HomeMy Public PortalAboutM 1978-05-18 - CC_spSPECIAL MEETING MAY 18, 1978 The City Council of the City of Lynwood met in a special session in the City Hall, 11330 Bullis Road, on above date at 5 p.m. Mayor Higgins in the chair. Councilmen Byork, Morris, Rowe and Higgins answered the roll call. Councilman Green was absent. Also present was City Manager Valliere. The City Manager reported that the meeting was called to request Council to authorize two additional signatures for checks/warrants in the absence of the City Treasurer. In the past the City Treasurer has been the only person auth- orized to sign checks/warrants and to make bank deposits and in her absence, the Deputy City Treasurer performed these duties. In view of the absence of the City Treasurer and the resignation of the Deputy City Treasurer, the Mayor signed paychecks for City employees on May 18, 1978, citing Govern- ment Code Section 40602: "40602. Signature. The Mayor shall sign: (a) All warrants drawn on the city treasurer. (b) All written contracts and conveyances made or entered into by the ci ty. (c) All instruments requiring the city seal. The legislative body may provide by ordinance that the instruments described in (a), (b) and (c) be signed by an officer other than the mayor." Councilman Morris requested the following be made part of the record: that the City Treasurer by his absence is placing City employees in financial jeopardy by not fulfilling the functions of City Treasurer as specified in the Government Code; that the community expects service from the City Council, City management and City departments and that no less service is expected from the City Treasurer; that the City Manager, City Attorney, former City Treasurer have all had conferences with the City Treasurer regarding his duties, but to no avail; that the City is being placed in jeopardy by Mr. Richman's irresponsibility. Councilman Byork stated that the elected City Treasurer should sign the checks if he was here. Councilman Rowe stated that the people elected Mr. Richman for the office of City Treasurer on the presumption that he would perform the functions of that office and that if Mr. Richman does not or will. not perform these functions, it will be a matter for the electorate to act upon. It was moved by Councilman Byork, seconded by Councilman Rowe, that Councilman Higgins and Councilman Morris, be authorized to sign checks/warrants. Roll Call: Ayes: Councilmen Byork, Morris, Rowe, Higgins. Noes: None. Absent: Councilman Green. Councilmen Byork, Green, Morris, Rowe and Higgins answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. The Mayor announced that members of the CarlinrPalm Neighborhood Association requested permission to address the Council. Mr. Robert Henning, 3952 Carlin Avenue, Vice President of the association, stated members wished to speak in opposi- tion to the overnight parking ordinance. Mr. William McCall, 3713 Palm Avenue, member of the Lynwood Labor Council Association, spoke in opposition to the ordinance, stating it would create a hardship on people who have garages in an alley as parking late at night would set off burglar alarms. Mr. A. Shapel, 3910 Palm Avenue, spoke in opposition to t$e ordinance stating that it would be an imposition on residents who have late-night visitors and that it would cause people to park on lawns. Mr. Robert Downs, 3920 Carlin Avenue, President of the association, spoke in opposition to the ordinance stating he was concerned about enforcement. He noted the lack of supporting statistical data and requested Council to defer enforcement of the ordinance pending further study. The Mayor asked for a show of hands in opposition to the ordinance; the majority present expressed opposition. It was moved by Councilman Green, seconded by Council- man Morris, that the Sheriff be directed not to enforce the overnight parking ordinance pending resolution of contingencies.
