CITY OF MEDINA
RESOLUTION NO.2005-32
RESOLUTION GRANTING FINAL PLAT APPROVAL FOR
INDEPENDENCE BAY
WHEREAS, the city of Medina (the "City") has received an application from Thomas J.
Terry and Gara J. Gehring, husband and wife ("Owners") regarding the platting of certain land in
Medina located generally on Fern Street in the Independence Beach area, which land is legally
described in Exhibit A attached hereto (the "Property"); and
WHEREAS, the plat of the Property submitted by the Owners was reviewed by the
planning commission on May 10, 2005 and, following a public hearing thereon as required by law,
the planning commission recommended approval of the plat, subject to certain terms and conditions;
and
WHEREAS, the Owners also received a recommendation for approval of a 500 square foot
variance from the 9,000 square foot minimum lot size in the urban residential zoning district; and
WHEREAS, on May 17, 2005, the city council reviewed the variance and plat for
conformance with the ordinances of the City and considered the recommendations of the planning
commission, and heard the comments of the Owners and other interested parties regarding the
matter; and
NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Medina,
Minnesota that final approval of the plat of Independence Bay is hereby granted, subject to the
following terms and conditions:
1. The Owners must pay an administrative fee to the city in an amount sufficient to
reimburse the city for the costs of reviewing the plat of the Property; and
2. The Owners must pay all connection fees associated with the plat; and

3. The Owners must file the final plat for the Property with Hennepin County within 60
days of the date of this resolution or the final approval hereby granted shall be null and void; and
4. The Owners shall comply with the conditions stated in the Public Works memo
dated March 28, 2005; and
5. The Owners shall comply with the conditions stated in the Engineer's memo
dated April 1, 2005; and
6. The Owners shall submit any permits to the Pioneer -Sarah Creek Watershed for
review.

The motion for the adoption of the foregoing resolution was duly seconded by member Smith and
upon vote being taken thereon, the following voted in favor thereof:
Weir, Workman, Cavanaugh, Smith
and the following voted against same: (Absent: Brinkman)
None
Whereupon said resolution was declared duly passed and adopted.
