration on the need for an EIS at the April 5 meeting. Staff will route
the record of decision as required. The applicant has now also applied for preliminary plat and
site plan review approval for construction of approximately 398,000 s.f. of office warehouse on
three lots. The Planning Commission held a public hearing at their August 10 and October 11
meetings and recommended approval on a 4-2 vote. The City Council reviewed the wetland
replacement plan on October 18 and directed staff to prepare a notice of decision. Staff presented
and Council approved the wetland application at the December 6 meeting. The applicant has also
submitted updated plat and plans, which are under review and staff will present after review.
C) Pioneer Highlands Final Plat – Onyx Investments has requested final plat approval of a four-lot
rural subdivision located south of Pioneer, east of Willow Drive. Staff is reviewing the
information and intends to present to City Council on January 17, 2023.
D) Knappenberger Rearrangement and Easement Vacation – Gail Knappenberger has requested
approval of a lot line rearrangement between two properties in common ownership. The
applicant also requests to vacate easements adjacent to the relocated property line and proposes
to grant replacement easements next to the new line. City Council granted approval on
November 1. Staff will work with the applicant to record necessary documents to finalize the
requests.
E) Cates Ranch/Willow Drive Warehouse Industrial – Comprehensive Plan Amendment– Oppidan
has submitted a concept plan review for a 310,000 square foot warehouse/office development
east of Willow Drive, north of Chippewa Road. The applicant is requesting feedback prior to
proceeding with full design of their project. The Planning Commission reviewed and provided
comments on October 11 and Council reviewed on October 18. Staff will await formal
application.
F) BAPS Site Plan Review – 1400 Hamel Road – BAP Minneapolis Medina has requested an
amendment to their approved site plan review. The applicant has submitted updated architectural

information based on the City’s updated regulations pertaining to architectural elements. The
applicant has also proposed minor adjustments to the site layout previously approved. The
Council reviewed at the November 9 meeting and recommended approval. The Council
approved the amended Site Plan Review at the December 6 meeting. The applicant has indicated
that they intend to start construction during the spring of 2023.
G) Adam’s Pest Control Final Plat – Jan Har LLC has requested final plat approval for a two lot
subdivision for development of an office north of Hwy 55 and west of Willow Drive. The
property owner to the east of the site has not agreed to provide right-of-way, so the applicant
proposes access directly to Highway 55. Council granted final approval at the September 20
meeting. Construction is underway.
H) 500 Hamel Road Apartment Concept Plan – Medina Apartments LLC has requested review of a
concept plan review for development of a 97-unit apartment building at 500 Hamel Rd. The
Planning Commission held a public hearing at their August 10 meeting and Council provided
comments on August 16. The developer met with neighbors on September 12 and the parties
have indicated that they will meet again to discuss the project.
I) Hamel Townhomes Final Plat – 342 Hamel Rd – Hamel Townhomes, LLC has requested final
plat approval for a 30-unit townhome development. The Council granted final plat approval on
August 16. Staff will work with the applicant to finalize documents prior to beginning of
construction.
J) Ditter Heating and Cooling Site Plan Review – 820 Tower Drive – Ditter Heating and Cooling
has requested a Site Plan Review for an approximately 5,000 square foot addition to its building.
The application is incomplete for review and will be scheduled for a hearing when complete.
K) Pioneer Trail Preserve – This project has been preliminarily approved and the City is awaiting
final plat application.
L) Johnson ADU CUP, St. Peter and Paul Cemetery – The City Council has adopted resolutions
approving these projects, and staff is assisting the applicants with the conditions of approval in
order to complete the projects.
Other Projects
A) Hennepin County Elevate Business – I met with Hennepin County Community Works related
to their Elevate Business consulting services for small businesses. Hennepin County is
requesting local governments partner in the program. Medina’s share for 2023 is proposed at
$1250, would replace Medina’s contribution toward the Open to Business program next year.
B) Diamond Lake Regional Trail – staff has drafted amendments to a cooperative agreement with
Three Rivers related to reimbursement for land the City acquires for the future trail. Staff
intends to present the agreement to Council in early 2023.
C) Vacation – I am out of the office December 26-30. Happy Holiday and a Happy New Year!

STREETS
• Public Works has been fighting snow, wind, and very cold weather for the past two
weeks. The roads are now in good condition again.
• Lisa and I are preparing the 2023 street material bid packet with the intention to have
pricing ready to submit to Council in February. I have contacted several contractors
to advise them the City has numerous paving projects this year, and we need them to
bring their best foot forward when bidding.
• I have been utilizing Lisa’s skill set to create a pavement management plan
spreadsheet with formulas for a more efficient means to calculate and track projects,
pricing, and long-term budget planning.
WATER/SEWER/STORMWATER
• The filter rehab project is well on its way at the water treatment plant. We are
currently waiting for testing to be done on the existing media to determine if it is
hazardous or not.
• Sewer cleaning and televising will begin as soon as we have some milder weather
conditions.
• Public Works received our first shipment of new radios for the reading system
upgrade this week. We are working on a plan to install them in the coming months.
PARKS/TRAILS
• Interviews for openings on the Park Commission are complete and our
recommendations are in the 2023 appointments.
• Maintenance of the trails, ice-skating rinks, and the snow hill is ongoing, and weather
dependent. Public Works has not had a lot of time to spend on the parks with all the
snow, but we are keeping the trails open, and the rinks cleaned off as we try for better
ice.
MISC
• Recently the Minnesota Pollution Control Agency made updates to the hazardous
material generator documentation. We are in the process of reviewing the regulations
to ensure the City remains compliant.
